Regulations of Hubei Province on Comprehensive Utilization of Resources

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the relevant provisions of national laws and regulations and in light of the actual situation of this province in order to rationally utilize resources, improve the efficiency of resource utilization, protect the ecological environment and promote the sustainable development of economy and society. Article 2 The term "comprehensive utilization of resources" as mentioned in these Regulations refers to the comprehensive development and rational utilization of primary minerals and associated minerals in the process of mining mineral resources; Recovery and rational utilization of waste residue, waste water (liquid), waste gas, waste heat and residual pressure generated in the production process; Recover and recycle all kinds of waste materials produced in the process of social production and consumption.

The term "products for comprehensive utilization of resources" as mentioned in these Regulations refers to the products listed in the national catalogue of products for comprehensive utilization of resources. Article 3 The Economic and Trade Commission of the people's government at or above the county level is the administrative department in charge of comprehensive utilization of resources of the people's government at the same level, and is responsible for the supervision and management of comprehensive utilization of resources within its jurisdiction.

The relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, assist the administrative departments in charge of comprehensive utilization of resources to do a good job in the management of comprehensive utilization of resources. Article 4 People's governments at all levels implement economic policies that encourage comprehensive utilization of resources. Give preferential treatment and support to construction projects and products for comprehensive utilization of resources in terms of investment, credit, taxes and fees; Units and individuals that have made remarkable achievements in the comprehensive utilization of resources shall be commended and rewarded. Chapter II Supervision and Administration Article 5 The people's governments at or above the county level shall formulate medium-and long-term plans and annual plans for comprehensive utilization of resources, which shall be incorporated into the plans for national economic and social development. Article 6 People's governments at all levels shall strengthen the scientific and technological research and development of comprehensive utilization of resources, and major scientific and technological research and development projects of comprehensive utilization of resources shall be included in the scientific and technological research plan, and the required funds shall be included in the annual special plan for scientific and technological expenses of financial expenditure. Measures for the declaration and determination of projects and products for comprehensive utilization of resources shall be formulated by the provincial administrative department for comprehensive utilization of resources in conjunction with the provincial finance and taxation departments. Chapter III Development and Utilization Article 11 In the exploration and exploitation of mineral resources, the original ore and associated ore with development and utilization value must be planned in a unified way and comprehensively explored, evaluated, exploited and utilized. Effective protective measures should be taken for those that cannot be used temporarily. Article 12 An enterprise shall comprehensively utilize the wastes generated in the production process, give priority to the comprehensive utilization of waste residue, waste water (liquid), waste gas, waste heat, residual pressure and leftover materials, and establish and improve comprehensive utilization facilities. Article 13 If an enterprise cannot comprehensively utilize the wastes generated in the production process, it shall support other units to utilize them, and give freight subsidies to the units that utilize the wastes.

The waste discharge unit provides the treated waste to the waste utilization unit, and the waste discharge unit can charge a certain treatment fee to the waste utilization unit.
