Conditions for Establishing a Medical Institution
Based on the provisions of the "Regulations on the Administration of Medical Institutions," there are six conditions for applying for registration of a medical institution to practice medicine and obtaining a "license to practice in a medical institution:"
(1) an approval letter for the establishment of a medical institution;
(2) conformity with the basic standards of a medical institution;
(3) having a suitable name , organization and premises;
(4) has funds, facilities, equipment and professional health technicians appropriate to the business it carries out;
(5) has appropriate rules and regulations;
(6) is able to independently assume civil liability.
According to the "physicians, Chinese medicine practitioners, individual practice of the Interim Management Measures," the individual practice of physicians, Chinese medicine practitioners by the county (urban) health administrative department issued licenses to practice, supervision and management, and collect management fees. (11) Experience table of the medical staff of the medical institution;
(12) Catalog of commonly used medicines in the medical institution;
(13) Catalog of commonly used medical devices in the medical institution;
(14) Rules and regulations of medical institutions (available in book form).
Legal Basis: Article 39 of the Law of the People's Republic of China on Practicing Physicians stipulates: "If a medical institution is opened to practice medicine without approval or if a non-physician is practicing medicine, the health administrative department of the people's government at or above the county level shall prohibit the practice of medicine, confiscate the proceeds of the offense and its medicines and devices, and impose a fine of 100,000 yuan and impose a fine of less than 100,000 yuan."
