Rules for Domestic Transportation of Passengers and Baggage of Civil Aviation of China

(Formulated on January 1, 1985 and revised on February 28, 1996) Article 1 These rules are formulated in accordance with the Civil Aviation Law of the People's Republic of China in order to strengthen the management of domestic air transportation of passengers and baggage, protect the lawful rights and interests of the carriers and the passengers, and to maintain the normal order of air transportation.

Article 2 These rules apply to the domestic air transportation of passengers and baggage by civil aircraft and receive compensation for domestic air transportation and free domestic air transportation with the consent of the carrier. The "domestic air transportation" referred to in these rules is the air transportation under the contract of carriage of passengers whose origin, agreed stopping place and destination are all within the territory of the People's Republic of China.

Article 3 The following terms used in these Rules, unless otherwise required by specific provisions or expressly provided for, shall have the following meanings:

(1) "Carrier" includes the air carrier that issues the ticket and all air carriers that carry or agree to carry the passengers and their baggage listed in the ticket.

(b) "Sales Agent" means an enterprise engaged in the business of sales agent for civil air transportation.

(c) "Ground Service Agent" means an enterprise engaged in the business of ground service agent for civil air transportation.

(d) "Passenger" means any person, other than a member of the crew, who, with the consent of the Carrier, is carried on board a civil aircraft.

(e) "group passenger" means a unified organization of more than 10 people (including 10 people) with the same voyage, date of travel and flight.

(f) "Child" means a person who is two years old but less than twelve years old.

(g) "Infant" means a person who is less than two years of age.

(viii) "Reserved Seat" means a reservation for a passenger's reserved seat, class of cabin or for the weight or volume of baggage.

(ix) "Contract unit" means the unit with which the Carrier has entered into a contract for reservation of seats or purchase of tickets.

(j) "Flight" means a regular flight of an aircraft on a specified route, date and time.

(k) "Passenger Seating Order" means the business document which must be filled in by the Carrier or its sales agent before the passenger purchases the ticket in order to make the reservation and fill in the passenger ticket.

(xii) "Valid Identity Document" means the document prescribed by the competent governmental authority to prove the identity of the passenger that must be presented by the passenger when purchasing the ticket and traveling on the airplane. For example, resident's identity card, valid passport, military officer's card, police officer's card, soldier's card, civilian cadres or retired cadres' certificate, student's card for minors under the age of 16, household registration book and other documents can be used according to regulations.

(xiii) "Passenger Ticket" means a document called "Passenger Ticket" and baggage vouchers issued by or on behalf of the Carrier, including the conditions of the contract of carriage, declarations, notices, and passenger coupons and passenger coupons.

(xiv) "Combined Ticket" means a ticket for two or more flights.

(xv) "Round-trip Ticket" means a ticket for a return trip from the place of departure to the place of destination by the same route to the original place of departure.

(xvi) "Regular Ticket" means a ticket which specifies the flight, date of boarding and seat reservation.

(xvii) "Non-scheduled ticket" means a ticket with no flight, date of travel and seat reservation.

(xviii) "Connection" means the portion of the Ticket marked "Suitable for Transportation", indicating that the connection is suitable for transportation between two specified points.

(xix) "Passenger coupon" means the part of the Ticket marked "Passenger coupon", which is always in the possession of the passenger.

(xx) "Missed Flight" means a Passenger who fails to complete the formalities for boarding an aircraft within the prescribed time or fails to board an aircraft due to non-compliance of travel documents.

(xxi) "Missed Flight" means that a passenger has not boarded the designated flight after checking in at the originating station of the flight, or while transiting at a stopover station.

(xxii) "Wrong Flight" means that the passenger has taken a flight other than the one specified in the ticket.

(xxiii) "Baggage" means articles and other personal effects carried by the Guest for the purpose of wear, use, comfort or convenience during the Trip. Unless otherwise provided, it includes the checked baggage and self-cared baggage of the traveler.

(xxiv) "Checked baggage" means the baggage which the passenger places in the care and transportation of the carrier and for which a baggage ticket has been issued.

