Article 2: These Measures apply to the application, approval and related supervision and management activities for waste electrical and electronic product processing qualifications.
The term "Waste Electrical and Electronic Products" as mentioned in these Measures refers to the products listed in the "Waste Electrical and Electronic Products Disposal Catalog" issued by the National Development and Reform Commission, the Ministry of Environmental Protection, and the Ministry of Industry and Information Technology.
Article 3: The state implements a centralized processing system for waste electrical and electronic products and encourages the large-scale, industrialized and professional development of the treatment of waste electrical and electronic products.
The environmental protection department of the provincial people's government shall, together with the relevant departments of the people's government at the same level, prepare a development plan for the treatment of waste electrical and electronic products in the region and submit it to the Ministry of Environmental Protection for filing.
The preparation of the development plan for the treatment of waste electrical and electronic products should be based on the requirements for centralized treatment and the rational layout of waste electrical and electronic product processing enterprises.
The development plan for the treatment of waste electrical and electronic products should be revised every five years based on the local economic and social development, industrial structure, changes in treatment enterprises and other relevant conditions.
Article 4: The disposal of waste electrical and electronic products shall comply with national requirements for comprehensive utilization of resources, environmental protection, labor safety and protection of human health.
It is prohibited to use technologies and processes that have been explicitly eliminated by the state to treat waste electrical and electronic products.
Article 5: The environmental protection departments of people's governments at the districted municipal level shall be responsible for licensing the qualifications for the disposal of waste electrical and electronic products in accordance with the provisions of these Measures.
Article 6: The environmental protection departments of the people's governments at or above the county level shall be responsible for the supervision and management of the disposal of waste electrical and electronic products in accordance with the "Regulations on the Management of Recycling and Disposal of Waste Electrical and Electronic Products" and the relevant provisions of these Measures.
Chapter 2 Licensing Conditions and Procedures
Article 7 Enterprises applying for qualifications to dispose of waste electrical and electronic products shall be established in accordance with the law and comply with the requirements of the region’s development plan for the treatment of waste electrical and electronic products. It has the legal person qualification of a general taxpayer of value-added tax and meets the following conditions:
(1) It has waste electrical and electronic product processing workshops and sites, storage sites, dismantling and processing equipment that are suitable for its application processing capabilities; Supporting data information management systems, pollution prevention and control facilities, etc.;
(2) Having sorting and packaging equipment as well as transportation vehicles, handling equipment, compression and packaging equipment that are suitable for the waste electrical and electronic products processed, Special containers and central monitoring equipment, metering equipment, accident emergency rescue and processing equipment, etc.;
(3) Having sound environmental management systems and measures, including the proper utilization of waste electrical and electronic products that cannot be completely processed Or disposal plans, preventive measures and emergency plans for environmental emergencies;
(4) Professional and technical personnel with relevant safety, quality and environmental protection.
Article 8: Enterprises applying for qualifications to process waste electrical and electronic products shall submit a written application to the environmental protection department of the municipal people's government where the waste electrical and electronic product processing facilities are located, and provide relevant supporting materials.
Article 9: The environmental protection department of the people's government of a districted city shall publicize the relevant information of the application and solicit public opinions within 3 working days from the date of acceptance of the application. The publicity period shall not be less than 10 working days.
The environmental protection department that accepts the application shall verify the public opinions.
Article 10: The environmental protection department of the districted municipal people’s government shall review the materials submitted by the enterprise within 60 days from the date of acceptance of the application and organize on-site verification. For those who meet the conditions, a qualification certificate for the disposal of waste electrical and electronic products will be issued and announced; for those who do not meet the conditions, the applicant will be notified in writing and the reasons will be explained.
Article 11 The qualification certificate for the disposal of waste electrical and electronic products includes the following main contents:
(1) Legal person’s name, legal representative, and domicile;
( 2) Address of the treatment facility;
(3) Category of waste electrical and electronic products processed;
(4) Main treatment facilities, equipment and operating parameters;
(5) Processing capacity;
(6) Validity period;
(7) Issuance date and certificate number.
The format of the qualification certificate for the disposal of waste electrical and electronic products is uniformly stipulated by the Ministry of Environmental Protection.
Article 12 If an enterprise that handles waste electrical and electronic products changes its legal person name, legal representative or domicile, it shall apply to the original licensing authority for processing waste electrical appliances within 15 working days from the date of change of industrial and commercial registration. Article 13 If any of the following circumstances occurs, the waste electrical and electronic product processing enterprise shall re-apply for the qualification to process waste electrical and electronic products in accordance with the original application procedures:

(3) Renovation or expansion of original treatment facilities;
( 4) The processing capacity of waste electrical and electronic products exceeds the processing capacity determined by the qualification certificate by more than 20%.
Article 14 After the development plan for the treatment of waste electrical and electronic products is revised, the original issuing authority shall, based on the economic and social development of the region, changes in the market for the treatment of waste electrical and electronic products, etc. Enterprises engaged in electronic product processing activities will be reviewed, and if they meet the conditions, a qualification certificate for the processing of waste electrical and electronic products will be issued.
