Article 2 (Reward Nature) China Quality Award is the highest government honor in the field of quality, awarded to organizations with leading quality, technological innovation, excellent brand and outstanding benefits, and individuals who have made outstanding contributions to promoting the quality development of People's Republic of China (PRC).
The organization mentioned in these Detailed Rules refers to the legal person organization registered in People's Republic of China (PRC) according to law, including all kinds of organizations engaged in production, service, research, design, education and medical treatment in the primary, secondary and tertiary industries; Individuals mentioned in these Rules refer to citizens of China.
Article 3 (Award Setting) The China Quality Award is held every two years, with China Quality Award and China Quality Award Nomination Award. No more than 10 organizations and individuals have won the China Quality Award, and no more than 90 organizations and individuals have been nominated for the China Quality Award.
Article 4 (Award Principle) The recommendation, evaluation and award of the China Quality Award shall follow the principles of openness, fairness and impartiality, and a scientific evaluation system shall be implemented. No fees shall be charged, and no organization or individual may illegally interfere.
Article 5 (Scope of Application) These Rules are applicable to the activities such as recommendation, evaluation and award of China Quality Award and nomination award of China Quality Award. Article 6 (Organization and Leading Body) The General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as AQSIQ) shall, together with relevant departments of the State Council, set up the China Quality Award Evaluation and Commendation Committee (hereinafter referred to as the Evaluation and Commendation Committee) to be responsible for the macro management and guidance of the China Quality Award.
Article 7 (Competent Department) The secretariat of the Evaluation and Commendation Committee is located in the General Administration of Quality Supervision, Inspection and Quarantine and is responsible for its daily work.
Article 8 (Responsibilities of Leading Bodies) The main responsibilities of the appraisal committee are:
(1) Hire relevant experts to form China Quality Award Selection Committee and China Quality Award Supervision Committee;
(two) to examine and approve the relevant evaluation rules and technical documents of China Quality Award;
(three) to consider the selection report of the selection committee and the supervision report of the supervision committee;
(four) to review and put forward the list of suggestions for winning the China Quality Award;
(five) to provide policy advice and suggestions for improving the quality award work in China;
(six) to study and solve other major problems in the evaluation of China Quality Award.
Article 9 (Composition of Leading Bodies) The Appraisal and Commendation Committee consists of 1 chairman, several vice-chairmen and 1 secretary-general. The chairman is the director-general of AQSIQ, the vice-chairman is the vice-ministerial leaders of relevant departments and academicians of China Academy of Engineering and China Academy of Sciences, and the secretary-general is the deputy director-general of AQSIQ. The members are composed of famous experts and scholars in the fields of quality, science and technology, economy and the heads of relevant administrative departments. Members are approved by the AQSIQ and reported to the National Appraisal and Commendation Coordination Group for the record.
The members of the evaluation and commendation committee shall be appointed for a term of four years, with no more than two consecutive terms.
Article 10 (Establishment of Selection Organization) The Evaluation Committee is composed of the China Quality Award Selection Committee (hereinafter referred to as the Selection Committee), and its main responsibilities are:
(1) Organizing the selection of China Quality Award;
(two) report the selection and results to the evaluation and commendation committee;
(three) to study and solve the relevant problems in the selection of China Quality Award;
(four) to provide suggestions for improving the selection of China Quality Award.
Article 11 (Composition of Selection Organization) The selection committee consists of 1 chairman, 2 to 6 vice-chairmen and several members. Members are experts and scholars in various related fields who have been engaged in quality work for a long time, are familiar with enterprise management, have rich experience in evaluating government awards and have a sense of responsibility. Candidates for membership are proposed by AQSIQ in conjunction with relevant departments and reviewed and approved by the Evaluation and Commendation Committee. The office of the Selection Committee is located in China National Institute of Standardization and undertakes the daily work of the Selection Committee.
A selection committee shall be established before each China Quality Award, and members shall be appointed. The selection committee will be dissolved after the evaluation and commendation of the current China Quality Award.
Article 12 (Supervisory Authority) The Appraisal Committee shall set up the China Quality Award Supervisory Committee (hereinafter referred to as the Supervisory Committee), whose main duties are:
(a) to supervise the recommendation, selection and objection handling of China Quality Awards;
(two) submit a supervision report to the evaluation and commendation committee;
(three) to standardize the evaluation and commendation of China Quality Award.
Article 13 (Supervisory Authority) The board of supervisors shall have a chairman 1 person, two to four vice-chairmen and several members. Members are from discipline inspection, personnel, publicity and other departments, as well as experts in the fields of quality, law and media. Candidates for membership are proposed by AQSIQ jointly with relevant departments of the State Council and approved by the Evaluation and Commendation Committee.