(25) "Self-care baggage" means the baggage that the Carrier agrees to take care of by the passenger himself.

(xxvi) "Carry-on Articles" refers to small articles which the Carrier agrees to be carried by the passenger himself.

(xxvii) "Luggage tag" refers to the identification of the luggage and the proof of the passenger's receipt of the checked baggage.

(xxviii) "Departure Time" means the time when the door of the aircraft is closed after the passenger has boarded the flight.

Article 4 The flight schedule of the Carrier shall be announced to the public prior to its implementation. The carrier's flight schedule shall not be changed arbitrarily. However, the Carrier may make adjustments in accordance with the prescribed procedures to ensure flight safety, first aid and other special needs. Article 5 A passenger, after fixing his seat, shall travel on the airplane with the ticket of such fixed seat. The carrier may prescribe the time limit for accepting seat reservations for a flight, and may suspend acceptance of seat reservations for a particular flight if necessary. Unscheduled tickets shall not be used until a seat has been booked with the Carrier. Contracted units shall be seated as agreed in the contract.

Article 6 A passenger shall purchase a ticket for a seat that has already been booked within the time limit specified or pre-agreed by the Carrier, and the Carrier shall reserve the booked seat within the time limit specified or pre-agreed. The Carrier shall provide a seat to a passenger on the flight and class of accommodation for which the passenger has been booked.

Article 7 If a passenger holding an interline or return ticket with a confirmed seat stays for more than 72 hours at the place of the interline or return, he/she shall go through the seat reconfirmation procedure before 12:00 noon two days before the departure of the interline or return flight, otherwise the seat he/she has booked shall not be reserved. If the arrival time of the passenger for the connecting or return trip is not more than 72 hours before the departure time of the flight, the passenger is not required to go through the seat reconfirmation procedures. Article 8 The passenger ticket shall be in the form of registered name and shall be used only by the passenger whose name is listed on the ticket, and shall not be transferred or altered, otherwise the ticket shall be invalid and the fare shall not be refunded. The ticket shall include at least the following:

(1) the name of the carrier;

(2) the name, time and place of the issuer;

(3) the name of the passenger;

(4) the place of departure, stop and destination;

(5) the flight number, class of cabin, date and departure time;

(6) the fare and the mode of payment;

(7) the number of passengers; and (8) the number of passengers. Fare and method of payment;

(vii) Ticket number;

(viii) Matters of transportation instructions.

Article 9 The passenger shall complete all the voyages specified in the passenger ticket within the validity period of the ticket. When the passenger uses the passenger ticket, he/she shall present a valid passenger ticket, including the passenger coupon of the flight segment and all other unused passenger coupons and passenger coupons retained on the passenger ticket, without any of the above coupons, the passenger ticket shall be invalid. For international and domestic interline tickets, the passenger coupon of the domestic interline segment can be used in the domestic interline segment and does not need to be exchanged into a domestic passenger ticket; a domestic air transport ticket purchased by a passenger outside of China with an international passenger ticket shall be exchanged into a domestic passenger ticket of China before it can be used. The carrier and its sales agent shall not use domestic air transportation passenger tickets for sales outside China. Regular passenger tickets are only applicable to the date of travel and flights stated on the ticket.

Article 10 The validity period of the passenger ticket is as follows:

(1) The passenger ticket is valid for transportation for one year from the date of commencement of travel. If the passenger ticket is not used in its entirety, it shall be valid for transportation for one year from the date of filling out the passenger ticket.

(2) The validity period shall be calculated from 00:00 hours of the day following the date of commencement of travel or the date of filling out the passenger ticket to 00:00 hours of the day following the date of expiration of the validity period.