Article 15 If an enterprise that handles waste electrical and electronic products intends to terminate its processing activities, it shall take pollution prevention and control measures for its business facilities and sites, properly handle undisposed waste electrical and electronic products, and take the above-mentioned measures. Submit a cancellation application to the original issuing authority within 20 days from the date of the measure, and the original issuing authority will cancel its qualification for the disposal of waste electrical and electronic products after passing on-site verification.
Enterprises that terminate the processing activities of waste electrical and electronic products should conduct environmental investigations and risk assessments on their business facilities and sites; if they require treatment and restoration after assessment, they should bear the responsibility for treatment and restoration in accordance with the law.
Article 16 It is prohibited to dispose of waste electrical and electronic products without a qualification certificate for the disposal of waste electrical and electronic products or not in accordance with the provisions of the qualification certificate for the disposal of waste electrical and electronic products.
It is prohibited to provide or entrust waste electrical and electronic products to units and individuals without waste electrical and electronic product processing qualification certificates to engage in processing activities.
It is prohibited to forge, alter or transfer waste electrical and electronic product processing qualification certificates.
Chapter 3 Supervision and Management
Article 17 The environmental protection department of the people's government of the districted municipality shall dispose of the waste electrical and electronic products of the previous year before March 31 of each year. The issuance of qualification certificates shall be reported to the environmental protection department of the provincial people's government for record.
The environmental protection departments of the people's governments at or above the provincial level shall strengthen supervision and inspection of the approval and issuance of qualification certificates for the disposal of waste electrical and electronic products by the environmental protection departments of the people's governments at the districted city level, and promptly correct illegal activities.
Article 18 The environmental protection departments of local people's governments at or above the county level shall strengthen supervision and inspection of waste electrical and electronic product processing activities through written verification and on-site inspections, and shall supervise and inspect the status and processing of waste electrical and electronic products. The results are recorded and signed by the supervisory and inspection personnel before being filed.
The public may apply to the environmental protection department of the local people's government at or above the county level in accordance with the law to disclose the results of supervision and inspections.
Article 19: Waste electrical and electronic product processing enterprises shall formulate annual monitoring plans and conduct daily monitoring of pollutant emissions. Monitoring reports should be kept for more than 3 years.
The environmental protection departments of local people's governments at or above the county level should strengthen supervisory monitoring of pollutant emissions from waste electrical and electronic product processing enterprises. Supervisory monitoring shall be conducted no less than once every six months.
Article 20: Waste electrical and electronic product processing enterprises shall establish a data information management system, regularly submit basic data and relevant information on the processing of waste electrical and electronic products to the licensing authority, and announce it to the public. Relevant requirements will be formulated separately by the Ministry of Environmental Protection.
Chapter 4 Legal Responsibilities

Article 22 If a waste electrical and electronic product processing enterprise commits any of the following acts, in addition to being punished in accordance with relevant laws and regulations, the issuing authority will take back the waste electrical and electronic product processing qualification certificate:
(1) Anyone who closes, leaves idle, dismantles or uses pollution prevention and control facilities or places abnormally without authorization shall be ordered to make corrections within a time limit by the environmental protection department of the people's government at or above the county level, but fails to make corrections within the time limit;
(2) Causing environmental emergencies of a larger level or above.
Article 23 If a waste electrical and electronic product processing enterprise provides or entrusts waste electrical and electronic products to units or individuals without a waste electrical and electronic product processing qualification certificate to engage in processing activities, the local people at or above the county level shall The government's environmental protection department shall order the illegal conduct to cease, make corrections within a time limit, and impose a fine of less than 30,000 yuan; in serious cases, the certification authority shall withdraw the qualification certificate for the disposal of waste electrical and electronic products.
Article 24 If anyone forges or alters the qualification certificate for the disposal of waste electrical and electronic products, the environmental protection department of the local people's government at or above the county level shall confiscate the forged or altered qualification certificate and impose a fine of 30,000 yuan. The following fines shall be imposed; if it constitutes a violation of public security management, it shall be transferred to the public security organs for public security management penalties in accordance with the law; if it constitutes a crime, it shall be transferred to the judicial organs for investigation of criminal liability in accordance with the law.
Anyone who resells, rents, lends or illegally transfers the qualification certificate for the disposal of waste electrical and electronic products in other forms shall be ordered by the environmental protection department of the local people's government at or above the county level to stop the illegal behavior, make corrections within a time limit, and impose a fine of 30,000 yuan The following fines shall be imposed; if the circumstances are serious, the qualification certificate for the disposal of waste electrical and electronic products shall be withdrawn by the issuing authority; if a crime is constituted, the person shall be transferred to the judicial authority for investigation of criminal liability in accordance with the law.
Article 25 Violations of other provisions of these Measures shall be punished in accordance with the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste", the "Regulations on the Management of Recycling and Disposal of Waste Electrical and Electronic Products" and other relevant laws. Penalties shall be imposed in accordance with the provisions of the regulations.
Chapter 5 Supplementary Provisions
Article 26 Enterprises that have been engaged in processing waste electrical and electronic products before the implementation of these measures shall report to The environmental protection department of the people's government at the district level where the waste electrical and electronic product processing facilities are located shall submit an application for waste electrical and electronic product processing qualifications; those who fail to apply within the time limit shall not continue to engage in waste electrical and electronic product processing activities.
Article 27 These Measures shall come into effect on January 1, 2011.