The members of the supervisory committee shall be appointed for a term of four years, with no more than two consecutive terms.
Article 14 (Evaluation Expert Group) Before the selection of each China Quality Award begins, according to the selection needs, several evaluation expert groups shall be set up to make a preliminary evaluation of relevant candidate organizations and individuals of China Quality Award, and the evaluation results shall be reported to the selection committee.
Article 15 (Composition of Expert Groups) Each evaluation expert group shall have a group leader 1 person, a deputy group leader 1 to 3 people, and several members. The team leader is generally a member of the selection committee, and the members are appointed by the qualification system.
Experts from each evaluation group shall be selected from qualified personnel by the selection office according to the specific circumstances recommended by the current China Quality Award, and reported to the secretariat of the evaluation committee for approval. The members of the evaluation expert group rotate once every session. Article 16 (Conditions for Organizing Application) An organization applying for the China Quality Award shall meet the following conditions:
(a) leading quality, technological innovation, excellent brand and outstanding benefits.
(two) in the past five years, it has been awarded by the government at or above the provincial level; Priority is given to recommending government quality awards above the provincial level.
(3) It has reached the quality index stipulated in the Outline of Quality Development (20 1 1-2020) and is at the leading level in China.
(4) The international and domestic market share of leading brand products ranks in the forefront of the industry.
(five) the application object is mainly for grassroots units.
Article 17 (Personal Recommendation Conditions) An individual who is recommended as a candidate for the China Quality Award shall meet the following conditions:
(a) political firmness, high morality, no illegal behavior, abide by professional ethics and social norms.
(two) engaged in quality theory research or quality work practice for a long time, with good theoretical quality, high level of ability and great influence on achievements, and made outstanding contributions to promoting China's quality progress in their posts.
(3) The applicants are mainly for grass-roots units and front-line work.
Eighteenth (veto) in the past three years, one of the following circumstances shall not participate in the declaration and recommendation:
(a) there have been major quality and safety accidents or serious violations of law and discipline;
(two) there are unqualified quality supervision and spot checks at or above the provincial level;
(three) in terms of quality and safety, energy conservation and environmental protection, market order, intellectual property rights and other aspects of administrative punishment by the relevant departments of the State Council.
Article 19 (Reporting Channels) Organizations and individuals that meet the reporting requirements shall apply through the following three channels according to the reporting requirements:
(1) Bureau of Quality and Technical Supervision of all provinces (autonomous regions and municipalities), cities under separate state planning and sub-provincial cities.
(2) The territory is directly under the Entry-Exit Inspection and Quarantine Bureau.
(3) Designated relevant national trade associations and federations.
Among them, local enterprises should declare through the local bureau of quality and technical supervision and the entry-exit inspection and quarantine bureau directly under the central government, and central enterprises can declare through the above three channels.
Article 20 (Nomination and Recommendation) The quality and technical supervision bureaus of provinces (autonomous regions and municipalities) or cities under separate state planning, sub-provincial cities and local inspection and quarantine bureaus directly under them shall, after preliminary examination of the accepted application materials, submit them to the people's governments of provinces (autonomous regions and municipalities) or cities under separate state planning and sub-provincial cities for approval and nomination and recommendation.
After the relevant national trade associations and federations conduct a preliminary examination of the accepted application materials, a deputy director of the Selection Committee will lead the organization to conduct a comprehensive review of the application materials, and then nominate and recommend them.
Article 21 (Formal Examination) The secretariat of the Evaluation and Commendation Committee entrusts the office of the Selection Committee to conduct formal examination of the recommended materials of organizations and individuals, including whether the procedures, procedures and materials for declaration and recommendation meet the prescribed requirements. If the recommended materials fail to meet the specified requirements after examination, they shall not be accepted.
Article 22 (Publicity) Candidate organizations and individuals who have passed the formal examination shall be publicized to the public in a timely manner. If there is no objection to the publicity, they shall be admitted. Confidential matters involving national defense and national security shall be made public within an appropriate scope. If it is found that the candidate organizations and individuals do not meet the relevant conditions, they will not be declared for review. Article 23 (Review Process) The secretariat of the Review and Commendation Committee entrusts the Selection Committee to organize review and demonstration of the candidate organizations and individuals that have passed the formal review, including material review, on-site review, statement and defense, etc.
Article 24 (Evaluation Content) The evaluation content mainly evaluates the basic information, key indicators and veto items of candidate organizations and individuals according to the provisions of the Quality Development Outline (20 1 1-2020).