Article 11 The Carrier and its agents shall be conscientious and responsible in selling tickets. If the Passenger fails to travel within the validity period of the Ticket due to reasons attributable to the Carrier, the validity period of the Ticket shall be extended until the Carrier is able to make arrangements for the Passenger to board the airplane. Article 12 The passenger fare means the price of air transportation of a passenger from the airport of departure to the airport of destination, excluding the cost of ground transportation between the airport and the city. The passenger fare is the fare applicable on the date when the passenger commences his/her flight. After the sale of a passenger ticket, if the fare is adjusted, the fare shall not be changed. The fares published in the tariff table are applicable to transportation on non-stop flights. If a passenger requests a stopover or transfer to another flight, the fare shall be calculated by adding up the actual segments.

Article 13 The passenger shall pay for the ticket in the currency and in the manner prescribed by the State, and unless otherwise agreed between the Carrier and the passenger, the ticket shall be paid on demand. Article 14 A passenger shall purchase a ticket at the ticket office of the carrier or its sales agent. Passengers shall purchase tickets on the basis of their own valid identity documents or other identity documents issued by the public security organs and fill in the Passenger Seat Reservation Sheet. To purchase a child ticket or an infant ticket, a valid certificate of the year of birth of the child or infant shall be provided. A seriously ill passenger shall have a certificate issued by a medical unit that he/she is fit to travel by air, and shall be allowed to purchase a ticket only after the carrier agrees to do so. Each passenger shall be issued a separate ticket.

Article 15: Revolutionary disabled soldiers shall purchase tickets at 80% of the applicable fares with the Revolutionary Disabled Soldiers' Pension Certificate. Children shall purchase a child ticket at 50% of the applicable adult fare, with seats provided. Infants shall purchase infant tickets at 10% of the applicable adult fare, with no seat provided; if they need to occupy a separate seat, they shall purchase a child ticket. If each adult passenger carries more than one infant, a child ticket shall be purchased for the number in excess.

Article 16 The Carrier or its sales agent shall sell tickets for interline, round-trip and return journeys at the request of passengers.

Article 17 The ticketing office shall set up the necessary information such as schedule, route map, air tariff table and passenger information. Article 18 After a passenger purchases a ticket, if the passenger requests to change the flight, date or class of travel, the carrier and its sales agent shall actively handle the request according to the actual possibility.

Article 19 In the event of flight cancellation, advancement, delay, change of route or failure to provide the original seat, the Carrier shall give priority to the passenger to take the subsequent flight or sign for another carrier's flight. If the class of the passenger's cabin is changed due to the Carrier's reasons, the difference in the ticket price shall be more or less than the refund.

Article 20 A passenger requesting a change of carrier shall obtain the consent of the original carrier or ticket issuer and shall be signed for on the condition that the seat on the new carrier's flight permits. When a passenger is required to change the carrier under the circumstances listed in Article 19, paragraph 1 of these Rules. The consent of the passenger and the carrier to be endorsed shall be obtained before endorsement. Article 21 If the passenger does not complete part or all of the voyage within the validity period of the ticket due to the reasons of the carrier or the passenger, the passenger may request a refund of the ticket within the validity period of the ticket. If the passenger requests for refund, he/she shall apply for refund by presenting the ticket or the unused portion of the ticket with the "passenger coupon" and the "passenger coupon". Refunds can only be made at the ticket office of the carrier or its sales agent at the place of issuance of the ticket, the place of departure of the flight, or the place of termination of travel. The refund can only be made to the passenger himself or the payer of the ticket as stated on the ticket.

Article 22 A passenger who voluntarily refunds a ticket shall, in addition to a valid passenger ticket, provide the passenger with his/her own valid identity document, and the refund shall be handled in accordance with the following terms and conditions.

(1) If a passenger requests a refund within 24 hours and two hours before the scheduled departure time of the flight, a refund fee of 10% of the passenger ticket price shall be charged; if a passenger requests a refund within two hours before the scheduled departure time of the flight, a refund fee of 20% of the passenger ticket price shall be charged. If the refund is requested after the scheduled departure time of the flight, it will be treated as a missed flight.

(2) Passengers holding interline or round-trip tickets requesting for refund shall be handled in accordance with the provisions of the first paragraph of this Article.

(3) Revolutionary invalids requesting for refund of tickets shall be exempted from the refund fee.

