Article 4 of the special operators shall meet the following conditions:

Chapter III assessment and certification

Article XVI in line with the provisions of Article IV of these regulations and passed the examination of special operators, shall apply for special operations license to their domicile or practice where the examination and licensing authorities, and submit a copy of identity card, a copy of academic certificate, medical examination certificate, test certificate and other materials.

Chapter IV review
Article 21 of the special operations license review every three years.

Article 25 of the special operators have one of the following circumstances, the review or extension of the review will not be passed:
(a) health checkup failed;
(b) violation of the operation of the serious consequences or more than 2 violations and confirmed by the verification;
(c) there is a violation of work safety, and given administrative punishment;
(c) the administrative penalty;
(d) the special operation license shall be re-issued by the examination and issuance of the authority. p>

(5) failing to participate in the safety training in accordance with the regulations, or failing to pass the examination;
(6) having the circumstances stipulated in Article 30 and Article 31 of the present provisions.
Article 26 of the special operations license review or extension of the review in line with the provisions of Article 25 (b), (c), (d), (e) circumstances, in accordance with the provisions of the re-security training and examination, and then for review or extension of the review procedures.

Chapter V Supervision and Administration
Article 28 of the assessment and licensing authorities or their entrusted units and their staff should be loyal to their duties, adhere to the principle of integrity and self-discipline, in accordance with the provisions of laws, rules and regulations of the assessment of special operators, licensing, review work, and accept the supervision of the community.
Article 29 of the assessment and licensing authorities shall strengthen the supervision and inspection of special operators, found to have the circumstances provided for in Article 30 of these provisions, the timely revocation of the special operations license; should be given administrative penalties in accordance with the law of production safety violations, in accordance with the relevant provisions of the law on the production and management units and their special operators to implement administrative penalties.
The examination and licensing authority shall establish a special operator management information system to facilitate the employer and the public inquiry; for the cancellation of special operations license for special operators, should be promptly announced to the community.
Article 30 of the following circumstances, the examination and licensing authority shall revoke the special operations license:
(a) more than the validity of the special operations license has not been extended for review;
(b) the physical condition of the special operators have been unsuitable to continue to engage in special operations;
(c) the occurrence of accidents in production safety is responsible for;
(D) special operations license record false information;
(E) deception, bribery and other improper means to obtain a special operations license.
Special operators in violation of the preceding paragraph (d), (e) of the provisions of the three years shall not re-apply for a special operations license.
Article 31 of the following circumstances, the assessment of the licensing authority shall cancel the special operations license:
(a) the death of special operators;
(b) the special operators to apply for cancellation;
(c) the special operations license has been revoked according to law.

Article 34 of the training institutions shall, in accordance with the relevant provisions of the organization and implementation of special operators of safety training, shall not lend to any institution or individual, leasing safety training qualification certificate.
Article 35 of the production and management units shall strengthen the management of special operators, establish and improve the training of special operators, review files, and do a good job in the declaration, training, assessment, review of the organization and daily inspection.
Article 36 of the special operators in the labor contract expires after the change of work unit, the original work unit shall not be any reason to withhold its special operations license.
Trans-provincial, autonomous regions and municipalities directly under the Central Government to work in the special operators shall accept the practice of local assessment of the supervision and management of the licensing authority.
Article 37 of the production and management units shall not print, forge, sell special operation license, or the use of illegal printing, forgery, sell the special operation license.
Special operators shall not forge, alter, loan, transfer, fraudulent use of special operations license or use a forged special operations license.
Chapter VI penalties
Article 38 of the assessment and licensing authorities or their entrusted units and their staff in the special operators assessment, licensing and review work, abuse of power, dereliction of duty, favoritism and malpractice, administrative sanctions shall be given according to law; constitutes a crime, shall be investigated for criminal responsibility.
Article 39 of the production and management units did not establish and improve the special operators file, give a warning, and impose a fine of 10,000 yuan.
Article 40 of the production and management units to use special operations without special operating permits for special operators on duty, shall order rectification; overdue rectification, shall order the suspension of rectification, and may also impose a fine of 20,000 yuan.
