Special operators safety technology training and assessment management regulations

Chapter I General Provisions
Article 1 In order to standardize the work of the safety and technical training and assessment of the special operators, to improve the safety and technical level of the special operators, and to prevent and reduce the number of casualties and injuries, in accordance with the "Work Safety Law", the Administrative License Law" and other relevant laws and administrative regulations, the formulation of these provisions.
Second, the production and management units of special operators of safety technology training, assessment, certification, review and supervision and management work, the application of these provisions.
Related laws, administrative regulations and the State Council on the management of special operators otherwise provided, from its provisions.
Article 3 The special operations referred to in these provisions, is prone to accidents, the operator himself, the safety and health of others and the safety of equipment and facilities may cause significant harm to the operation. The scope of special operations by the special operations catalog.
Special operations personnel referred to in these provisions, refers to the practitioners directly engaged in special operations.
Article 4 special operators shall meet the following conditions:
(1) 18 years of age, and not more than the national legal retirement age;
(2) by the community or county-level or above, medical examination of health, and does not prevent to engage in the corresponding special operations of organic heart disease, epilepsy, Meniere's disease, vertigo, dystonia, dysthymia, tremor paralysis, Psychosis, dementia and other diseases and physiological defects;
(c) with junior high school and above;
(d) have the necessary technical knowledge and skills of safety;
(e) the corresponding special operations of other conditions.
Hazardous chemicals special operators in addition to the first, second, fourth and fifth paragraph of the preceding conditions, should have a high school or the equivalent of high school and above.
Article 5 special operators must be specialized safety technology training and assessment of qualified, and obtain the "People's Republic of China *** and the country's special operations license" (hereinafter referred to as the special operations license), before they can work on the job.

Article 7 The State Administration of Work Safety (hereinafter referred to as the General Administration of Work Safety) to guide and supervise the national special operators of safety training, assessment, certification, review work; provincial, autonomous regions, municipalities directly under the Central People's Government of Work Safety Supervision and Administration Department to guide and supervise the administrative region of special operators of safety training, is responsible for the administrative region of special operators of the assessment, certification, review work. The State Coal Mine Safety Supervision Bureau (hereinafter referred to as the Bureau of Coal Mine Safety) guides and supervises the safety technical training, examination, licensing and review work of the special operators of coal mines across the country (including the operators of special equipment used in coal mines); the departments responsible for the examination and licensing of special operators of coal mines in the people's governments of provinces, autonomous regions and municipalities directly under the central government or the designated organizations guide and supervise the safety technical training work of special operators of coal mines in their own administrative regions. Chapter II training
Article IX special operators should be engaged in special operations corresponding to their safety technology theory and practical training.
Have obtained a vocational high school, technical school and junior college graduates engaged in special operations corresponding to their specialties, with proof of education by the assessment of the licensing authority agreed to be exempted from the relevant professional training.
Trans-provincial, autonomous regions, municipalities directly under the Central Government to work in the special operators, can be in the place of domicile or place of employment to participate in training.
Article X of the special operators of safety training, with safety training conditions of the production and management units should be based on independent training, but also can be entrusted with the safety training conditions of the organization for training.

Production and management units entrusted to other organizations for special operators safety training, to ensure that the responsibility for safety training is still responsible for the unit.
Article 11 of the institutions engaged in special operators safety training (hereinafter collectively referred to as training institutions), shall develop appropriate training programs, teaching arrangements, and in accordance with the General Administration of Safety Supervision, the Coal Mine Safety Supervision Bureau of the development of the special operators training syllabus and the coal mine special operators training syllabus of the special operators of the safety and technical training.
Chapter III Examination and Certification
Article 12 The examination of special operators includes two parts: examination and audit. Examination by the examination and licensing authority or its entrusted unit responsible; audit by the examination and licensing authority.
The General Administration of Safety Supervision, the Coal Mine Safety Supervision Bureau to develop special operators, coal mine special operators, respectively, the assessment standards, and the establishment of the corresponding examination question bank.
The assessment of the licensing authority or its commissioned units should be in accordance with the General Administration of Safety Supervision, the Coal Mine Safety Supervision Bureau uniformly formulated assessment standards for the assessment.
Article XIII to participate in the qualification examination of special operations personnel, should fill out the application form for the examination by the applicant or the applicant's employer with proof of academic qualifications or training certificate issued by the training institution to the applicant's domicile or practice in the location of the assessment of the licensing authority or its commissioned unit to apply.
The examination and licensing authority or its commissioned unit after receiving the application, should be organized within 60 days of the examination.
Special operation qualification examination, including safety and technical theory examination and practical operation of the two parts of the examination. Failed the examination, allowing a remedial examination. Failed by the remedial examination, to participate in the corresponding safety technology training.
Article XIV of the examination and licensing authorities commissioned to undertake special operations qualification examination unit should have the appropriate premises, facilities, equipment and other conditions, the establishment of the appropriate management system, and publish fees and other information.
Article XV of the examination and licensing authorities or its commissioned to undertake special operations qualification examination unit shall be published within 10 working days after the end of the examination results.
Article XVI meets the provisions of Article 4 of these regulations and passed the examination of special operators, shall apply for a special operations license to the examination and licensing authorities in the place of their domicile or place of practice, and submit a copy of the identity card, a copy of the academic certificate, physical examination certificate, proof of passing the examination and other materials.
Article XVII of the application received by the examination and licensing authorities shall be completed within five working days of the special operators to submit application materials for review, to make the decision of acceptance or inadmissibility. Acceptance decision can be made on the spot, should be made on the spot acceptance decision; application materials are incomplete or do not meet the requirements, should be on the spot or within five working days to inform the applicant of all the contents of the need to make corrections, and not informed of the late, deemed to be accepted since the date of receipt of the application materials have been accepted.
Article XVIII of the application has been accepted, the examination and licensing authority shall complete the audit within 20 working days. Meet the conditions, the issuance of special operations license; does not meet the conditions, shall state the reasons.
Article 19 of the special operations license is valid for six years, valid throughout the country.