(4) Passengers holding infant tickets are exempted from the refund fee.

(5) Passengers holding irregular tickets who request a refund shall go to the place where they originally purchased the ticket to apply for a refund within the validity period of the ticket.

(6) If a passenger automatically terminates his/her travel at the stopover place of the flight, the ticket price for the unused segment of the flight shall not be refunded.

Article 23 If a passenger requests a refund of his ticket when the flight is canceled, advanced, delayed, or when the voyage is changed or the Carrier is unable to provide the original seat, the originating station shall refund the full amount of the ticket, and the place of stop shall refund the full amount of the ticket for the unused section of the flight, and neither of them shall charge a refund fee.

Article 24 If a passenger requests a refund due to illness, the passenger shall provide a certificate from the medical unit, and the originating station shall refund the full amount of the ticket, and the stopping place shall refund the full amount of the ticket for the unused section of the flight, and neither of them shall charge a refund fee. If the companion of a sick passenger requests for ticket refund, it shall be handled in accordance with the provisions of Paragraph 1 of this Article. Article 25 A passenger who loses a passenger ticket shall apply in writing to the Carrier or its sales agent for loss of the ticket. The Carrier shall not be liable if the passenger ticket has been fraudulently used or refunded before the passenger applies for loss.

Article 26 If a regular passenger ticket is lost, the passenger shall provide proof to the Carrier one hour before the scheduled departure time of the flight on which the passenger is traveling, and the Carrier may reissue a new ticket for the original flight. The replacement ticket cannot be refunded.

Article 27 If an irregular passenger ticket is lost, the passenger shall promptly apply for its loss by providing proof to the ticketing place where the ticket was originally purchased, and the ticketing place shall promptly notify the carriers concerned. Upon verification that the ticket has not been fraudulently used, fraudulent refund, pending the expiration of the validity of the ticket within 30 days, for refund procedures. Article 28 Group passengers shall purchase tickets within the specified or pre-agreed time limit after booking their seats, otherwise, the booked seats shall not be reserved.

Article 29 If a group passenger voluntarily refunds the ticket after purchasing the ticket, a refund fee shall be charged according to the following provisions:

(1) If a group passenger requests for refund of the ticket 72 hours prior to the departure time of the flight, a refund fee of 10% of the passenger ticket price shall be charged.

(2) A refund fee of 30% of the ticket price shall be charged to group passengers who request a refund within 72 hours of the scheduled departure time of the flight and before 12:00 noon of the day before the scheduled departure.

(3) A refund fee of 50% of the ticket price will be charged for a group of passengers who request a refund after 12:00 noon on the day before the scheduled departure time of the flight and before the departure of the flight.

(4) The refund of tickets requested by group passengers holding interline or round-trip tickets shall be handled in accordance with the provisions of items (1), (2) and (3) of this Article, respectively.

(5) If a group passenger misses the flight, the ticket shall be void and no refund shall be made.

Article 30 If some members of a group of passengers request a refund of their tickets, the refund fee for such members shall be charged in accordance with the provisions of Article 29 of these Rules.

Article 31 In case a group passenger requests to change or refund his/her ticket involuntarily or some members of the group passenger request to change or refund his/her ticket due to illness, it shall be handled in accordance with the provisions of Article 19, Article 23 or Article 24 of these Rules, respectively. Article 32 The passenger shall arrive at the airport within the time limit specified by the carrier, and with the ticket and his or her own valid identification documents on time for ticket inspection, checked baggage, boarding passes and other passenger procedures. The carrier shall notify the passengers in an appropriate manner of the time specified by the carrier when check-in procedures are to cease. The Carrier shall open the check-in counters on time, accept passenger tickets issued by passengers in accordance with the regulations, and conduct check-in procedures quickly and accurately.

Article 33 Before boarding an airplane, passengers and their baggage must undergo security checks.

