Article 3 The special funds for employment must adhere to the principle of earmarking, and be used strictly in accordance with the prescribed scope, standards and procedures, and shall not be used or disguised for the purchase or construction of office buildings and other capital expenditures, personnel expenses, public funds, meeting expenses and other expenditures that should be arranged by the departmental budget, and other expenditures unrelated to the work of employment and re-employment.
Article 4 The special funds for employment are mainly used for subsidies for employment introduction, vocational training subsidies (including entrepreneurial training subsidies), social insurance subsidies, public welfare post subsidies, vocational skills appraisal subsidies, specific employment policy subsidies, support for public **** employment services, small guaranteed loan funds and micro-secured loan subsidies for micro-income projects, the construction of human resources market, the "Certificate of Employment and Unemployment Registration work cost fee, subsidies for street community labor security work agencies to employ people with employment difficulties, and other expenditures applied for by the Provincial Department of Finance and the Provincial Department of Human Resources and Social Affairs*** together and approved by the Provincial People's Government. Employment special funds transferred from the central government can only be used for subsidies for job referrals, subsidies for vocational training (including subsidies for entrepreneurial training), social insurance subsidies, subsidies for public welfare positions, subsidies for vocational skills appraisal, subsidies for specific employment policies, and support for public **** employment services. The transfer of special employment funds for supporting public **** employment services shall be determined by the provincial Department of Finance and the provincial Department of Human Resources and Social Affairs **** in a joint study. All levels of government and departments are not allowed to use the employment special funds transferred from higher levels for the expenditure on the basic construction of the human resources market and the construction of the information network.
Article 5 Employment special funds to strictly implement the financial account management. The financial departments at all levels can only open a special fiscal account in a state-controlled commercial bank for the accounting of employment special funds. Since the date of issuance of this document, all localities shall cancel the employment re-employment funds expenditure account. The financial departments shall, in accordance with the regulations, allocate the funds transferred and subsidized by the higher-level departments, the funds arranged in the budget of the local level, and the funds raised through other channels, to the fiscal special account for employment special funds in a timely manner. Article 6 The people's governments at or above the county level shall, in accordance with the changes in the local employment situation and the needs of the employment work objectives, increase the arrangement of special funds for employment promotion work in the financial budget.

Article 7 The allocation of special transfer funds for employment adheres to the principle of rewarding instead of subsidizing, i.e., it is linked to the financial input (including the guarantee of funds for public **** employment services), employment situation, employment and re-employment tasks, performance, fund management and use of other factors, and the implementation of subsidy targets are issued by sub-division, the funds are disbursed along with the targets, and the end of the year comprehensive assessment and evaluation and annual focus on tracking and inspection. Article 9: All types of employment intermediaries that provide free employment referral services to the "two categories of persons" and successfully find employment, signing a labor contract of more than one year, shall be allocated an employment referral subsidy of 200 yuan per person. When applying for the subsidy for job referral, the employment intermediaries shall calculate the subsidy for job referral as once a year for each person eligible for free service, and shall not repeat the application within the same year.
Article 10: For public **** employment service agencies that are included in the financial subsidies, local finances shall arrange for personnel funds, working funds (including expenditures for equipment purchase, repairs, capital construction, etc.) and project funds based on the actual number of people in their establishment enjoying financial subsidies and in conjunction with the actual workload of the free public **** employment services they have undertaken; the above funds shall be arranged by the finances at the same level in the departmental budgets (including income from service charges paid to the treasury by public *** employment service agencies); public *** employment service agencies that are not included in the financial subsidies may, until the end of 2011, temporarily apply for subsidies for job placement in accordance with the regulations on job placement subsidies for job intermediary agencies. Labor work agencies at all levels stationed abroad with the qualification of employment introduction of labor work management stations (centers, divisions, offices), etc., labor transfer work funds are not included in the same level of the financial budget, can continue to apply for subsidies for employment introduction, the subsidy is implemented until the end of 2011.
The public **** employment service organizations are those set up by the government at or above the county level to provide free employment services for workers in accordance with the provisions of Article 35 of the Law of the People's Republic of China on the Promotion of Employment in the People's Republic of China.