Article 25 (Contents of Organization Evaluation) The evaluation of candidate organizations includes three aspects: basic situation evaluation, including quality, technology, brand and benefit; Review of key indicators, including product quality qualification rate, quality and technology awards at or above the provincial level, market share of leading brand products at home and abroad, customer satisfaction, etc. ; Review the rejected items, including quality and safety status, law-abiding status and quality supervision and spot check.
Article 26 (Material Evaluation) For the candidate organizations and individuals that have passed the formal evaluation, experts shall be organized to evaluate the basic information of the application materials according to the evaluation points and implementation guidelines, and preliminary evaluation opinions shall be formed and submitted to the selection committee.
The selection committee focuses on the evaluation and rejection of key indicators of candidate organizations and individuals, and reviews the evaluation results, and votes on the shortlist of China Quality Award nomination award and the list of candidate organizations and individuals who enter the on-site evaluation, and reports to the secretariat of the evaluation and commendation committee for social publicity of the preliminary evaluation results.
Article 27 (On-site Review) For the candidate organizations and individuals who enter the on-site review, the review experts will conduct on-site review of the candidate organizations, conduct on-site inspection of the candidate individuals, and verify the relevant key indicators and vetoes.
Article 28 (Statement and Defense) The organization that enters the on-site review shall hold a statement and defense meeting. The legal representative or principal responsible person of the organization shall state the quality work of the organization, and experts shall evaluate the innovative characteristics, development prospects, key indicators and veto items of the organization.
Article 29 (Evaluation and Publicity) The selection committee evaluates the on-site evaluation, states the defense situation, forms the evaluation results, which are publicized by the secretariat of the evaluation committee and reported to the evaluation committee.
Article 30 (Avoidance System) The evaluation of China Quality Awards shall be subject to avoidance system. If judges and staff members have an interest in the reporting organization (individual), they should voluntarily withdraw. Article 31 (Evaluation Results) The evaluation committee shall examine and approve the evaluation results of the selection committee and form an evaluation resolution by voting.
Article 32 (Examination of Results) The General Administration of Quality Supervision, Inspection and Quarantine shall examine the evaluation resolutions made by the evaluation and commendation committee.
Article 33 (Approval of Awards) The General Administration of Quality Supervision, Inspection and Quarantine will submit the audited list of China Quality Awards and the list of nominees for China Quality Awards to the State Council for approval, and commend and award them. Article 34 (Objection System) The appraisal and commendation of China Quality Awards shall be subject to social supervision, and the appraisal shall be subject to the objection system.
Any unit or individual who has any objection to the qualifications of candidates for the China Quality Award and the authenticity of the recommended materials shall submit it to the secretariat of the evaluation committee within the publicity period, and it will not be accepted within the time limit.
Article 35 (Objection Materials) The units or individuals that raise objections shall provide written objection materials and necessary written proof materials.
The units and individuals that raise objections shall show their true identities. If an individual raises an objection, he shall sign his real name on the written objection materials; In the name of the unit, the objection shall be stamped with the official seal of the unit. Anonymous objections are not accepted.
Article 36 (Channels of Objection) Any unit or individual who raises objections shall not directly submit the objection materials to the China Quality Award Selection Committee or its members without authorization; Members who receive objection materials shall promptly forward them to the secretariat of the review committee, and shall not submit them to the expert review group for discussion and forwarding to other members.
Article 37 (Acceptance of Objections) After receiving the objection materials, the secretariat of the evaluation committee shall examine them and accept the objections that meet the requirements and can provide sufficient evidence.
Article 38 (Confidentiality of Objections) In order to safeguard the legitimate rights and interests of dissidents, the secretariat of the evaluation committee and its staff, as well as other relevant personnel involved in the investigation and handling of objections, shall keep the identity of dissidents confidential; If it is really necessary to make it public, it shall solicit the opinions of the dissidents in advance.
After receiving the objection materials, the recommending unit fails to submit the investigation, verification report and coordination opinions within the time specified in the notice of objection, and shall not nominate the candidate organizations or candidates related to the objection.
Article 39 (Handling of Objections) In the process of handling objections, either party to the objection shall actively cooperate and shall not shirk or delay. Candidates and candidates' organizations fail to provide relevant certification materials as required within the specified time, which is regarded as acknowledging the objection; If the units and individuals who raise objections fail to provide relevant certification materials as required within the specified time, they shall be deemed to have waived their objections.
Article 40 (Objection Report) The secretariat of the Evaluation Committee shall report the verification and handling opinions of the objection to the China Quality Award Evaluation Committee, submit them to the China Quality Award Evaluation Committee for decision, and notify the objecting party and the recommending unit of the decision.