Article 34 Special passengers such as unaccompanied children, invalid passengers, pregnant women, blind, deaf or convicted passengers, etc., shall be carried only with the prior consent of the Carrier under the conditions stipulated by the Carrier, and with arrangements made by the Carrier when necessary. The Carrier shall not carry passengers with infectious diseases, mental illnesses or passengers whose health conditions may endanger themselves or affect the safety of other passengers. The Carrier shall have the right to refuse to carry a passenger who is unable to travel by air according to relevant state regulations, and the purchased ticket shall be refunded voluntarily.

Article 35 Passengers who miss their flights shall be handled in accordance with the following provisions:

(1) Passengers who miss their flights shall go to the airport where they traveled or the place where they originally purchased their tickets to go through the procedures of changing flights or refunding their tickets.

(2) If a passenger who has missed his flight requests to be transferred to a subsequent flight, the Carrier shall actively make arrangements for the subsequent flight if there are available seats on the subsequent flight. No missed flight fee will be charged.

(3) If a passenger misses his flight and requests a refund, the Carrier may charge an appropriate missed flight fee.

The missed flight of a passenger shall be handled in accordance with the following provisions:

(1) If a missed flight occurs due to a passenger and the passenger requests for a refund of the ticket, it shall be handled in accordance with the relevant provisions of the first paragraph of this Article.

(2) If a passenger misses a flight for reasons attributable to the Carrier, the Carrier shall arrange for the passenger to take a subsequent flight as soon as possible. If the passenger requests a refund of the ticket, it shall be handled in accordance with the provisions of Article 23 of these Rules.

The passenger's misuse shall be handled in accordance with the following provisions:

(1) If a passenger misuses an airplane, the Carrier shall arrange for the misused passenger to take the earliest available flight to the destination on the passenger's ticket, and the fare shall not be refunded or made up.

(2) If a passenger takes a wrong flight due to reasons attributable to the Carrier, the Carrier shall arrange for the passenger to take a subsequent flight at the earliest possible time. If the passenger requests a refund of the ticket, it shall be handled in accordance with the provisions of Article 23 of these Rules. Article 36 The baggage carried by the Carrier shall be limited to articles within the definition of Article 3, paragraph 23 of these Rules. The baggage carried by the carrier is divided into checked baggage, self-cared baggage and carry-on articles according to the responsibility of transportation. Important documents and information, diplomatic pouch, securities, currency, bills of exchange, valuables, fragile and perishable articles, and other articles requiring personal care shall not be carried in the checked baggage. The carrier shall bear the compensation responsibility for the loss or damage of the above articles in the checked baggage according to the general checked baggage. Prohibited articles, restricted articles, dangerous articles, and other articles with bad smell or easily deface the aircraft as stipulated by the state cannot be checked as baggage or included in the baggage. The carrier may refuse to accept or terminate the transportation at any time if, before accepting the baggage or in the course of transportation, it finds that the baggage contains any articles that cannot be transported as baggage or clipped into the baggage. Passengers are not allowed to carry control knives on board. Sharp or blunt objects other than control knives shall be checked in with the checked baggage and cannot be carried on.

Article 37 Checked baggage must be well-packed, well-locked and securely tied, able to withstand a certain degree of pressure, and able to be safely loaded, unloaded and transported under normal operating conditions, and shall comply with the following conditions, or else the carrier may refuse to accept it for transportation:

(1) suitcases, travel bags and handbags, etc., must be locked;

(2) more than two pieces of the package, which cannot be be bundled into one piece;

(iii) no other items can be attached to the baggage;

(iv) bamboo baskets, mesh pockets, straw ropes, straw bags, etc. cannot be used as the outer packaging of the baggage;

(v) the baggage should be written with the traveler's name, detailed address and telephone number. The weight of checked baggage cannot exceed 50 kilograms per piece, and the volume cannot exceed 40(60(100 centimeters, and any baggage exceeding the above provisions shall be checked only with the prior consent of the carrier. The weight of self-care baggage cannot exceed 10 kilograms and the volume cannot exceed 20(40(55 centimeters per piece. The weight of carry-on items is limited to 5 kilograms per passenger. Passengers holding first class tickets are allowed to carry two items per person. The volume of each carry-on item shall not exceed 20(40(55 centimeters. Carry-on articles exceeding the above weight, number of pieces or volume limitations shall be checked in as checked baggage.

