Chapter 1 General Provisions Article 1 In order to strengthen road transport management, maintain the order of the road transport market, and protect the legitimate rights and interests of road transport operators, cargo owners and other parties, in accordance with relevant national regulations and in light of the actual situation of this autonomous region, Enact these regulations. Article 2 The term "road transportation" as mentioned in these Regulations refers to road passenger transportation, cargo transportation, vehicle maintenance, handling, loading and unloading and transportation services. Article 3 All units and individuals engaged in commercial road transport activities within the administrative area of ??this autonomous region must abide by these regulations.

The term "commercial road transport" as mentioned in these regulations refers to road transport that provides transportation services to the society for the purpose of profit and incurs various forms of cost settlement.

This regulation does not apply to Yinchuan City public transport vehicles (including small public transport vehicles and taxis) and Shizuishan District public transport vehicles engaged in passenger transportation within the city. Article 4 Road transportation implements the principles of coexistence of multiple economic components, fair competition, and coordinated development.

Road transport operators should abide by professional ethics and provide safe, punctual, fast, economical and convenient services for the development of the national economy and society in accordance with the requirements of making it easier for people to travel and the smooth flow of goods. Article 5 The transportation administrative departments of the people's governments at or above the county level shall be in charge of road transportation within their respective administrative regions. The specific management work of road transportation shall be implemented by the road transportation management agency (hereinafter referred to as the transportation management agency) under the transportation administrative department.

The public security, industrial and commercial administration, urban construction, agricultural machinery management, technical supervision, price, and taxation departments at all levels perform their respective duties according to the division of responsibilities, and coordinate with the transportation administrative department to do a good job in road transportation management. Chapter 2 Supervision and Management Article 6 To apply for commercial road transportation, one shall have equipment, facilities, funds, professionals and other conditions suitable for the type, project and scope of its business, and shall obtain approval from the transportation management agency at or above the county or city level. Road transport business license certificate, and go to the local industrial and commercial administration authority for registration with the certificate. Only after obtaining the business license after approval can you operate.

Foreign investors who apply to engage in commercial road transportation must go through the approval procedures in accordance with relevant national regulations.

Road transport operators shall engage in business activities within the approved scope. Article 7 When purchasing vehicles for commercial transportation, the principle of application first and then purchase shall be adhered to, and the approval procedures shall be handled by the transportation management agencies at or above the county or city level in accordance with national regulations.

Units and individuals engaged in passenger transportation and cargo transportation shall register their vehicles with the transportation management agency at or above the county or city level where the vehicle registration is located, and apply for the "Road Transport Regulations of the People's Republic of China and the People's Republic of China". Certificate" (hereinafter referred to as the road transport certificate), the road transport certificate should be carried with the vehicle. Article 8 The technical equipment and technical conditions of vehicles engaged in transporting passengers and goods shall comply with national standards or industry standards.

Transportation operators must abide by state regulations on the rational use of vehicles, mandatory maintenance, and repairs as appropriate, and accept comprehensive vehicle performance testing.

It is prohibited to use vehicles that fail to pass the test and vehicles that have reached national scrappage standards or are included in the national mandatory scrappage scope for transporting passengers and goods. Article 9 Road transport operators that merge, split, change their business scope or go out of business must report to the original approval authority for approval, and go to the industrial and commercial administration and taxation departments to go through the change or deregistration procedures in accordance with regulations. Article 10 When accepting the relevant applications listed in Articles 6, 7 and 9 of these Regulations, the transportation management agency shall make a written approval decision within thirty days from the date of receipt of the application. Article 11 The transportation management agency shall conduct annual inspections on the business qualifications, behavior and technical status of the vehicles of road transport operators. Only those who pass the inspection and have been reviewed and registered by the industrial and commercial administrative department may continue to operate. Article 12 The transportation administrative department of the autonomous region shall, in accordance with the national price management regulations, formulate adjustments to transportation prices and charging standards or charging behavior rules for vehicle maintenance, transportation and loading and unloading rates, transportation services, etc., and shall publish and implement them after being reviewed and approved by the price department of the autonomous region.

Road transport operations should clearly mark prices. Article 13 Road transport business certificates shall be uniformly printed by the transportation administrative department of the autonomous region in accordance with national regulations.

Road transport passenger tickets, cargo tickets and other special invoices are printed or supervised by the taxation department of the autonomous region. The transportation management agencies at the county, city and above levels collect (purchase) them from the taxation department and are responsible for management and distribution. No unit or individual may forge, resell, transfer or alter. Article 14 Road transport operators shall pay road transport management fees to the transport management agency in accordance with national regulations.

The transportation management fees collected by transportation and management agencies at all levels should be turned over to the transportation and management agencies of the autonomous region in full level by level, stored in special accounts, collected and disbursed in a unified way, and used for road transportation management undertakings. Any unit or individual May not be used for other purposes. Article 15 Road transport operators shall submit statistical data to local operating agencies in accordance with national and autonomous region regulations. Article 16 The transportation management agency is responsible for supervising and inspecting illegal and illegal behaviors in road transportation operations. Road transport supervision and inspection personnel may enter road transport-related operating units, work sites, or road transport inspection stations established with the approval of the People's Government of the autonomous region to conduct inspections. When performing their duties, supervisory and inspection personnel shall dress uniformly, wear uniform signs, and present road transport inspection certificates issued in accordance with unified national regulations. Special vehicles for traffic law enforcement shall be equipped with special sign lighting.