Article 11 The report on the application for subsidies for employment introduction shall be accompanied by: a copy of the Employment Intermediary License, a roster of the persons who have realized employment (including identity card number, home address, Employment and Unemployment Registration Certificate number, employment unit and position, duration of the signed labor contract, and contact telephone number, etc., hereinafter the same), the signature of the person who has accepted the free employment introduction service to confirm the service, a certificate of the free employment introduction service, a copy of the Resident Identity Card", a copy of the "Certificate of Employment and Unemployment Registration", a copy of the labor contract or proof of employment (issued by the Labor Security Supervision Department, hereinafter the same), the employment intermediary agency in the bank to open a basic account and other materials. For the payment of fees to participate in training, training institutions should issue administrative fees (or tax invoices), and indicate the training program, class hours, the names of participants and identity card numbers; for non-payment of fees to participate in training, training institutions should be signed on behalf of its application for vocational training subsidies, the contents of which indicate the training program, class hours, the names of participants and identity card numbers, etc..

Article 15: Training institutions that provide free training shall apply for vocational training subsidies from the local human resources department after the training is completed. Article 16 Employers who recruit "two types of personnel" and sign a labor contract with them for more than six months, and within six months from the date of signing the labor contract, organize the workers to the local human resources and social welfare departments to determine the fixed-point training institutions for vocational training, can be entitled to the vocational training subsidies in accordance with the stipulated standards. Training subsidies for employers are paid first and then subsidized. Before organizing training, the employer shall report to the local human resources and social welfare department and finance department for the record, with specific details including the training project, roster of training participants, duration and method. Within 10 days after the end of the training, the employer shall submit an application to the local human resources and social welfare department. Article 17 For the "two categories of people" to participate in vocational training or entrepreneurship training and obtain a certificate of training, within six months without employment or business start-up, the subsidy is given at 60% of the standard of the vocational training subsidy or entrepreneurship training subsidy; within six months of employment or business start-up, the subsidy is given at 100% of the standard of the vocational training subsidy or entrepreneurship training subsidy, and the subsidy is given at 100% of the standard of the vocational training subsidy or entrepreneurship training subsidy. The subsidy rate for vocational training is 300 yuan per person, and the subsidy rate for entrepreneurship training is 300 yuan per person for "Generate Your Business Idea" (GYB) training, and 300 yuan per person for "Start and Improve Your Business" (SIYB) training. People who are organized by employers to go to training institutions for training and obtain a certificate of vocational training shall be subsidized at the rate of 150 yuan per person, and those who obtain a certificate of vocational skills qualification shall be subsidized at a maximum of 50% of the subsidy standard for the type of work.
Subsidies for the preparatory training of the "two post-graduates" and for skills training in technical colleges for more than one year, as well as subsidies for skills training for not less than three months for migrant workers entering the cities, are implemented in accordance with the relevant regulations.
Article XVIII of the provincial level each year, the central transfer of 10% of the special funds for employment is dedicated to the transfer of rural labor force employment skills training, with a focus on supporting the "two students" to participate in vocational education, such as technical colleges and universities, as well as urban workers not less than three months of skills training. Governments at all levels shall, in accordance with the relevant provisions, increase the strength of training for the transfer of surplus rural labor force for employment, and may arrange the part of the special funds for employment to be used for vocational training subsidies in coordination with the funds for the "Sunshine Project" and the funds for poverty alleviation, etc., and make use of them in accordance with the relevant provisions of the present Measures, so as to avoid duplication and wastage. Unemployed persons with difficulties in employment and college graduates who have registered as unemployed may apply for social insurance subsidies if they are engaged in flexible employment and pay social insurance premiums in their personal capacity. Persons with employment difficulties are recognized in accordance with the provincial government's Circular on Further Improving Employment Promotion (Gan Zheng Fa [2008] No. 56), and the scope of flexible employment is determined in accordance with the Circular on Further Improving Social Insurance Subsidies for Flexible Employment of Unemployed Persons Who Have Been Laid Off (Gan Laoshe Fa [2007] No. 70) issued by the former Provincial Department of Labor and Social Security.
Social insurance subsidies are managed by the method of "paying first and making up later, and withholding the subsidies".