Article 38 Free baggage allowance (including checked and self-cared baggage) for each passenger: 40 kilograms for first class passengers holding adult or child tickets, 30 kilograms for business class passengers and 20 kilograms for economy class passengers. No free baggage allowance is available for passengers holding infant tickets. If two or more passengers traveling on the same flight to the same destination check in their baggage at the same time and place, their free baggage allowance can be calculated in accordance with the standard of their respective fare classes. For domestic flight segments that constitute international transportation, the free baggage allowance of each passenger shall be calculated according to the free baggage allowance of the applicable international routes.

Article 39 Passengers must check in baggage with valid tickets. The carrier shall indicate the number and weight of checked baggage on the passenger ticket and baggage ticket. The Carrier shall generally collect the baggage when checking in on the day of flight departure; if the baggage of a group of passengers is too much, or needs to be checked in advance for other reasons, the Carrier may agree with the passengers on the time and place to collect the baggage. The Carrier shall bolt a baggage tag to each piece of baggage checked in by the passenger and hand the identification link thereof to the passenger. With the consent of the carrier's own baggage should be combined with the checked baggage weight, and then handed over to the passenger to bring into the cabin to take care of their own, and in the baggage on the bolt to hang self-care baggage tag. Items not belonging to baggage shall be checked as goods and cannot be checked as baggage.

Article 40 The passenger's overweight baggage shall be transported with the passenger on the same airplane if the capacity of the airplane he is traveling on permits. The passenger shall pay the excess baggage fee, and the rate of the excess baggage fee shall be calculated at 1.5% of the economy class fare per kilogram, and the amount shall be in Yuan.

Article 41 The carrier may inspect the baggage of a passenger together with the passenger for the sake of transportation safety; if necessary, it may inspect the baggage together with the relevant departments. If the passenger refuses to be inspected, the carrier has the right to refuse transportation of such baggage.

Article 42 The checked baggage of a passenger shall be transported on the same flight as the passenger; if it cannot be transported on the same flight under special circumstances, the Carrier shall explain this to the passenger and give priority to arrange for its transportation on a subsequent flight.

Article 43 When the value of a passenger's checked baggage exceeds RMB 50 per kilogram, the declared value of the baggage can be handled. The Carrier shall charge a surcharge on the declared value at the rate of 5% of the value of the part of the declared value of the passenger that exceeds the limit specified in the first paragraph of this Article. The amount is in Yuan. The declared value of checked baggage cannot exceed the actual value of the baggage itself. The maximum limit of declared value of baggage for each passenger is RMB 8,000 yuan. If the carrier disagrees with the declared value and the passenger refuses to accept the inspection, the carrier has the right to refuse to accept the transportation.

Article 44 Small animals refer to cats, dogs or other small animals kept at home. Transportation of small animals shall be handled in accordance with the following provisions:

The passenger must make a request at the time of booking a seat or purchasing a ticket and provide a certificate of quarantine of the animal, which can be consigned only after the consent of the carrier. The passenger shall transport the small animal to the airport for consignment by himself on the same day of the flight and at the time specified by the carrier. The container for small animals shall meet the following requirements:

(a) It can prevent the small animals from damaging, escaping and extending beyond the container to damage the passengers, baggage or goods.

(b) to ensure air circulation, do not cause small animals suffocate.

(c) to prevent feces from overflowing, so as not to contaminate the aircraft, equipment and other items on board. Small animals carried by passengers, except by the carrier's license, can not be transported in the passenger cabin. The weight of small animals and their containers shall be charged separately according to the standard of overweight baggage charge.

