Regulations of Baotou Municipality on River Management

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Water Law of People's Republic of China (PRC), the Flood Control Law of People's Republic of China (PRC) and the Regulation of People's Republic of China (PRC) on River Management, in combination with the actual situation of this Municipality, in order to strengthen the management of river courses, ensure the safety of flood control and maintain the functions of river courses. Article 2 These Regulations shall apply to the regulation, protection, supervision and management of river courses (including dikes, flood discharge areas, lakes, flood storage and detention areas and artificial waterways) within the administrative area of this Municipality. Article 3 The principles of overall planning, comprehensive improvement, strict protection, classified management, graded responsibility and obedience to flood control shall be implemented in river management in this Municipality. Article 4 The water department of the Municipal People's Government is the competent department of rivers in the whole city, responsible for the supervision and management of rivers in the whole city, and may entrust the supervision and management institution established by it to be responsible for the specific supervision and management work.

The water department of Qixian District People's Government is the competent department of river courses within its administrative area, responsible for river courses management within its administrative area according to its management authority, and subject to the guidance and supervision of the municipal competent department of river courses.

Baotou Rare Earth Hi-tech Industrial Development Zone Management Committee is responsible for river management within its jurisdiction in accordance with the provisions of the Municipal People's Government.

The administrative departments in charge of development and reform, finance, planning, land and resources, urban and rural construction, transportation, agriculture and animal husbandry, forestry, environmental protection, and the management institutions of Daqingshan Nature Reserve shall, according to their respective functions and duties, do a good job in river management. Fifth river management, regulation and dike maintenance funds in accordance with the principle of graded responsibility, by the municipal and county people's governments into the fiscal year budget at the same level. Article 6 The people's governments of cities and counties, their river departments, township people's governments and sub-district offices shall strengthen the publicity and education of river management laws and regulations, popularize relevant knowledge of river protection, guide social organizations and citizens to consciously abide by river management laws and regulations, and raise their awareness of flood control. Chapter II River Regulation Article 7 The river administrative department shall, according to the needs of economic and social development and flood control safety, formulate river regulation and construction plans and annual plans, and organize their implementation after being submitted to the people's government at the same level for examination and approval. Article 8 River regulation shall conform to the flood control standards and other relevant technical requirements stipulated by the state and the autonomous region.

River regulation measures mainly include the construction and maintenance of dikes, dangerous works, revetments, culverts, dredging, pollution interception, widening and other projects. Ninth river regulation projects in line with the provisions of the state and the autonomous region of the scope and standards of construction project bidding, bidding should be carried out according to law. Tenth river regulation project shall prepare the project construction plan, and report it to the competent department of river for examination and approval in accordance with the river management authority, and the construction unit may go through the examination and approval procedures in accordance with the basic construction procedures.

When the river is built into a landscape river regulation project, experts should be organized in advance to demonstrate and evaluate flood control, and the project construction plan should be reported to the municipal river department for approval.

The construction scheme of river regulation project shall include regulation objectives, specific regulation measures, completion time and safeguard measures. Eleventh river regulation projects should be carried out in strict accordance with the approved project construction plan. The river administrative department shall supervise and inspect the implementation of the project construction scheme and the construction quality. Twelfth survey, design, construction and supervision units and personnel of river regulation projects shall have corresponding qualifications and professional qualifications, and abide by the relevant technical norms and standards of the state and the autonomous region. Thirteenth river sand mining license system, management in accordance with the principles of scientific planning, rational layout, certified sand mining, total control. Sand excavation in rivers should be combined with river regulation planning, dredging rivers, widening flood discharge sections, eliminating hidden dangers of flood discharge and ensuring flood discharge safety. Chapter III Protection of Rivers Article 14 Rivers in this Municipality are divided into major rivers and general rivers.

The municipal river administrative department shall, jointly with the relevant administrative departments, regularly investigate and evaluate the main rivers, compile a list of rivers, specify the names of the main rivers and their starting and ending boundaries, and report to the Municipal People's Government for approval. Fifteenth river management scope shall be delineated in accordance with the following provisions:

(1) Rivers with dikes refer to the waters, beaches, flood discharge areas, dikes, flood control passages and berms between the two banks of the Yellow River (berms of the first-class tributaries of the Yellow River, such as Hadimengou, Kundulun River, Sidao Shahe, Erdao Shahe, Donghe River, Wudanggou, Shuijiangou and Meidaigou). , which means that the slopes on both sides of the dike are 30 meters outward, and the berms of other rivers are 30 meters outward.

(2) Rivers without dikes shall be determined according to the historical highest flood level or planned flood level.

The river section with dikes shall delimit the scope of protection in accordance with the following provisions:

(a) thirty meters outside the scope of management of the first-class tributaries of the Yellow River;

(two) other river management scope beyond twenty meters. Article 16 The specific management scope and protection scope of major rivers shall be determined by the municipal river administrative department in accordance with the relevant provisions of the state, autonomous regions and these Regulations, jointly with the relevant administrative departments and the county and district people's governments, and announced to the public together with the river directory after examination and approval by the municipal people's government.

Where the scope of management and protection of major rivers changes, relevant procedures shall be performed in accordance with the provisions of the preceding paragraph. Seventeenth main river management scope and protection scope should be set up boundary markers.

No unit or individual may move or damage boundary markers without authorization.
