Provisions of the State Radio Regulatory Commission on the Development of Radio Transmitting Equipment

Article 1 In order to strengthen the management of the development of radio transmitting equipment, these Provisions are formulated in accordance with the Regulations of People's Republic of China (PRC) Municipality on Radio Management. Article 2 All units that develop (including trial production, the same below) radio transmitting equipment within the territory of People's Republic of China (PRC) must abide by these provisions. Article 3 The radio transmitting equipment mentioned in these Provisions refers to radio communication, navigation, positioning, direction finding, radar, remote control, telemetry, broadcasting, television and other devices that emit radio waves, excluding industrial, scientific research, medical equipment, electrified transportation systems, high-voltage power lines and other electrical devices that can radiate electromagnetic waves. Article 4 The development of radio transmitting equipment must conform to the relevant national technical standards and the relevant provisions on radio management. Article 5 The development of radio transmitting equipment must go through the examination and approval procedures in accordance with the following procedures:

(a) the research unit must submit the application form for research and development (see annex 1), the approval documents of the competent department of the research unit, the feasibility report and technical data and other related documents. The central state organs and their directly affiliated units in Beijing receive and submit application forms from the Office of the State Radio Regulatory Commission (hereinafter referred to as the Office of the State Radio Regulatory Commission), while other units receive and submit application forms from the offices of the radio regulatory commissions of all provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as the offices of the radio regulatory commissions of all provinces, autonomous regions and municipalities directly under the Central Government), and report them to the Office of the State Radio Regulatory Commission after giving their opinions.

Article 6 The State Editorial Office and the relevant provincial, district and municipal editorial offices shall supervise and inspect the approved research and development projects. If the research unit fails to complete the research task within the specified time, it must apply to the national non-commissioned office for extension, otherwise the development approval document issued by the national non-commissioned office will automatically become invalid. Article 7 If the development of radio transmitting equipment requires effective transmission, temporary station establishment procedures must be handled in accordance with the relevant provisions on the establishment of radio stations. Article 8 After the development is completed, the relevant scientific and technological management institutions shall organize technical appraisal in accordance with the appraisal methods of scientific and technological achievements issued by the State Science and Technology Commission or other relevant provisions. The technical indicators of the developed equipment shall meet the requirements of the approval document for the development of radio transmitting equipment issued by the national inspection-free office, and the identification documents and materials shall be reported to the national inspection-free office and the local provincial, district and municipal inspection-free office for the record. Article 9 The development of military radio transmitting equipment shall be handled in accordance with the relevant provisions of the State and the Radio Management Committee of China People's Liberation Army. Tenth in violation of the provisions of the development of radio transmitting equipment, according to the relevant provisions of the state radio management will be punished. Eleventh these Provisions shall be interpreted by the Office of the State Radio Regulatory Commission. Article 12 These Provisions shall come into force as of the date of promulgation.
