Notice to Applicants
I. GENERAL PROVISIONS
1. WHEREAS, (Name of Bidder), as the bidder for the proposed construction of the (Name of Project), has completed all the formalities of approving, registering and filing of documents prior to bidding for the construction of the project in accordance with the relevant laws, rules, regulations, etc., and is basically equipped to bid for the construction of the project and has been prepared for the construction, completion and delivery of the project. construction, completion, delivery and repair of any defects of the Project, a sufficient sum of money has been raised, part of which will be used for the reasonable payment of the Contract Price under this pre-qualification.
2. The Bidder will prequalify Bid Applicants for this Project. Bid applicants may apply for pre-qualification for one (or more) of the segments of this award.
3. Basic information about the Project, such as climate, hydrology, topography of the project site, site access, transportation and communication equipment, medical facilities, project route, project size, structural form, major construction equipment, special requirements of the Project (construction techniques and measures, etc.), estimated duration, source of funds, and facilities and services to be provided by the Bidder, and other pertinent data, will be Schedule 3 Description.
4. Bidding applicants who have subcontracted should provide detailed reasons for subcontracting and the contents of subcontracting. Inadequate reasons for subcontracting or inappropriate contents of subcontracting may result in their failure to pass the pre-qualification.
2. Application for qualification
1 、Pre-qualification will be open to construction enterprises or consortiums with (construction enterprise qualification category) (qualification level) level and above issued by the competent department of construction administration and with sufficient assets and ability to effectively fulfill the contract.
2. Bidding applicants from countries that have trade agreements with the People's Republic of China*** and state-owned countries and have market access qualifications may apply to participate in the pre-qualification process as long as they fulfill the conditions required in Article 1.
3. In order to be pre-qualified and thereafter to participate in the bidding for the Project, the bidding applicants shall provide the bidders with sufficient and effective documents to prove that they are qualified and capable of effectively performing the contract as stipulated in Article 1 and Article 2. To this end, so the bidding applicants must truthfully fill in and provide the relevant information in accordance with the requirements of the application for pre-qualification and the accompanying series of forms, using indelible water pen or computer printout.
4. Tender applicants must answer all questions raised in the application form and the attached series of schedules. Any missing items will likely result in rejection of their application.
5. Bidding applicants are required to submit information relevant to their qualification and to provide timely clarifications or additions to the information submitted, or they may be prevented from being pre-qualified.
6. All information provided in accordance with the pre-qualification requirements shall be in Chinese. Information in other languages shall be accompanied by a Chinese translation approved by an authorized translation agency. The understanding of the information will be based on the Chinese translation.
7. If the Tender Applicant applies for more than one tender section, the Tender Applicant shall specify in the Application for Prequalification the section(s) for which it is applying and separately provide relevant information on key personnel and equipment (as required in Schedules 10 and 11) for each section applied for.
8. Each page of the application shall be signed by the legal representative of the bidding applicant or his/her authorized agent. If it is not signed by the legal representative of the bidding applicant, the application for pre-qualification shall be accompanied by a letter of authorization from the legal representative. Applications without page-by-page small signatures will be liable to be rejected.
3. Prequalification Evaluation Criteria
1. The prequalification of each Bid Applicant for this Project will be based on the information that can be properly verified provided by the Bid Applicant in accordance with the requirements of the Application for Prequalification and the accompanying series of Forms and these Notes, as well as the criteria of the necessary qualifications agreed in Schedule 1 and the criteria of additional qualifications agreed in Schedule 2 of these Notes.
2. The Bidder will evaluate the financial capability of the Bidding Applicant on the basis of the Bidding Applicant's turnover/revenue from contract works, net worth and the contract sum of the uncompleted portion of the works in progress. If the tender applicant considers that its financial capacity is insufficient, it may submit a letter of guarantee issued by its depositary bank along with the application. The letter of guarantee shall be presented to the bidder and shall guarantee that upon award of the contract to the bidding applicant, the bank will provide the bidding applicant with a revolving credit in the amount specified in the letter of guarantee. Such revolving credit shall continue until the bidder takes possession of the contract work.
3. The Bidder will determine the eligibility of each Bid Applicant to participate in the Work and will only be pre-qualified if it meets in all respects at least all of the criteria for the Required Qualifications (Exhibit 1) and at least % of the criteria for the Additional Qualifications (Exhibit 2) that are required to be met by the Applicant in these Instructions.
Four, consortium
1, if a single enterprise can independently pass the pre-qualification, a single enterprise is encouraged to participate directly in the pre-qualification; consortium consisting of two or more enterprises that have passed the pre-qualification will be regarded as the qualification of the ex officio qualified bidding applicants.
2. A consortium consisting of two or more enterprises shall submit applications for pre-qualification for bidding in accordance with the following requirements:
(1) If a consortium consisting of two or more enterprises fails to meet the requirements for a consortium as specified in these instructions, the application for pre-qualification submitted by the consortium will be rejected.
(2) Each member of the consortium may participate in the pre-qualification individually or in a unified manner in the name of the consortium, but no member of the consortium will be allowed to submit or participate in more than one bid for the Project, and any bid in violation of this provision will be rejected.
