Chapter 1 General Provisions

Article 1. In order to regulate the fundraising and acceptance of donations by the Red Cross Society of China, in accordance with the "Red Cross Society Law of the People's Republic of China" and the "Red Cross Society of China These Measures are formulated in the spirit of laws and documents such as the Charity Law of the People's Republic of China, the Public Welfare Donation Law of the People's Republic of China, and the Opinions of the State Council on Promoting the Development of the Red Cross.

Article 2 The National Red Cross Society of China (hereinafter referred to as the "General Conference") guides local Red Cross societies and industry Red Cross societies in their fundraising and acceptance of donations.

Article 3 Local Red Cross societies and industry Red Cross societies should strengthen the management of fundraising and donation acceptance, and standardize the behavior of fundraising and donation acceptance.

Article 4: Local Red Cross societies may authorize grassroots Red Cross organizations to assist in fundraising and accepting donations. Units and individuals other than the Red Cross may not raise funds or accept donations in the name of the Red Cross without the authorization of the Red Cross at or above the county level.

Article 5 Red Cross societies at all levels shall carry out fundraising and accept donations and accept the supervision of the civil affairs department at the same level in accordance with the law.

Article 6 Red Cross societies at all levels shall strictly abide by the "Red Cross Law of the People's Republic of China" and the "Red Cross Emblem of the People's Republic of China" when conducting fundraising and accepting donations. Regulations on the use of the Red Cross emblem and name and other laws and regulations such as "Usage Regulations" shall not violate the basic principles of the International Red Cross Movement or damage the reputation of the Red Cross Society.

Chapter 2 Fundraising

Article 7 The fundraising activities carried out by the Red Cross at all levels in accordance with the law include public fundraising for the public and targeted fundraising for specific targets.

Article 8 Red Cross societies at all levels must carry out public fund-raising in accordance with the relevant requirements of the Ministry of Civil Affairs and the "Notice on Issues Concerning the Red Cross' Public Fund-raising" issued by the Red Cross Society of China.

Article 9 When Red Cross societies at all levels carry out public fundraising activities that involve matters such as public security, public order, fire protection, etc., they shall perform approval procedures in accordance with relevant regulations.

Article 10 Red Cross societies at all levels may adopt the following methods to conduct public fundraising:

(1) Set up donation boxes in public places;

(2) Hold charity performances, charity matches, charity sales, charity exhibitions, charity auctions, charity evenings, etc. for the public;

(3) Publish fundraising information through radio, television, newspapers, Internet and other media;

(4) Other public fundraising methods.

Article 11 If public fundraising activities are carried out through the Internet, the public fundraising information should be published on the information platform unified or designated by the Ministry of Civil Affairs, and at the same time, the official website of the Red Cross, Weibo, WeChat, mobile Clients and other online platforms publish public fundraising information.

Article 12 If the Red Cross Societies at all levels cooperate with organizations or individuals that do not have public fundraising qualifications to carry out public fundraising activities, they shall sign a written cooperation agreement in accordance with the law, and all revenue and expenditures from donations shall be included in the Red Cross Society Donation accounts are subject to unified financial accounting and management.

Article 13 Red Cross societies at all levels may accept direct donations from units and individuals outside the country (territory) and outside their jurisdiction. Local Red Cross societies shall not receive donations without the authorization of the federation or the superior Red Cross society. Conduct public fundraising outside the country (territory) and jurisdiction.

Article 14 The General Conference shall decide whether to issue an appeal for donations internationally and domestically based on the occurrence of major natural disasters and other public emergencies. Local Red Cross societies and industry Red Cross societies are not allowed to directly issue fund-raising appeals outside their jurisdiction or industry without approval from the General Conference.

Chapter 3 Accepting Donations

Article 15 Red Cross societies at all levels should open special bank accounts and establish special accounts for management when accepting donations.

Article 16 Donated property accepted by the Red Cross shall be legal property that the donor has the right to dispose of. Donated properties include tangible and intangible properties such as currency, physical objects, houses, securities, equity, and intellectual property rights.

Donated objects must have practical value and meet safety, health, environmental protection and other standards.

Article 17 When accepting donations, the Red Cross may, based on the actual situation, sign a donation agreement with the donor, or ask the donor to issue a donation letter to agree on the type, quantity, purpose, and delivery time of the donated property. etc. content. Donors may not designate their interested parties as beneficiaries.

Article 18 After accepting a donation, the Red Cross shall promptly issue to the donor a donation receipt supervised (printed) by the financial department. If the donor remains anonymous or gives up the donation receipt, relevant records should be kept.

Article 19 The non-monetary assets donated by the Red Cross shall be converted into RMB at their fair value, and the donor shall provide legal and valid proof of their fair value.

Article 20 For overseas (overseas) donated materials accepted by the Federation, the transportation and other expenses after arriving at the port are generally borne by the Red Cross Society in the recipient area; the freight for domestic donated materials is generally borne by The donation is borne by the donor or performed in accordance with the donation agreement. Inspection, quarantine, tax exemption and entry procedures for donated materials from abroad (overseas) shall be handled uniformly by the Federation or relevant provincial Red Cross societies in accordance with relevant national regulations.

