Regulations on the administration of farmers' markets in downtown Nanchang

Article 2 These Regulations shall apply to the planning, construction, business norms, supervision and management of farmers' markets in the central urban areas of this Municipality and the central urban areas of counties.

the central city as mentioned in these regulations refers to the centralized bearing area of the city's leading functions, and its specific scope is delineated by the municipal and county people's governments. Article 3 The term "farmer's market" as mentioned in these Regulations refers to a place with fixed places and facilities, which focuses on spot retail trading of edible agricultural products and is centralized and publicly traded.

the farmers' market promoters mentioned in these regulations refer to enterprises or other organizations that have established farmers' markets or obtained the management rights of farmers' markets according to law, provided fixed business places (including stalls, shops, business rooms, etc.), corresponding facilities and services, and are responsible for daily management.

the floor operators mentioned in these regulations refer to natural persons, legal persons or other organizations that independently conduct spot operations in farmers' markets. Article 4 The farmer's market shall be managed in a territorial way, following the principles of unified planning, rational layout, standardized management, market operation and government support, and embodying the functions of people's livelihood, public welfare, sociality and convenience.

the business activities of the farmers' market should follow the principles of voluntariness, fairness, honesty and credit, law-abiding operation and civilized operation. Article 5 The people's governments of cities and counties (districts) shall strengthen the organization and leadership over the planning, construction, renovation and upgrading of farmers' markets, establish and improve the coordination mechanism for the management of farmers' markets composed of departments of commerce and market supervision and management, and coordinate and solve major problems in the construction and management of farmers' markets.

the people's governments of cities and counties (districts) shall incorporate the funds for the management of farmers' markets into the fiscal budget at the corresponding level, and formulate and implement policies and measures to support farmers' markets. Sixth city and county (District) people's government departments in charge of commerce is responsible for the organization and coordination of the management of farmers' markets, farmers' market planning, acceptance, upgrading and other responsibilities.

the market supervision and management department of the people's government of the city or county (district) is responsible for supervising and managing the operation order and food safety of the farmers' market, and accepting complaints and reports from consumers.

other relevant departments of the municipal and county (district) people's governments shall, in accordance with their respective responsibilities, do a good job in the supervision and management of farmers' markets. Article 7 The neighborhood offices and township (town) people's governments where farmers' markets are located shall be responsible for urging farmers' market promoters within their respective jurisdictions to implement their management responsibilities and assist relevant departments in the management of farmers' markets. Eighth city and county (District) people's government and its relevant departments, the news media should strengthen the publicity and education of food safety, environmental sanitation, epidemic prevention and control in farmers' markets, and guide the public to form healthy and civilized consumption habits. Article 9 The people's governments of cities and counties (districts) shall encourage and support the farmers' market promoters and on-site operators to establish or join trade organizations independently according to law.

trade organizations in farmers' markets should play a self-discipline role and promote the standardized and orderly development of the industry. Chapter II Planning and Construction Article 1 The competent department of commerce of the Municipal People's Government shall, jointly with the competent department of natural resources, organize the preparation of special plans for the construction of farmers' markets, which shall be promulgated and implemented after being approved by the Municipal People's Government.

the preparation of special plans for the construction of farmers' markets should be based on and in line with the overall planning and detailed planning of land and space, follow the principles of reasonable total amount, environmental protection and convenience for the masses, invite experts to demonstrate and solicit opinions from the public.

the approved special plan for the construction of farmers' markets shall not be modified without authorization. If it is really necessary to modify it, it shall be handled in accordance with the original preparation and approval procedures. Eleventh city and county (District) people's government in the implementation of the construction of new urban areas and the transformation of old urban areas, farmers' markets should be planned and constructed as public service facilities. Article 12 The competent commerce department of the Municipal People's Government shall, jointly with relevant departments, formulate norms for the construction and acceptance of farmers' markets, which shall be promulgated and implemented after being approved by the Municipal People's Government.

the construction specifications and acceptance specifications should include the independent setting of food business areas, live poultry business areas, aquatic products business areas and cooked food business areas, the division of functional areas such as self-produced and self-sold booths, parking lots, unloading areas and public toilets, and the provision of facilities and equipment such as fire fighting, detection, disinfection, power supply, ventilation, drainage, sewage treatment and waste treatment. Thirteenth city and county (District) people's government to organize land supply, should give priority to the protection of single construction or construction of farmers' markets, and shall not arbitrarily change the land use of farmers' markets. Fourteenth new construction, renovation and expansion of farmers' markets shall conform to the special planning and construction norms of farmers' markets. The farmer's market shall not be put into use if it is not completed and accepted in accordance with the acceptance criteria or fails to pass the acceptance.

motor vehicle and non-motor vehicle parking lots in farmers' markets, as well as basic supporting facilities such as environmental sanitation, rain and sewage diversion and drainage, and fire fighting, should be planned, constructed, accepted and delivered synchronously with the main project of farmers' markets.

if the farmer's market established before the implementation of these regulations does not conform to the construction norms, it shall be transformed according to the construction norms. Farmers' markets that meet the construction specifications after transformation shall be subsidized by the people's governments of cities and counties (districts).