(3) Applications submitted by the consortium shall be in accordance with the following requirements:
a. Each member of the consortium shall submit a full set of conforming qualification documents as if it were applying for pre-qualification individually.
b. The application shall guarantee that the applicant will submit a bid in accordance with the requirements of the bidding documents after qualification; the bidding documents and, if awarded, the contract shall bear the signatures of the legally authorized representatives of the members and the seals of the legal entities, so as to be legally binding on the members of the consortium as a whole and on each of them individually; and, unless the corresponding documents have already been annexed to the application for qualification, the bidding documents shall be submitted with the following requirements Unless the corresponding documents have been attached to the application for qualification, the bidding documents shall be submitted with a consortium ****simultaneous bidding agreement, which shall stipulate the members' ****simultaneous and respective responsibilities in the consortium.
c. The application must include a statement of the shares and responsibilities which each member of the consortium plans to assume; each member of the consortium must have adequate experience and competence for the work he is undertaking.
d. One member should be agreed in the application as the sponsor of the consortium and correspondence between the applicant and the bidder will be passed through the sponsor.
(4) Any change in the composition, etc., of the qualified consortium after pre-qualification must be agreed to in writing by the bidder prior to the deadline for submission of bids; and any change in the consortium shall not be permitted if, in the opinion of the bidder, the change will result in any of the following:
a. a. a serious impact on the overall competitive strength of the consortium;
b. a new consortium which has not been passed or new members not participating in the pre-qualification;
c. The qualification conditions of the consortium have fallen short of the qualification criteria for pre-qualification;
d. Any other circumstance which, in the opinion of the bidder, will affect the interests of the works to be tendered.
(5) The assessment of the overall capacity of the consortium will be based on the qualification conditions of the member with the lower qualification level in the same specialty, in accordance with the provisions of the Construction Law of the People's Republic of China and the Bidding and Tendering Law of the People's Republic of China.
3. Members who pass the pre-qualification in the name of a consortium are not allowed to participate in the bidding independently or join other consortiums and are automatically considered pre-qualified. If a consortium regrouped before the deadline for application for pre-qualification submits an application for pre-qualification, the bidder shall decide whether to accept it on a case-by-case basis.
4. Firms that have participated in the prequalification on the basis of subcontracting a specific part of the Project by a qualified subcontractor and have been successful must seek the approval of the Bidder before changing the subcontractor or the scope of subcontracting work listed, otherwise their prequalification will be automatically invalidated.
5. Applicants must provide appropriate assurances and understanding of the above requirements of the bidders in writing as part of the evaluation.
V. Conflict of Interest
In the past three years and at present, the bidding applicants (including all parties of the consortium) shall:
(1) not have any subordinate relationship with the bidding agent of the project;
(2) not have been involved in the preparation of the design, technical specifications, prequalification or bidding documents of the project;
(3 ) has no subordinate relationship with the organization that will undertake the supervision of this contract.
VI. Submission of Application
1. The application for pre-qualification and related information of the bidding applicant must be delivered to the bidder or the bidding agent after sealing before the time of
on the day of January, 2012, and the late application will be rejected.
The bidding applicant should submit one original and one copy.
2. The name and mailing address of the bidding applicant shall also be clearly indicated on the cover of the application for prequalification.
3. While submitting the application, the bidding applicant shall submit the following certificates, original information documents and photocopies of the originals for the bidder's examination:
(1) the bidding applicant's legal person's business license;
(2) all the qualification certificates of the bidding applicant.
4. All documents submitted by the bidding applicant will be treated as confidential documents and will not be returned.
VII. Updating of Pre-qualification Materials
When submitting the bidding documents, the bidding applicant is required to re-update the financial status materials in the pre-qualification application to prove that it still meets the pre-qualification evaluation criteria and that the materials provided are confirmed. If at the time of tendering the tender applicant is no longer able to meet the qualification criteria, its tender will be annulled.
VIII. NOTIFICATION AND CONFIRMATION
1. Only pre-qualified tender applicants may participate in the tender. Each qualified bidding applicant or a member of a consortium can only participate in one or more bidding segments at one time. If the enterprise simultaneously submits multiple bids as an independent bidding applicant or a member of a consortium at one time, all bids including that enterprise's bid will be annulled. This provision shall not apply to those specialized subcontractors whose multiple bid applicants will *** be used together.
2. The bidder reserves the right to:
(1) Modify the size and total amount of the work to be tendered; in such cases, the bidding applicant may participate in the bidding for the contract only if it meets the requirements of the modified contract and is pre-qualified.
(2) Rejection or acceptance of any application;
(3) Cancellation of pre-qualification or rejection of all applications.
The bidder will not be responsible for the above actions and will not be obligated to inform the bidding applicant of its reasons regarding the above actions.
3. Within days after the deadline for submission of applications for pre-qualification, the bidder will notify the bidder in writing of the results of the evaluation of its applications for pre-qualification and will issue a notice of pre-qualification to the pre-qualified bidder; the bidder will not give any reasons for this decision.
4. Bidding applicants will be qualified to participate in the bidding for the Project upon receipt of the notice of pre-qualification; in view of the fact that there can be only one successful bidder and for the purpose of protecting the interests of the individual bidding applicants, the bidder will reserve the option of making further evaluations in order to select, on the basis of merit, the appropriate number of pre-qualified bidding applicants, in the event that the number of pre-qualified bidding applicants greatly exceeds the minimum number stipulated by the State. qualified bidding applicants.
5. The bidding applicant shall confirm in writing upon receipt of the notice of pre-qualification.