The secretariat of the evaluation committee shall promptly notify the China Quality Award Supervision Committee of the handling of objections. Article 41 (Scoring and Ranking) The expert review team shall score the candidate organizations and individuals according to the review points and implementation guidelines, and produce rankings according to the comprehensive scores.
Article 42 (Voting Rules of the Selection Committee) The Selection Committee shall consider the evaluation results of the expert evaluation team by meeting and produce the evaluation results by voting. In the evaluation of candidate organizations and individuals, they will be eliminated by secret ballot, and enterprises and individuals with more than one third (including one third) of the participating members voting against will be eliminated. The list of organizations and individuals entering the on-site review is generated by quota secret ballot.
Article 43 (Voting Rules of the Appraisal Committee) The Appraisal Committee shall examine and approve the appraisal results of the Selection Committee by meeting, and form a appraisal resolution by secret ballot. Among them, the China Quality Award shall be passed by more than two thirds (including two thirds) of the participating members, and the nomination award for the China Quality Award shall be passed by more than one half (including one half) of the participating members.
Article 44 (Requirements of Participants) The voting of the Appraisal and Commendation Committee and the Selection Committee shall be attended by more than two thirds (including two thirds) of the members, and the voting result shall be valid. Article 45 (Appraisal and Supervision) The supervisory committee shall regularly supervise and inspect the selection activities and report to the appraisal and commendation committee. Units and individuals who violate the relevant provisions of the review rules in the selection activities may suggest that relevant parties make corresponding treatment as appropriate.
Article 46 (Supervision Mechanism) The selection committee shall regularly report to the supervision committee on the recommendation, evaluation and objection handling of the China Quality Award. When necessary, the board of supervisors may require the submission of special reports.
Article 47 (Reporting Complaints) Any unit or individual may report and complain to the secretariat of the evaluation committee if it finds any problems in the evaluation and objection handling of the China Quality Award. The secretariat of the review committee conducts investigation and verification according to the complaint information.
Article 48 (Reputation Management) The reputation evaluation mechanism shall be implemented for China Quality Awards. AQSIQ shall establish credit files for experts and scholars participating in the evaluation activities, and credit records shall be used as an important basis for recommending candidates for the selection committee and the evaluation expert group.
Article 49 (Handling of Fraud) The reporting units and individuals shall be responsible for the authenticity of the application materials for China Quality Award provided by them, and fraud is strictly prohibited. Organizations and individuals who have won the China Quality Award by fraud or other improper means, but have not been awarded the award, shall be disqualified from winning the award that year; If the award has been awarded, the award shall be revoked after being reviewed by the evaluation and commendation committee and reported to the AQSIQ for approval, and shall be publicly notified. If the circumstances are serious, you may not declare the China Quality Award for life. At the same time, it is suggested that the unit or the competent department give corresponding punishment.
Article 50 (Accepting Unit) If the accepting unit provides false data and materials to assist the recommending organizations and individuals to defraud the China Quality Award, the AQSIQ will give informed criticism, and if the circumstances are serious, the qualification for accepting the recommendation will be suspended or cancelled; The directly responsible person in charge and other directly responsible personnel are advised to be punished by their units or competent departments.
Article 51 (Supervision Mechanism) Organizations (individuals) who accept on-site evaluation and statement defense evaluate the work quality and discipline style of evaluation experts and personnel, and give feedback to the evaluation and commendation committee and the secretariat of the supervision committee.
Article 52 (Obligation of Confidentiality) Relevant institutions and personnel participating in the evaluation of China Quality Award shall keep the business secrets and technical secrets mastered in the evaluation.
Article 53 (Responsibility of Judges) Judges and staff members who violate the provisions of these Rules shall be disqualified. Because of abuse of power, dereliction of duty, corruption, bribery caused serious consequences, shall be given administrative sanctions. If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 54 (Use of Titles) Organizations and individuals who have won the China Quality Award may use the title of China Quality Award in activities such as publicity, introduction and explanation, but the year of award shall be indicated. It is forbidden to use the title and logo of China Quality Award in advertising, publicity, description and packaging of specific products.
Article 55 (Conditions for Revocation) If an organization that has won the China Quality Award has a major quality, safety and environmental accident in that year, and the quality and safety supervision and inspection at or above the provincial level is unqualified, or the organization or individual has serious violations of law and discipline, the award title shall be revoked and it shall be publicly notified. Article 56 (Source of Funds) The funds needed for the China Quality Award shall be applied to the state finance for settlement.
Article 57 The General Administration of Quality Supervision, Inspection and Quarantine shall be responsible for the interpretation of these Rules.
Article 58 (Date of Implementation) These Rules shall come into force as of the date of promulgation.
