Article 6 The principal person in charge of an enterprise shall perform the following duties:
(1) to establish and improve the responsibility system for production safety in the enterprise;
(2) to organize and formulate the rules and regulations of production safety in the enterprise and the operating procedures;
(3) to ensure effective implementation of the investment in production safety in the enterprise;
(4) to preside over the study of production safety on a regular basis. (d) regularly preside over the study of production safety, and report on production safety to the staff congress and shareholders' meeting;

Article 7 Enterprises in the transfer of property rights shall sign a special production safety management agreement or in the contract of change of property rights to agree on matters related to production safety management.

Article 8 Enterprises contracting or leasing out production and business projects, premises and equipment shall sign a special production safety management agreement with the contracting unit or the leasing unit or agree on the relevant production safety management matters in the contracting or leasing contract.
Failure to sign a production safety management agreement or failure to agree on production safety management matters, the occurrence of production safety accidents, the contracting or leasing unit to bear the corresponding consequences. Article 9 Enterprises shall establish and improve the unit of production safety responsibility system, the implementation of full production safety responsibility assessment, and clarify the positions of the responsible personnel, the content of responsibility, and the assessment of rewards and punishments and other matters.

(xiv) production safety accident reporting and investigation system;
(xv) emergency plan management and exercise system;
(xvi) other rules and regulations to ensure production safety.
Article XI of the enterprise shall ensure the implementation of production safety rules and regulations, and according to the actual situation of timely revision and improvement, and educate employees to master and strictly abide by. Article 15 Enterprises shall support the production safety management organization and production safety management personnel to perform their duties in production safety management and ensure the necessary conditions for them to carry out their work. Full-time production safety management personnel should be treated higher than the same level of the same job managers of other positions. Article XVI of the enterprise should be developed at the beginning of the year production safety education and training plan, and according to the plan to organize and implement. The main person in charge of high-risk production and management units and production safety management personnel shall be qualified by the relevant departments of their production safety knowledge and management capacity assessment before taking office. Article 20 The main person in charge of the enterprise and production safety management personnel initial safety training time shall not be less than 32 hours, and annual retraining time shall not be less than 12 hours. High-risk production and management units in charge of the main production and safety management personnel safety qualification training time shall not be less than 48 hours, annual retraining time shall not be less than 16 hours.
Enterprises newly employed (including the transfer of jobs, away from work for more than six months to return to their original jobs or the use of new processes, new technologies, new materials, new equipment, the relevant practitioners), the initial training time shall not be less than 24 hours, the annual retraining time shall not be less than 8 hours. High-risk production and management units should be mandatory safety training for new employees, safety training time shall not be less than 72 hours, annual retraining time shall not be less than 20 hours. Article 21 The enterprise shall ensure that the unit has the necessary capital investment in production safety conditions, production safety investment should be included in the unit's annual budget.
High-risk production and operation units and road transportation production and operation units should be in accordance with relevant state regulations, the extraction and use of production safety costs. Article 22 of the high-risk production and operation units and road transportation production and operation units shall, in accordance with the relevant provisions of the storage and use of production safety risk collateral or purchase of production safety liability insurance.
Article 23 Enterprises shall participate in work injury insurance in accordance with the law, and pay insurance premiums for employees.? Article 24 Enterprises shall strictly implement the construction project safety facilities "three simultaneous" provisions. Construction project safety facilities "three simultaneous" shall meet the following requirements:
(a) construction project design unit in the preparation of project design documents, should be prepared at the same time the design of safety facilities;

Article 29 Enterprises shall carry out maintenance and repair of safety facilities and equipment in accordance with the regulations, and regular testing to ensure the normal operation of safety facilities and equipment. Article 43 The enterprise shall strengthen the production safety publicity and education, and constantly improve the safety awareness of employees. Article 44 The enterprise shall carry out activities to create a culture of safety, adhere to the people-oriented, put production safety in the first place, and actively explore effective management methods and ways to create a strong safety culture, and improve the safety awareness of the whole staff and emergency response capabilities.
Article 45 Enterprises shall accept the supervision of labor unions, create the necessary conditions for labor unions to safeguard the lawful rights and interests of workers in accordance with the law, and shall seriously study and resolve the relevant opinions and suggestions put forward by labor unions.
Article 46 Enterprises shall establish incentives and constraints on production safety mechanism, grade by grade, level by level, position by position with the employees to sign a certificate of responsibility for production safety. Article 52 The enterprise in the event of a production safety accident shall, in accordance with the law, properly deal with the aftermath of the accident, and pay compensation to casualties in accordance with the provisions of the compensation. Article 60 of the schools, hospitals and other public welfare units engaged in production and business activities in the implementation of the main responsibility for production safety, this provision shall apply.
Article 61 Where laws, regulations and rules provide otherwise on the main responsibility of enterprises for production safety, the provisions thereof shall apply.
Article 62 These provisions shall be implemented from the date of issuance.