Article 45 The diplomatic bag shall be carried by the diplomatic courier under his own care. At the request of the diplomatic courier, the carrier shall also handle it as checked baggage, but the carrier shall only bear the responsibility of general checked baggage. Diplomatic courier to carry the diplomatic bag and baggage, can be combined weight or pieces, more than the free baggage allowance, in accordance with the provisions of overweight baggage. When the diplomatic bag needs to occupy a seat, it must be proposed at the time of seat reservation and agreed by the carrier. The weight limit of the diplomatic bag occupying each seat shall not exceed 75 kilograms, and the volume and weight limit of each piece is the same as that of baggage. There is no free baggage allowance for diplomatic baggage occupying a seat, and the freight charge is calculated according to the following two methods, whichever is higher:

(1) Based on the actual weight of diplomatic baggage occupying a seat, and calculate the freight charge according to the rate of overweight baggage;

(2) Based on the number of seats occupied by diplomatic baggage occupying a seat. Freight shall be calculated on the basis of the fare between the place of origin and destination of transportation, which is the same as the fare class of the passenger ticket held by the diplomatic courier.

Article 46 If any of a passenger's checked baggage, self-cared baggage and carry-on articles contains any prohibited articles, restricted articles or dangerous articles as stipulated by the state, the whole piece of baggage shall be called unauthorized baggage. The handling of illegal baggage is stipulated as follows:

(1) When illegal baggage is found at the place of departure, it should be refused to be transported; if it has been transported, it should be canceled or the illegal articles should be taken out and transported, and the overweight baggage fee charged will not be refunded.

(2) In the stopping place found in violation of baggage, should immediately stop transportation, has been charged for excess baggage charges are not refundable.

(3) The prohibited articles, restricted articles or dangerous goods stipulated by the state that are carried in the illegal baggage shall be handed over to the relevant departments for disposal.

Article 47 Due to the reasons of the carrier, it is necessary to arrange for passengers to change to other flights, the baggage transportation shall be changed accordingly with the passengers, and the overweight baggage fees collected shall be refunded; the surcharge on the declared value delivered shall not be refunded. The refund of baggage shall be handled according to the following provisions:

(1) Passengers requesting for refund of baggage at the place of departure must make the request before the baggage is loaded on the plane. If the passenger returns the ticket, the checked baggage must also be returned at the same time. For all the above returns, the excess baggage charge shall be refunded.

(2) If a passenger returns his/her baggage at the stopover place, the excess baggage charge for the unused section of the flight shall not be refunded.

(3) In case of return of baggage with declared value, the surcharge for declared value delivered at the place of origin shall be refunded, while the surcharge for declared value delivered at the place of stopover shall not be refunded.

Article 48 Passengers shall claim their baggage at the airport immediately after the arrival of the flight by presenting the identification link of the baggage tag. If necessary, the passenger's ticket shall be surrendered. The Carrier shall deliver the baggage with the identification link of the baggage tag and shall not be responsible for whether the person who receives the baggage is indeed the passenger himself or herself, as well as for the losses and expenses incurred as a result. Upon the delayed arrival of the passenger's baggage, the Carrier shall immediately notify the passenger to claim it, or it can be delivered to the passenger directly The passenger shall be deemed to have delivered the checked baggage in good condition if he/she does not raise any objection when he/she claims the baggage. If the passenger loses the identification link of the baggage tag, the passenger shall immediately report the loss to the Carrier. If the passenger requests to claim the baggage, he/she shall provide sufficient proof to the Carrier and issue a receipt when he/she claims the baggage. The Carrier shall not be liable if the baggage has been claimed fraudulently before the declaration of loss.

Article 49 If the undeliverable baggage remains unclaimed for more than 90 days from the next day of the arrival of the baggage, the Carrier may deal with it in accordance with the relevant provisions on undeliverable baggage.

Article 50 In case of delay, loss or damage in the transportation of baggage, the carrier or its agent at the place of stopover or destination of the flight shall fill in the Record of Accidents in the Transportation of Baggage together with the passengers, find out the situation and reasons as soon as possible, and reply to the passengers and the relevant units with the results of the investigation. In case of baggage compensation, it shall be handled at the stopping place or destination. If the checked baggage of a passenger fails to arrive on the same plane with the passenger due to the reasons of the carrier, which causes inconvenience to the passenger's life on the journey, the passenger shall be given appropriate compensation for temporary necessities at the stopping place or destination.

