(a) to formulate major public policies and measures in market supervision, public services, social management and environmental protection;
(two) the preparation and revision of economic and social development plans and annual plans, municipal land and space master plans, important special plans and regional plans determined by the municipal government;
(three) to formulate major public policies and measures for the development, utilization and protection of important natural and cultural resources;
(four) to decide on major government investments and major public construction projects;
(five) to formulate or adjust the items and standards of administrative fees and government funds, and implement the prices of important public utilities and public welfare services set by the government;
(six) to decide on other major issues that have a significant impact on economic and social development and involve major public interests or the vital interests of the public.
Where there are other provisions in laws and administrative regulations on the decision-making procedures for matters specified in the first paragraph of these Provisions, those provisions shall prevail. These Provisions shall not apply to government legislative decisions and emergency decisions. Article 4 When making major administrative decisions, the municipal government shall, under the leadership of the municipal party committee, fully implement the party's line, principles, policies and decision-making arrangements, and make the party's leadership run through the whole process of major administrative decisions. Article 5 When making major administrative decisions, the municipal government should follow the principle of scientific decision-making, implement the development concept of innovation, coordination, green, openness and enjoyment, proceed from reality, apply science and technology and methods, respect objective laws, and adapt to the requirements of the city's economic and social development and comprehensive deepening reform. Article 6 When making major administrative decisions, the municipal government should follow the principle of democratic decision-making, fully listen to opinions from all sides, and ensure the people and all sectors of society to participate in decision-making through various channels and forms such as public consultation, symposiums, hearings and questionnaires. Seventh municipal government to make major administrative decisions, should follow the principle of decision-making according to law, strictly abide by the statutory authority, perform legal procedures according to law, to ensure that the decision-making content conforms to laws, regulations, rules and other relevant provisions of the state, province and city. Article 8 If the major administrative decisions of the municipal government are subject to the supervision of the Municipal People's Congress and its Standing Committee according to law, and fall within the scope of major issues discussed and decided by the Municipal People's Congress and its Standing Committee according to laws and regulations, or should be reported to the Standing Committee of the Municipal People's Congress before promulgation, it shall be handled in accordance with the relevant provisions. The annual decision-making list is determined by the municipal government, announced to the public with the consent of the municipal party Committee, and adjusted according to the actual situation. Tenth major administrative decisions should be regarded as an important part of the assessment and evaluation of decision-making matters (hereinafter referred to as decision-making units), decision-making matters implementation units (hereinafter referred to as decision-making execution units) and their leaders. Eleventh municipal government office is responsible for the collection and meeting arrangement of the annual decision list, and is responsible for organizing the post-decision evaluation.
The decision-making undertaking unit is responsible for organizing public participation, expert argumentation and risk assessment.
The municipal judicial administrative organ is responsible for the legality review of decision-making matters.
Audit institutions shall supervise decision-making matters in accordance with regulations.
Other departments of the municipal government shall do a good job in decision-making matters in accordance with their respective responsibilities. Chapter II Formation of Draft Decision Section 1 Decision Initiation Article 12 After making research and demonstration on the suggestions on decision-making matters put forward by various parties, the municipal government shall decide whether to start the decision-making procedure:
(a) the decision-making suggestions put forward by the leaders of the municipal government shall be submitted to the relevant units for study and demonstration;
(II) If the working department of the municipal government or the district governments (including Wuhan East Lake New Technology Development Zone, Wuhan Economic and Technological Development Zone, East Lake Eco-tourism Scenic Area, Wuhan Xingang, Wuhan Yangtze River New Town Management Committee, the same below) put forward suggestions on decision-making matters to the municipal government, it shall demonstrate the main problems to be solved, the reasons and basis for the suggestions, the preliminary plan to solve the problems and its necessity and feasibility;
(III) Municipal People's Congress deputies and CPPCC members put forward suggestions on decision-making matters through suggestions, motions and proposals, and citizens, legal persons or other organizations put forward suggestions on decision-making matters to the municipal government or through relevant departments of the municipal government, and submit them to relevant units for study and demonstration. Thirteenth municipal government decided to start the decision-making process, should be clear in accordance with the following provisions:
(a) the decision-making matters put forward by the leaders of the municipal government shall be determined in accordance with the statutory duties of the municipal government departments. Involving multiple departments, the main responsible department is the decision-making unit; There is no main responsible department, and the decision-making undertaking unit is designated by the leaders of the municipal government;
(two) the decision-making matters put forward by the working department of the municipal government or the district government, and put forward the department or the district government as the decision-making undertaking unit;
(three) the decision-making matters put forward by the Municipal People's Congress deputies and CPPCC members through suggestions, motions and proposals, and the lead undertaking department of the suggestions, motions and proposals is the decision-making undertaking unit;
(four) the decision-making matters put forward by citizens, legal persons or other organizations to the municipal government, and the relevant departments of the municipal government are the decision-making contractors.
In case of items (3) and (4) of the preceding paragraph, the decision-making undertaking unit shall invite NPC deputies, CPPCC members, citizens, legal persons or other organizations who put forward decision-making matters to participate in the drafting of major administrative decision-making draft (hereinafter referred to as the draft decision).
