What formalities and materials are needed for marriage registration
Application, examination and registration of the license are the three links of the marriage registration process.
(a) Application
Couples who meet the requirements for marriage registration can bring the relevant documents, supporting materials and registration photos, and both parties together to the marriage registration authorities in the place of one party's permanent residence, the two parties filled out the application for marriage registration documents on the spot.
The documents required for marriage registration depend on the individual's situation. For example, if a Chinese citizen applies for marriage in China, he or she needs to have his or her ID card, hukou (household registration book), a certificate of marriage examination, a certificate of singleness, and a declaration that he or she is not related to the other party by blood (blood relatives in the direct line and collateral blood relatives within the third generation), and if the person is divorced, he or she should also bring the divorce certificate.
Foreigners applying for marriage in China (including ethnic Chinese, resident and temporary foreigners, and foreign nationals settling in China) need to bring along their valid passports, Alien Residence Permits or entry and residence certificates for temporary entry into China, and official certificates on their marital status.
(2) Examination
The marriage registration authority verifies and examines the applicant's application for marriage registration and finds out whether the application meets the conditions for marriage. Where there is uncertainty, the applicant will be questioned by the marriage registration authority, and will be asked to provide appropriate supporting documents if necessary.
(C) Registration and License
The marriage registry will give marriage registration to couples who meet the conditions and then issue marriage licenses; for those who have been divorced, the marriage registry will cancel their divorce licenses; and, if necessary, the marriage registry will issue a "Notice of Notification of Not Being Able to Apply for a Marriage Registration," which explains the reasons for not being able to register.
What formalities and documents are required for divorce
The process of divorce registration is as follows:
(a) Application
The husband and wife who are seeking a divorce, and need to be divorced, sign a divorce agreement according to the requirements of the two parties, and together with the relevant marriage registry, to apply, and according to the regulations Provide the following documents and certificates:
1. Marriage certificates of both men and women;
2. Identity documents required for the registration of divorce, such as one's ID card, hukou book, laissez-passer, passport, or other valid international travel documents;
3. Application for Registration of Divorce filled out on the spot.
(2) Acceptance
The marriage registrar conducts the initial examination of the above materials submitted by the parties in accordance with the relevant regulations. After the initial examination of the divorce application is correct, issued the "divorce registration application acceptance receipt". Do not meet the conditions of the application for divorce registration, the marriage registration authority is not accepted, the parties may request the issuance of a "notification of non-acceptance of the application for divorce registration".
(C) the cooling-off period
From the date of receipt of the application by the Marriage Registry and issued to the party concerned "acceptance of the receipt of the application for registration of divorce" within 30 days, any party who is not willing to divorce, may bring their own valid identity documents, "acceptance of the application for registration of divorce receipt" (loss of receipt can be written to explain the situation), to the acceptance of the application for registration of divorce to withdraw the application for registration of divorce before the divorce registry. Withdraw the previous application for divorce registration to the divorce registration authority accepting the application for divorce registration, and fill in the application form for withdrawal of divorce registration according to the regulations. After the marriage registration authority has verified that the information is correct, it will issue a confirmation slip on the withdrawal of the application for divorce registration. Within thirty days after the expiration of the cooling-off period for divorce, if both parties do not *** apply for the issuance of a divorce license at the marriage registration office, the application for registration of divorce shall be deemed to have been withdrawn.
(4) Review
Within thirty days from the expiration of the cooling-off period for divorce, (if the last day of the expiration of the period is a holiday, then the first day after the end of the holiday shall be taken as the date of the expiration of the period), the two parties shall hold the documents and materials stipulated under the relevant items of the "Norms for the Work of Marriage Registration", such as recent bareheaded photographs of the two parties, the agreement on divorce, the marriage certificate, the ID card, passport or passports, etc.*** together to the marriage registration authority to apply for the issuance of a divorce certificate. (E) Registration and issuance of divorce certificate