Article 51 The amount of compensation for total or partial damage or loss of a passenger's checked baggage shall not exceed RMB 50 per kilogram. If the value of baggage is less than RMB 50 per kilogram, the compensation shall be based on the actual value. The overweight baggage fee charged shall be refunded. The weight of the lost baggage is calculated according to the weight of the actual checked baggage. If the weight cannot be determined, each passenger's lost baggage can only be compensated according to the free baggage allowance enjoyed by the passenger. If the passenger's lost baggage has applied for the declared value of baggage, compensation shall be made according to the declared value, and the surcharge for declared value shall not be refunded. If the declared value of the baggage is higher than the actual value, compensation shall be made according to the actual value. If the baggage is damaged, compensation shall be made according to the reduced value of the baggage or the repair cost shall be borne by the passenger. The maximum amount of compensation to be borne by the Carrier for the loss of a passenger's own baggage and carry-on articles due to events occurring during embarkation or disembarkation or on board the aircraft shall not exceed RMB 2,000 per passenger. For domestic flight segments constituting international transportation, baggage compensation shall be handled in accordance with the applicable regulations on baggage compensation for international transportation. After the lost baggage of the compensated passenger is found, the Carrier shall promptly notify the passenger to collect it, and the passenger shall collect his/her own baggage and return all the compensation. The compensation for temporary living goods shall not be refunded. If the passenger is found to have obvious fraudulent behavior, the Carrier shall have the right to recover the full compensation.

Article 52 A passenger whose checked baggage is lost or damaged shall submit a claim for compensation to the Carrier or the agent in accordance with the legal time limit and attach the passenger ticket (or photocopy), the identification coupon of the baggage tag, the Record of Accidents in Baggage Transportation, the vouchers proving the content and price of the baggage as well as other relevant certificates. Section I General Services

Article 53 The carrier shall ensure flight safety and flight normalcy, provide good service as a guideline, with civilized and courteous, warm and considerate service attitude, and conscientiously do a good job in the air and on the ground in the transport of passengers in the various services.

Article 54 The personnel engaged in air transport passenger service shall undergo appropriate training and obtain the certificate of competency. Those who have not obtained the certificate shall not engage in air transport passenger service.

Article 55 In the course of air transportation, when a passenger suffers from an illness, the carrier shall actively take measures to rescue him/her as far as possible.

Article 56 In the course of air transportation, the carrier shall provide passengers with drinks or meals according to the flight time.

Section 2: Services for Unusual Flights

Article 57 If a flight is delayed or canceled at the place of origin due to reasons of aircraft maintenance, flight deployment, business, crew, etc., the Carrier shall provide passengers with meals or accommodation.

Article 58 If a flight is delayed or canceled at the place of origin due to weather, emergencies, air traffic control, security check, passengers and other reasons not attributable to the Carrier, the Carrier shall assist the passengers in arranging for meals and accommodation at the passengers' own expense.

Article 59 If a flight is delayed or canceled at the place of stopover, the Carrier shall be responsible for providing meals and accommodation to the stopover passengers regardless of the reasons.

Article 60 When a flight is delayed or canceled, the Carrier shall promptly notify the passengers of the delay or cancellation of the flight and do a good job of explanation.

Article 61 The Carrier and other security departments shall cooperate with each other, perform their respective duties, be conscientious and responsible, and ****together to ensure normal flights and avoid unnecessary flight delays.

Article 62 When a flight is delayed or canceled, the Carrier shall, at the request of the passengers, make arrangements for subsequent flights or refund the tickets in accordance with the provisions of Articles 19 and 23 of these Rules. Article 63 These rules shall come into force on March 1, 1996. The Civil Aviation Administration of China on January 1, 1985 the formulation and implementation of the "passenger, baggage domestic transport rules" shall be repealed at the same time.