Chapter 4 Donation Management

Article 21 Red Cross societies at all levels shall establish systems for financial management, internal control, audit disclosure, supervision and inspection of donated property, and regulate donations. Management and use of property.

Article 22 The Red Cross shall dispose of the donated property in accordance with the donation plan, donation agreement or the donor’s wishes, and use it for humanitarian relief work that is consistent with the purpose of the Red Cross.

Article 23 The Red Cross shall not change the use of donated property without violating the donation plan, donation agreement or the donor’s wishes. If the use really needs to be changed, the donor’s written consent must be obtained. For donated property without specific donation intention, the Red Cross can make overall arrangements for use according to its purpose and humanitarian needs, and its use should be reported to the donor in a timely manner.

Article 24 Humanitarian public welfare projects carried out using donated property should generally be organized and implemented by the Red Cross system; under special circumstances, other legally qualified social institutions may also be entrusted with the specific implementation.

Article 25 The actual costs incurred by the Red Cross when using donated funds to carry out humanitarian relief work can be expensed from the donated funds and disclosed to the public. The actual costs to be deducted from donated funds should be clearly stated in advance to the donor through donation agreements or fundraising announcements when accepting donations, and the amount and scope of use should be strictly limited. The actual costs mainly include the remuneration of project personnel, volunteer subsidies and insurance, related expenses for the use of houses, equipment, and materials, and expenses for travel, logistics, transportation, meetings, training, audits, evaluations, etc. incurred to manage the project. Donated funds shall not be used for the expenditure of the institution and its staff.

Article 26 The management of income and expenditure of donated property shall be audited by audit institutions and supervised by the civil affairs department, and reported to the Red Cross Board of Directors and the Board of Supervisors.

Article 27 The Red Cross shall strictly abide by relevant national regulations and actively maintain and increase the value of donated property in accordance with the principles of legality, safety and effectiveness.

Chapter 5 Information Disclosure

Article 28 Red Cross societies at all levels should establish and improve information disclosure systems, standardize information release, and promptly announce donations to the public on a unified information platform The income and use of money and property shall be subject to social supervision.

Article 29 The Red Cross shall publish an audited donation income and expenditure report to the public every year.

Article 30 The Red Cross shall regularly disclose its fundraising status and project implementation status to the public. If the public fundraising cycle exceeds six months, the fundraising status should be disclosed at least every three months, and the fundraising status should be fully disclosed within three months after the end of the public fundraising activity. If the implementation period of the donation project exceeds six months, the project implementation status should be disclosed at least every three months. The project implementation status and the use of funds raised should be fully disclosed within three months after the end of the project.

Article 31 When the Red Cross carries out targeted fundraising, it shall promptly inform donors of the fundraising situation and the management and use of the funds and materials raised.

Article 32 When the Red Cross uses donated property to carry out humanitarian relief, it shall adopt appropriate methods to inform recipients of funding standards, funding procedures and other relevant information.

Article 33 Information involving state secrets, business secrets, personal privacy, and information such as the name, title, address, communication method, etc. that donors and trustees of charitable trusts do not agree to disclose shall not be disclosed.

Chapter 6 Donation Recognition

Article 34 The General Conference will commend donors who have made a one-time donation of more than 1 million yuan in accordance with the following standards:

(1) Donors who make a one-time donation of more than 1 million yuan and less than 5 million yuan will be awarded the "China Red Cross Dedication Medal" and a donation certificate signed by the president of the Red Cross Society of China;

(2) Donors who make a one-time donation of more than 5 million yuan and less than 10 million yuan will be awarded the "China Red Cross Fraternity Medal" and a donation certificate signed by the president of the Red Cross Society of China;

(3) Donors who make a one-time donation of more than RMB 10 million will be awarded the "China Red Cross Humanity Medal", and a donation certificate and "Charity" plaque signed by the President of the Red Cross Society of China will be issued.

Article 35: Cash donations and non-monetary donations of less than 1 million yuan will not be commended uniformly by the Federation. Each locality can formulate corresponding commendation methods based on actual conditions.

Article 36 The General Conference will commend donors once a year. All provincial Red Cross societies should summarize and submit information such as the name of the donor, donation amount, donation time, and the recipient Red Cross society before December 30 of each year to the general fund-raising and finance department to apply for the corresponding medals, donation certificates and "Fraternity" plaque.

Article 37 Donors who donate to Red Cross causes through Red Cross societies at or above the county level shall enjoy corresponding preferential tax policies in accordance with the law.

Chapter 7 Supplementary Provisions

Article 38 The Chinese Red Cross Foundation and local Red Cross foundations carry out fundraising and acceptance of donations in accordance with the "People's Revolution of the People's Republic of China and the National The Charity Law, the State Council's "Foundation Management Regulations" and other provisions shall be implemented with reference to these Measures.

Article 39 The Red Cross Society of China is responsible for the interpretation of these Measures.

Article 40 These Measures shall come into effect after being adopted by the Fourth Meeting of the Tenth Council of the Red Cross Society of China. The "Regulations on the Fund-raising and Acceptance of Donations by the Red Cross Society of China" (Hongbanzi [2009] No. 124) and the "Measures for Donor Recognition and Rewards of the Red Cross Society of China" (Hongbanzi [2007] No. 67) were abolished at the same time.
