Medical risk is divided into four categories

There are five categories of medical risks, as follows:

1, risks due to patients' physical and psychological factors;

2, risks due to the special characteristics of emergency patients;

3, risks due to medical behavior;

4, risks due to the lack of working conditions and systems;

5, risks due to social factors.

The statute of limitations for damages in medical disputes is generally three years, for the following reasons:

1. According to the provisions of the Chinese People's *** and National Code, the period of limitation for petitioning the people's court for the protection of civil rights is three years. If the law provides otherwise, it shall be in accordance with its provisions. The period of limitation is calculated from the date when the right holder knows or should know that the right has been harmed as well as the date of the obligor;

2. The first condition for the victim to seek judicial remedies through litigation is to comply with the provisions of the law on the statute of limitations. The statute of limitations is directly related to the victim's rights and interests can be safeguarded, whether the aggressor will bear the corresponding legal responsibility. Therefore, not overly burdensome at the same time to fully guarantee the victims through the litigation process to the people's court to protect their legitimate civil rights and interests of the effective period of time is of great significance.

Legal basis: the Chinese people's *** and national code article 1218

Patients in the diagnosis and treatment of damage, medical institutions or their medical personnel are at fault, by the medical institutions bear the responsibility for compensation.

Article 1219

Medical personnel shall explain the patient's condition and medical treatment measures to the patient in the course of medical treatment activities. Where it is necessary to carry out surgery, special examination or special treatment, the medical personnel shall promptly explain to the patient the medical risks and alternative medical programs, and obtain his/her explicit consent; where it is not possible or desirable to explain this to the patient, he/she shall explain it to the patient's next of kin, and obtain his/her explicit consent.

Medical personnel did not fulfill the obligations of the preceding paragraph, causing damage to the patient, the medical institution shall bear the liability.
