Article 2 Units and individuals engaged in the safety supervision and management of agricultural machinery, driving (operating) agricultural machinery and related to the safety of agricultural machinery operations within the administrative area of ??this city shall abide by these regulations.
Agricultural machinery as mentioned in these Regulations refers to machinery and equipment used in agricultural production and preliminary processing of products and other related agricultural activities. Article 3 Municipal, county (city) and district agricultural and rural departments are responsible for the safety supervision and management of agricultural machinery in their respective administrative areas, and are responsible for the registration, safety inspection and technical inspection, scrap recycling of agricultural machinery and the examination of drivers (operators) of agricultural machinery in accordance with the law. Relevant departments such as public security, transportation, and emergency management should do a good job in the safety supervision and management of agricultural machinery in accordance with their respective responsibilities. Article 4 The municipal, county (city) and district people's governments shall strengthen their leadership over agricultural machinery safety supervision and management, incorporate agricultural machinery safety supervision and management into safety production planning, and implement the agricultural machinery safety production responsibility system.
The town people's government (subdistrict office) should strengthen the safety supervision and management of agricultural machinery, clarify the units and personnel responsible for the safety supervision and management of agricultural machinery, and do a good job in the safety supervision and management of agricultural machinery in accordance with the prescribed responsibilities.
Village (resident) committees should assist in the supervision, management, publicity and education of agricultural machinery safety. Article 5 Municipal, county (city) and district people's governments shall incorporate agricultural machinery safety supervision and management into the government's safety production target assessment, increase financial investment, and integrate agricultural machinery safety supervision and management such as publicity and education, hidden danger management, inspection and accident handling, etc. The funds required for the work are included in the financial budget to improve the level of agricultural machinery safety supervision and management. Article 6 The agricultural and rural departments and the traffic management departments of the public security organs shall establish an exchange system for safety management information on tractors and other agricultural machinery as well as a connection mechanism for case handling.
The agricultural and rural departments shall regularly provide information and data on tractor registration, safety technical inspection, and tractor driving (operation) license issuance to the traffic management department of the public security organ at the same level. If the traffic management department of the public security organ imposes a penalty of temporarily detaining or revoking the driving (operating) license of a tractor driver (operator), it shall notify the agricultural and rural departments at the same level. If the driving (operating) license is revoked, the driving (operating) license shall also be sent to the agricultural and rural department at the same level. Article 7 Municipal, county (city) and district people's governments shall include insurance related to agricultural machinery such as tractors, combine harvesters, and grain dryers into the scope of agricultural policy insurance.
Encourage and support agricultural machinery owners or drivers (operators) to voluntarily establish agricultural machinery safety mutual aid organizations in accordance with the law, improve the rescue mechanism, and reduce business risks. Chapter 2 License Management Article 8 Before being put into use, agricultural machinery such as combine harvesters and tractors must be registered with the agricultural and rural department at the owner’s residence and can only be used after applying for a license. If you need to temporarily use or newly purchased agricultural machinery that has not yet been registered and needs to be driven on the road, you should obtain a temporary license plate.
If the application materials are complete and meet the regulations, the agricultural and rural departments shall complete the registration review within two working days from the date of accepting the application. Those who meet the prescribed conditions shall be issued corresponding registration certificates, license plates and driving licenses. If the application materials are incomplete or do not comply with the legal form, the applicant shall be informed of all the content that needs to be supplemented and corrected at once. Those who do not meet the prescribed conditions shall be notified in writing of the reasons for rejection. Article 9 Agricultural machinery that is required to be registered by the state and the province must be registered with the agricultural and rural department of the owner’s residence within thirty days from the date of purchase.
When handling the registration of agricultural machinery, the identity certificate of the owner, the origin certificate of the agricultural machinery, and the factory qualification certificate or import certificate of the complete agricultural machinery must be submitted.
Article 10 Tractor and combine harvester drivers (operators) shall receive professional technical training from qualified agricultural machinery driving (operation) training institutions, pass the examination of the agricultural and rural departments, and obtain a driving (operation) license before they can drive. (operate) corresponding agricultural machinery.
Users (operators) of motorized plant protection machinery, motorized threshers, feed grinders, rice transplanters, mowers, mini-tillers, grain dryers and other agricultural machinery that endanger personal and property safety should accept Agricultural machinery producers and sellers must receive professional technical training before they can operate the corresponding agricultural machinery. Article 11 The agricultural and rural departments shall conduct regular safety technical inspections on licensed agricultural machinery in accordance with the law. If it has not been inspected or failed to pass the inspection, it should be suspended from use. It can only be used after passing the inspection or maintenance.
The agricultural and rural departments shall conduct regular inspections of agricultural machinery driving (operation) licenses in accordance with the law. Chapter 3 Safety Regulations Article 12 Agricultural machinery license plates shall be hung in accordance with regulations, shall be kept clear and complete, and shall not be blocked or defaced. Tractors and their trailers traveling on the road should be equipped with reflective signs or sign lights, and an enlarged trademark should be sprayed on the body or the rear of the carriage.
