Regulations on Radiation Protection of Radioisotopes and Radiation Devices

Chapter I General Provisions Article 1 These Regulations are formulated for the purpose of strengthening the supervision and management of radiation protection of radioisotopes and radiation devices, safeguarding the health and safety of persons engaged in radiological work and of the public, protecting the environment, and promoting the application and development of radioisotopes and radiation technology. Article 2 These Regulations shall apply to units and individuals engaged in the production, use and sale of radioisotopes and radiation devices within the territory of the People's Republic of China. Article 3 The departments of health, environmental protection and public security under the State Council shall, in accordance with their respective functions and the relevant provisions of these Regulations, supervise and manage the radiation protection in the production, use and sale of radioisotopes and radiation devices (referred to as radiation work). Article 4 Any unit or individual shall have the right to report and accuse any violation of these Regulations. Chapter II Permit Registration Article 5 of the State radiation work on the implementation of the permit registration system, the permit registration certificate by the health and public security departments. Article VI of the new construction, alteration, expansion of radiation workplace radiation protection facilities, must be designed and approved at the same time with the main project, construction, acceptance and put into operation at the same time, the design of radiation protection facilities, must be located in the provinces, autonomous regions and municipalities directly under the Central Government's health administrative departments in conjunction with the public security department to review and agree. Completion of the health, public security, environmental protection and other relevant departments must be accepted by the acceptance of consent to obtain a license registration certificate before being activated.

Projects involving radioactive wastewater, waste gas, solid waste management, must apply for review at the same time, submit the environmental impact assessment documents approved by the environmental protection department, after completion must be accepted by the health, public security, environmental protection and other departments to agree. Article 7 Before any unit engages in the production, use or sale of radiation devices, it must apply for permission from the health administrative department of the province, autonomous region or municipality directly under the central government; before engaging in the production, use or sale of radioisotopes and radiation devices containing radioactive sources, it must apply for permission from the health administrative department of the province, autonomous region or municipality directly under the central government and register with the public security department at the same level. Involving radioactive wastewater, waste gas, solid waste discharge, must also be submitted to the provinces, autonomous regions and municipalities directly under the Central Environmental Protection Department of the environmental impact report form (book), approved before applying for permission to register, licensed registration certificate before engaging in the scope of permission to register the radiation work. Article 8 Where the application for licensing, registration of radiation work units must have the following basic conditions:

(1) with the radiation work carried out by the appropriate premises, facilities and equipment, and provide the appropriate information;

(2) engaged in the radiation work of the personnel must have the appropriate professional and protective knowledge and health conditions, and to provide the appropriate supporting materials;

(C) full-time or part-time radiation protection management organization or personnel and the necessary protection of the mouth and monitoring instruments, and submit a list of personnel and equipment list;

(D) submit strict documents related to the management of safety and protection rules and regulations. Article IX radiation work permit registration card every one to two years for verification, verification by the original approval department to record on the permit registration card.

Radiation work units need to change the content of the license registration, you need to hold the license registration documents to the original approval department for change procedures. Termination of radiation work must be canceled to the original approval department for license registration procedures. Chapter III Radiological Protection Management Article 10 of the higher administrative units engaged in radiological work, is responsible for the management of the system's radiological protection work, and should be regularly on the system to implement the national radiation protection regulations and standards for inspection.

The person in charge of a unit engaged in radiological work shall take effective measures to bring the radiological protection work of the unit into conformity with the relevant state regulations and standards. Article XI radioisotope production, use, storage sites and the production and use of radiation devices must be set up protection facilities. Its population must be set at the radioactive sign and the necessary protection of safety interlocks, lone police device or work signal.

Outdoor, field radiological work, must be set out to protect the safety of the area, and set up a danger sign, if necessary, set up special guards.

Radioisotope tests in surface water and groundwater must be approved in advance by the provincial environmental protection and health administrative departments. Article 12 Radioisotopes shall not be placed together with flammable, explosive and corrosive substances, and their storage places shall take effective safety measures against fire, theft and leakage, and designate a person in charge of storage. When storing, receiving, using or returning radioisotopes, they must be registered and inspected so as to make the accounts match. Article 13 The units or individuals engaged in ordering, selling, transferring, allocating and borrowing of radioisotopes must be licensed and limited to the scope of the license registration to engage in the above activities, and to the health and public security departments at the same level for the record. It is strictly prohibited to engage in the above activities without a license or outside the scope of license registration. Article XIV of the import of radioisotopes equipped with instruments or individuals, must be registered with the local health, public security, environmental protection departments for the record; imports of minerals containing more than the level of radioactivity exemption, finished products, consumer goods, units or individuals, should be to the port of entry where the provincial health administrative department to apply for radiation monitoring and inspection.

Where engaged in processing work containing radioactive units and individuals, involving radioactivity for water, waste gas, solid waste discharge, must be submitted in advance to the province, autonomous region, municipality directly under the Central Government's environmental protection department of the environmental impact report form (book), after approval, to the county above the health administrative department to apply for a license, and to the public security department for registration.
