What to do if something sent from abroad is detained by customs

Article 85 of the Customs Law stipulates that individuals who carry or mail more than a reasonable amount of articles for their own use into or out of the country, and fail to declare them to the Customs in accordance with the law, shall be ordered to pay the customs duty in addition, and may be sentenced to a fine.

Article 6 of the Customs Law stipulates that, outside the customs supervision area and the coastal and border areas near the Customs, the Customs, when investigating smuggling cases, the means of transportation suspected of smuggling and places suspected of harboring smuggled goods and articles other than citizens' residences, may be inspected with the approval of the Customs Commissioner directly under the Customs or the Customs Commissioner of the subordinate Customs authorized by the Customs Commissioner and the party concerned shall be present; if the party concerned fails to be present, a witness shall be summoned to the Customs Office for inspection and the Customs Office shall notify him/her in writing. The parties concerned shall be present; the parties concerned are not present, in the presence of witnesses, may proceed with the inspection; of which there is evidence of smuggling suspected means of transportation, goods, articles, may be detained.

Article 82 of the Customs Law stipulates that, in violation of this Law and relevant laws and administrative regulations, to evade customs supervision, evasion of taxes due, evasion of the state's prohibited or restricted management of entry and exit of one of the following circumstances, is smuggling: (a) transportation, carrying, mailing the state prohibits or restricts the entry and exit of goods, goods, or should be required to pay taxes. The entry and exit of goods, articles ; (b) without Customs permission and not pay the tax due, the inspection of the relevant licenses, unauthorized bonded goods, specific tax exemption or reduction of goods, as well as other Customs-supervised goods, articles, imported means of transport outside the territory of the sale of; (c) there is to avoid Customs supervision, constituting smuggling of other acts.

One of the acts listed in the preceding paragraph, does not constitute a crime, the Customs confiscate the smuggled goods, articles and illegal income, and may impose a fine; specifically or repeatedly used to cover the smuggling of goods, articles, specifically or repeatedly used for smuggling means of transport, shall be confiscated, and hiding smuggled goods, articles of special equipment, shall be ordered to dismantle or confiscated.

According to the above provisions, if the goods seized by the Customs belong to the personal mail more than a reasonable number of articles for personal use to enter or leave the country, you can pay the customs duty according to the law, and after the payment of customs duty and payment of fines (if the Customs made a decision on fines), you can have normal customs clearance.

If the goods belong to other smuggled goods, the Customs and Excise Department has the right to confiscate the smuggled goods, goods and illegal demand for the enemy, and may impose a fine. Constitutes a crime, according to the law to investigate criminal responsibility.