Article 20: The standard of social insurance subsidy for enterprises (units) recruiting persons with difficulties in employment and college graduates registered as unemployed, or arranging for persons with difficulties in employment in public welfare positions, shall be the sum of basic pension insurance premiums, basic medical insurance premiums, and unemployment insurance premiums borne by the enterprise (unit), excluding basic pension insurance premiums, basic medical insurance premiums, and unemployment insurance premiums to be paid by the individual, as well as basic pension insurance premiums, basic medical insurance premiums, and unemployment insurance premiums to be paid by the enterprise (unit). and other social insurance premiums payable by the enterprise (organization) and the individual. The standard of social insurance subsidy for flexibly employed persons is calculated at a rate not exceeding 2/3 of the actual amount of their contributions, and the specific subsidy standard is determined by the finance and human resources and social welfare departments of each city or state.
Article 21 The duration of the social insurance subsidy shall be the same as the duration of the labor contract, with the maximum duration not exceeding 3 years. For employment-difficulty workers holding Employment and Unemployment Registration Certificates who have worked for more than three years and are less than five years away from the legal retirement age (calculated from the date of entitlement to the subsidy, hereinafter the same), the term of social insurance subsidy may be extended to retirement with the approval of the local departments of human resources and social welfare, and finance.
For those who were approved to enjoy social insurance subsidies before the end of 2008 but have not yet expired, they will continue to enjoy social insurance subsidies in accordance with the relevant provisions, and the period of social insurance subsidies will be calculated together, with the cumulative total not exceeding 3 years. However, for people with employment difficulties who are less than five years away from the legal retirement age, the period of social insurance subsidy can be extended to retirement with the approval of the local human resources and social welfare and finance departments.
Article 22 Enterprises (units) shall pay all social insurance premiums in full and on time in accordance with the regulations, and shall list the contributions of persons eligible for social insurance subsidies separately when declaring their contributions. Within 10 working days after the end of each quarter, in accordance with the provisions of the local human resources and social services departments to apply for subsidies on social insurance premiums paid in the previous quarter.
Article 23 The application for social insurance subsidies for public welfare posts by enterprises (units) shall be accompanied by the following materials: proof of employment of persons with employment difficulties or approval form for the recognition of public welfare posts, a detailed roster of persons eligible to enjoy the social insurance subsidies, the Employment and Unemployment Registration Certificate, a copy of the labor contract or proof of employment, and the approved contribution by the social insurance agency for the persons eligible to enjoy the social insurance subsidies for the last quarter by the enterprise (unit). The detailed account (list) and invoice of the contributions made by the enterprise (unit) in the previous quarter for the persons eligible for the social insurance subsidy, the account number of the financial account of the social insurance fund of the coordinating area in which the enterprise (unit) participates, and other documents and materials. Article 26 The maximum standard of subsidy for public welfare posts shall not exceed the local minimum wage. In principle, the working hours of persons with employment difficulties in public welfare posts shall not be less than 96 hours/month, and localities may reasonably determine the working hours or workload according to the characteristics of the post, the working environment, and the personnel situation.
The duration of the subsidy for public welfare posts: the maximum duration is not more than three years, except that it can be extended to retirement for persons with employment difficulties who are less than five years away from the legal retirement age.
Article 27 In the public welfare positions arranged for the employment of difficult-to-employ persons in the unit, the first application for job subsidies need to provide the following materials: by the county level or above the human resources and social services departments and the financial sector *** with the public welfare positions identified by the examination and approval form, the employment of difficult-to-employ persons detailed roster, difficult-to-employ persons, "Resident Identity Card" copy of the employment of difficult-to-employ persons, the original employment and unemployment registration card and copy, labor contracts or Proof of employment, and the basic account of the organization opened in the bank. The human resources and social services department will review and keep the documents on file, and the financial department will transfer the subsidized funds directly into the basic account of the unit in the bank after reviewing the documents. At the end of each quarter, the unit must provide a roster of the increase or decrease in the number of persons with employment difficulties and a roster of signatures for receiving job subsidies. Article 28 provides a one-time subsidy for the cost of vocational training and initial skills appraisal (limited to the designated types of work for which the employment access system has been implemented) for people with employment difficulties and rural migrant workers holding Employment and Unemployment Registration Certificates.
