Regulations of Chengdu Municipality on the Administration of Municipal Engineering Facilities (revised in 2020)

Chapter I General Provisions Article 1 In order to strengthen the management of municipal engineering facilities, ensure the intact and safe operation of facilities, improve the quality of cities and promote the construction of beautiful and livable parks, these Regulations are formulated in accordance with the provisions of relevant laws and regulations and in light of the actual situation in Chengdu. Article 2 These Regulations shall apply to the planning, construction, maintenance, repair, use and management of municipal engineering facilities within the administrative area of this Municipality.

Urban water supply, gas, electricity, communications, radio and television, road traffic safety, fire protection, civil air defense, landscaping, rail transit and other public facilities management, in accordance with the provisions of relevant laws and regulations. Article 3 The municipal engineering facilities mentioned in these Regulations include:

(1) Urban roads: motor vehicles, non-motor vehicles, sidewalks and their ancillary facilities;

(2) Urban bridges and culverts: bridges (including overpasses, river-crossing bridges, viaducts and footbridges), culverts and their ancillary facilities;

(3) Urban common ditches: underground structures used to accommodate more than two kinds of urban engineering pipelines and their ancillary facilities;

(4) Urban underpass tunnels: municipal underpass tunnels (including sunken roads) for vehicles and pedestrians in urban roads and their ancillary facilities such as drainage, ventilation, fire protection, electricity, lighting, monitoring and special communication facilities;

(5) Urban drainage facilities: rainwater pipes, sewage pipes, reclaimed water pipes, drainage pumping stations, water purification plants and their manhole covers, water filters and other ancillary facilities;

(6) Urban flood control facilities: rivers, dikes, dams, flood control passages and their ancillary facilities;

(7) Urban road lighting facilities: auxiliary facilities such as lampposts, lamps, special transformers, distribution boxes and working wells of urban roads and bridges and culverts. Article 4 Municipal engineering facilities shall follow the principles of unified planning, supporting construction, overall management and graded maintenance. Fifth municipal administrative departments and water departments are the competent departments of municipal engineering facilities in this Municipality (hereinafter referred to as the competent departments of municipal engineering facilities). City management department is responsible for the city's urban roads, bridges and culverts, common ditch, road lighting facilities management; The municipal water department is responsible for the management of urban drainage, flood control facilities and underground tunnels.

The competent department determined by the district (city) county people's government is responsible for the management of municipal engineering facilities within its jurisdiction.

Municipal engineering facilities management and maintenance institutions are specifically responsible for the maintenance, repair and related management of municipal engineering facilities.

Other relevant departments of the municipal and district (city) county people's governments shall, in accordance with their respective responsibilities, do a good job in the planning, construction and management of municipal engineering facilities. Article 6 The municipal, district (city) and county people's governments shall incorporate the planning, construction and management of municipal engineering facilities into the national economic and social development planning and the land and space planning, and organize their implementation. Article 7 All units and individuals have the right to use municipal engineering facilities according to law and the obligation to protect municipal engineering facilities, and have the right to discourage and report acts that affect the normal use of municipal engineering facilities, such as theft, damage and embezzlement.

Any unit or individual who finds that the municipal engineering facilities are damaged or destroyed may report to the competent department of municipal engineering facilities. Eighth units and individuals that have made remarkable achievements in the management and maintenance of municipal engineering facilities shall be commended or rewarded by the municipal and district (city) county people's governments and the competent departments of municipal engineering facilities. Chapter II Planning and Construction Article 9 The municipal engineering facilities departments of cities, districts (cities) and counties shall, jointly with the planning and natural resources, housing and construction departments at the corresponding level, formulate special plans for municipal engineering facilities such as urban roads, bridges and culverts, common ditches, drainage, flood control and road lighting, and organize their implementation after approval by the people's government at the corresponding level.

The principle of scientific layout, rational function and intensive development should be followed in the preparation of special planning for municipal engineering facilities. Modifying the special planning of municipal engineering facilities shall be carried out in accordance with the original examination and approval procedures.

The special planning of urban water supply, gas, electricity, communications, radio and television, road traffic safety, fire protection, civil air defense, landscaping, rail transit and other public facilities should be linked with the special planning of municipal engineering facilities. Tenth new construction, renovation and expansion of urban roads, bridges, underpasses and other municipal engineering facilities, along the municipal pipelines, road lighting, signs, landscaping, traffic safety and other public facilities should be scientific and unified planning, synchronous design, synchronous construction, synchronous acceptance. In principle, street box pole facilities adopt multi-pole integration and multi-box integration, and similar pipelines are in the same ditch, well or corridor. Eleventh municipal engineering facilities design and construction, should strictly implement the relevant technical specifications. Twelfth before the transfer of water conservancy projects, the water department is responsible for the supervision and management of wading municipal engineering facilities. The competent department of housing and construction is responsible for the supervision and management of other municipal engineering facilities before the transfer.

Municipal engineering facilities that have not been accepted or are unqualified for acceptance shall not be handed over to management and maintenance institutions, and shall not be opened to the public or put into use. Thirteenth after the completion and acceptance of municipal engineering facilities, the construction unit shall, in accordance with the relevant provisions, handle the transfer procedures to the municipal engineering facilities management and maintenance institutions in a timely manner.

The specific measures for the completion and transfer of municipal engineering facilities shall be formulated separately by the Municipal People's Government.
