Private education belongs to public welfare undertakings, and private schools and public schools have the same legal status. Article 4 The municipal, county and district education administrative departments shall be in charge of the work of private education within their respective administrative areas, and shall be responsible for the overall planning, comprehensive coordination and macro management of private education.
The administrative department of human resources and social security of the city and its flag, county and district shall, in accordance with the provisions of these regulations, be responsible for the work of private education within its scope of duties.
Other relevant departments shall, within the scope of their respective duties, assist in the work of private education. Article 5 Private schools shall abide by national laws and regulations, run schools according to law, be honest and trustworthy, and compete fairly.
Private schools should consciously safeguard the legitimate rights and interests of faculty and students, strengthen the safety management of private schools, and ensure the safety of teachers and students. Chapter II Establishment of Private Schools Article 6 The municipal, county and district people's governments shall guide the organizers of private schools to focus on preschool education, vocational education, adult education and senior secondary education. Article 7 The establishment of a private school shall conform to the relevant provisions of the state and the autonomous region, and meet the following conditions:
(a) the unit or organization has legal personality, and the individual citizen has political rights and full capacity for civil conduct;
(2) Having a clear educational purpose, training objectives, teaching syllabus, specialty setting and curriculum plan;
(3) Having an organizational structure, articles of association and relevant management systems;
(4) Having qualified full-time principals or administrators, qualified teachers and necessary management personnel;
(five) there are teaching places, facilities and equipment that meet the prescribed standards;
(six) qualified school funds and stable sources of funds;
(seven) the admission of students should meet the requirements of accommodation, medical care and hygiene. Article 8 The establishment of private schools includes preparatory establishment and formal establishment. Private schools do not have the qualification for enrollment during the preparation and establishment. Article 9 The establishment of private schools below the secondary level shall be examined and approved in accordance with the following provisions:
(a) the establishment of senior middle schools, complete middle schools and secondary vocational private schools that implement high school education shall be examined and approved by the education administrative department of the Municipal People's Government; Private schools that hold intermediate vocational qualification training and vocational skills training shall be examined and approved by the administrative department of human resources and social security of the Municipal People's Government.
(2) The establishment of private schools that implement preschool education, compulsory education and other cultural education shall be examined and approved by the education administrative department of the county or district people's government and reported to the education administrative department of the Municipal People's government for the record; Private schools that hold primary vocational qualification training and vocational skills training shall be examined and approved by the administrative departments of human resources and social security of the county, county and district people's governments.
The administrative department of human resources and social security shall, after examining and approving private schools, send a copy to the administrative department of education at the same level for the record within three months. Article 10 The examination and approval authority shall issue a school-running license to the approved private schools and make an announcement.
Private schools shall go through the registration formalities with the registration authority in accordance with the provisions of relevant laws and regulations, and the registration authority shall complete the registration within five working days with the application for registration, school license, identity certificate of the proposed legal representative and the articles of association of the private school submitted by the private school. Eleventh national examination institutions such as self-study examination, vocational qualification examination and technical grade examination shall not hold or approve the holding of private schools related to their examination business.
Private schools undertaking vocational qualification and technical grade examinations shall not hold teaching activities related to their examiner's business.
The examination and approval authority shall not directly or indirectly organize private schools related to its business. Article 12 The name of a private school shall comply with the provisions of relevant laws and regulations, and be compatible with the approval level, education category, school-running level and school-running scope of the private school.
Implementing academic education in private schools called schools;
(two) the implementation of non academic education is called a school or training center, and the words "cram school, junior college, further training" should be added before the school;
(3) Private schools that carry out vocational qualification training and vocational skills training are called vocational training schools, vocational technical schools or training centers;
(4) Private schools that implement preschool education are called kindergartens. Chapter III Teaching and Management of Private Schools Article 13 Private schools shall establish and improve internal decision-making bodies and supervision and management systems. Private schools should set up a board of directors, a council or other forms of decision-making bodies.
