The so-called human clinical trials, is in the field of biology, medicine, natural people as test subjects, in order to verify the safety and effectiveness of new drugs, new medical equipment, new treatments, experimental research behavior. In order to treat diseases and other personal purposes or to promote the development of medicine and other public welfare purposes, subjects risk their own health or even life to participate in the test, is a manifestation of the exercise of their bodily autonomy, the law should be respected. However, in view of the specialization and complexity of biological or medical knowledge, subjects may have little knowledge of the risks they face, so the relevant international conventions, ethical norms or legal norms emphasize the primacy of the protection of the rights and interests of subjects. For example, Article 6 of the Declaration of Helsinki stipulates: "In medical experiments involving human beings, the health of the individual subject shall take precedence over all other interests." The UNESCO Universal Declaration on Bioethics and Human Rights also clearly states that "the rights, safety and health of the subjects are the most important considerations in experimentation and should prevail over all other scientific and social interests."
