Article 21 of the people's government at or above the county level or the competent departments of environmental protection enterprises and institutions, should be organized at least once a year plan training, through a variety of forms, so that the relevant personnel to understand the content of the environmental emergency response plan, familiar with the emergency duties, emergency procedures and post emergency response plan.
Article 22 of the people's governments at or above the county level, the competent departments of environmental protection shall establish and improve the environmental emergency response plan exercise system, at least once a year to organize emergency drills. Enterprises and institutions should regularly conduct emergency drills, and actively cooperate with and participate in the relevant departments to carry out emergency drills.
After the end of the environmental emergency plan exercise, the relevant people's government environmental protection departments and enterprises should be the environmental emergency plan to assess the results of the exercise, write an assessment report on the exercise, analyze the problems, the environmental emergency plan to put forward modifications.
Article 23 of the people's governments at or above the county level, the competent departments of environmental protection or business institutions, in accordance with relevant laws and regulations and the provisions of this approach, according to the actual needs and changes in circumstances, based on the relevant guidelines for the preparation of the plan or the preparation of the revised framework guidelines for the revision of the environmental emergency response plan.
The environmental emergency plan is revised at least once every three years; one of the following circumstances, enterprises and institutions should be revised in a timely manner:
(a) the unit's production process and technology changes;
(b) the relevant units and personnel changes or emergency organization and command system or responsibility adjustments;
(c) the surrounding environment or environmental sensitive points change;
(c) the surrounding environment or environmental sensitive points change;
(d) the environmental emergency plan should be revised in accordance with the relevant laws and regulations and the provisions of this method. (C) changes in the surrounding environment or environmentally sensitive points;
(D) environmental emergency plan based on changes in laws, regulations, rules, etc.;
(E) environmental protection authorities or business units that should be revised in due course of other circumstances.
The environmental protection department or business unit, should be revised in the environmental emergency response plan within 30 days after the revision of the newly revised plan to the original plan filing management department for the record; plan filing department can be revised according to the specific circumstances of the revised plan required to revise the plan of the environmental protection department or business unit to assess the revised plan.
Chapter VI Legal Liability
Article 24 should be prepared or revised environmental emergency response plan of the environmental protection department does not prepare an environmental emergency response plan, do not revise the environmental emergency response plan in a timely manner, or do not according to the provisions of the plan for the record, by the competent department of environmental protection of the people's government shall order corrections.
Article 25 should be prepared or revised environmental emergency response plan of enterprises and institutions do not prepare environmental emergency response plan, do not revise the emergency response plan in a timely manner, or not in accordance with the provisions of the emergency response plan assessment and filing, by the people's governments at or above the county level of the competent department of environmental protection ordered to make corrections within a certain period of time; failure to make corrections after the due date, in accordance with the relevant laws and regulations shall be punished.
Article 26 of the environmental protection department or business institutions do not prepare environmental emergency response plan or do not implement the environmental emergency response plan, resulting in environmental emergencies or the expansion of the harm, according to the relevant provisions of the state responsible for the competent personnel and other directly responsible personnel to be given sanctions; constitutes a crime, be held criminally responsible.
Chapter VII Supplementary Provisions
Article 27 of the Measures in the meaning of the following terms:
Environmental emergencies, refers to accidents or unforeseen events and other factors, resulting in environmental contamination or damage, public life, health and property is jeopardized or threatened by the emergency.
Environmental emergency response plan, refers to the possible occurrence of environmental emergencies, in order to ensure rapid, orderly and efficient emergency response to reduce casualties and economic losses and pre-established plans or programs.
Environmental risk is the degree of danger to the environment (or health) from an environmental emergency.
Hazardous source, is the source or state that may lead to injury or disease, property damage, environmental damage, or a combination of these conditions.
Environmentally sensitive site, refer to the definition of "environmentally sensitive area" in the "Environmental Impact Assessment Classification and Management List of Construction Projects".
Emergency exercise means a practical activity to simulate emergency response in order to test the effectiveness of the emergency plan, emergency preparedness, adaptability of the emergency response capability and the synergy of emergency personnel.
Article 28 of these measures by the Ministry of Environmental Protection is responsible for interpretation.
Provinces, autonomous regions and municipalities directly under the Central People's Government, the competent departments of environmental protection can be based on these measures, combined with the actual development of implementation details of the region.
Article 29 These measures shall come into force on the date of publication.