The standard of subsidy for vocational skills appraisal does not exceed 300 yuan per person. If the standard of the vocational skills appraisal fee is higher than 300 yuan, the appraisal organization will reduce the fee by 300 yuan, and if the standard of the appraisal fee is lower than 300 yuan, the appraisal fee will no longer be charged.
Article 29 The vocational skills appraisal institutions to apply for vocational skills appraisal subsidies, can be based on the actual reduction of fees at the end of each quarter to the department of human resources and social services to submit an application. Article 30 The finance above the county level can arrange to support the public **** employment service funds, the lower level of the public **** employment service organizations used to strengthen its human resources market information network expenditures (specifically including computer and network hardware, software acquisition, development and application expenditures, etc.) to give the necessary support. The provincial finance according to the actual needs of the annual arrangement to support the public *** employment services special funds, to take the project management, focusing on subsidies to some cities and counties, used to support the construction of human resources market information network.
Article 31 The funds for supporting public **** employment services as part of the special funds for employment must be arranged separately, accounted for separately, managed separately, and shall not be transferred with other special funds for employment. Expenditures at all levels of finance for supporting public **** employment services shall be expended in accordance with the relevant provisions of the Government's revenue and expenditure classification accounts. Article 32 The current specific employment support policy refers to the approval of the provincial government, the municipal and state governments for the state-owned enterprises in difficulty "4050" laid-off workers to pay social insurance premiums and retired staff living expenses subsidies.
Article 33 of the social insurance subsidy policy in accordance with the Provincial Department of Finance, the former Provincial Department of Labor and Security, the provincial government, the State-owned Assets Supervision and Administration Commission "on the issuance of laid-off workers out of the center of Gansu Province, the definition of difficult enterprises and the management of financial subsidies, notice" (Gan CaiShe 〔2005〕 No. 163) the document provisions of the implementation. (2) After the end of the year, the department of human resources and social affairs shall do a good job of cleaning up and reconciling the special funds for employment, and submit the annual accounts and explanations of the special funds for employment to the finance department at the same level as required. The finance department shall report the annual final accounts of the employment special funds to the higher level finance department in a timely manner after the audit and summary of the annual final accounts of the employment special funds.
(3) If there is a balance at the end of the year of the employment special fund, it is necessary to explain the reasons in detail, and after approval, it will be transferred to the next year for further use in accordance with the regulations.
Article 35 The local finance and human resources departments shall further establish and improve financial management rules and regulations, strengthen internal financial management
management, and consciously accept the supervision and inspection of the monitoring and auditing departments and the society. The units and individuals who falsely report, seize, privately share or misappropriate various subsidized funds shall be seriously dealt with according to the regulations. For lax auditing, irregular operation, the relevant departments and units shall be held accountable in accordance with the relevant provisions.
Article 36 Each region shall, in accordance with the principles of openness, fairness and impartiality, for the community at all levels and types of training institutions, through bidding to determine the vocational training institutions to undertake training tasks. Establishment of vocational training institutions dynamic management mechanism and exit mechanism to strengthen the supervision and management of vocational training institutions.
Article 37 Each region shall gradually establish and improve the human resources information network system, the realization of public **** employment service agencies at all levels of information networking, for job seekers, employers to provide convenient and efficient information services; to strengthen the supervision of job intermediaries, vocational training institutions, public **** employment service agencies and employers. The finance and human resources departments at and above the county level shall regularly supervise and inspect all types of employment agencies, vocational training institutions, public **** employment service organizations and employers, and shall conduct assessments and evaluations of free employment agencies, vocational training, public **** employment services and employment, and disclose the relevant information to the public for social supervision. Employment agencies, vocational training institutions, public **** employment services and employing units that engage in fraudulent practices to obtain subsidies for employment services shall be disqualified from the relevant qualifications and the parties concerned shall be held accountable. Article 38 The specific management of the micro-guaranteed loan guarantee fund and the micro-guaranteed loan interest subsidy fund for micro-profit projects shall be implemented in accordance with the relevant provisions.
Article 39 The employment and re-employment of laid-off unemployed persons in central and provincial enterprises shall be incorporated into the employment and re-employment planning of the government where the enterprise is located in accordance with the principle of territorial management.
