Local public security organs at or above the county level shall, in accordance with their duties and the provisions of relevant laws and regulations, supervise and manage the public security situation, buying and selling forged tickets and other activities in the recycling and dismantling industry of scrapped motor vehicles, and dispose of them according to law.
The local competent department of ecological environment at or above the county level shall supervise and manage the prevention and control of environmental pollution in the recycling and dismantling activities of recycling and dismantling enterprises according to their duties, so as to prevent environmental pollution and deal with it according to relevant laws and regulations.
Local development and reform, industry and information technology, transportation and market supervision departments at or above the county level shall be responsible for the supervision and management of scrapped motor vehicles within their respective administrative areas. Article 6 Industry associations and chambers of commerce for the recycling and dismantling of scrapped motor vehicles shall formulate industry norms, provide information consultation, training and other services, carry out industry monitoring and early warning analysis, and strengthen industry self-discipline. Chapter II Qualification Identification and Management Article 7 The State implements a qualification identification system for recycling and dismantling enterprises. Without qualification, no unit or individual may engage in the business of recycling and dismantling scrapped motor vehicles.
The state encourages motor vehicle manufacturers to engage in the recycling and dismantling of scrapped motor vehicles. Motor vehicle production enterprises shall bear the responsibility of producers in accordance with the relevant provisions of the state, and provide scrap motor vehicle dismantling instructions and other related technical materials to recycling and dismantling enterprises. Article 8 To obtain the qualification for recycling and dismantling scrapped motor vehicles, the following conditions shall be met:
(1) Having the qualification of an enterprise legal person;
(2) The dismantling business premises shall conform to the local overall urban planning or national spatial planning and safety requirements, and shall not be built in environmentally sensitive areas such as residential areas, commercial areas and drinking water source protection areas;
(3) The technical specifications for the site, facilities, equipment, storage and disassembly that meet the national standard "Technical Specifications for Scrap Motor Vehicle Recycling and Dismantling Enterprises" (GB22 128), and the corresponding requirements of professional and technical personnel;
(4) It meets the requirements of the environmental protection standard "Technical Specification for Environmental Protection of Dismantling Scrap Motor Vehicles" (HJ348);
(5) It has an ecological environment protection system that conforms to the provisions of the state, corresponding pollution prevention measures, and a proper disposal plan for the solid waste generated by dismantling. Article 9 An enterprise applying for qualification certification (hereinafter referred to as the applicant enterprise) shall submit a written application to the provincial commerce department where the dismantling business premises are located or through the "National Automobile Circulation Information Management Application Service" system of the Ministry of Commerce, and submit the following written materials:
(1) Application report for establishment (name, legal representative, registered capital, domicile, dismantling place, unified social credit code, etc.);
(2) Applying for an enterprise business license;
(3) applying for the articles of association of the enterprise;
(four) apply for the identity card of the legal representative of the enterprise or other valid identity documents;
(5) Dismantling the land use right, house property right certificate or land lease contract or land use right lease contract or house lease certification materials with the lease term exceeding 10 years;
(6) A list of facilities and equipment used for dismantling scrapped motor vehicles and pollution prevention, and ownership certificates such as invoices or financial leasing contracts, which are purchased by the applicant enterprise or obtained through financial leasing;
(seven) the approval document of the environmental impact assessment document of the construction project issued by the competent department of ecological environment;
(eight) the list of senior management personnel and professional and technical personnel;
(nine) apply for enterprise dismantling operation norms, safety regulations and solid waste utilization and disposal plan.
The above materials can be obtained through the government information system, and the audit institution may no longer require the applicant to provide them. Article 10 The provincial commerce department shall examine the received application materials for qualification recognition, and accept them if they are complete and conform to the legal form; If the materials are incomplete or do not conform to the statutory form, the applicant shall be informed of the contents that need to be corrected within 5 working days from the date of accepting the application.
The provincial commerce department may entrust the local (city) commerce department where the dismantling business premises are located to examine whether the application materials are complete and conform to the statutory form.
