Complainant on what can be brought to the people's court administrative litigation in accordance with the law

Article 55 of the Government Procurement Law of the People's Republic of China*** and the State of the questioning supplier is dissatisfied with the response of the procurer or procurement agency or the procurer or procurement agency fails to make a response within the prescribed time, it can file a complaint to the supervision and management department of government procurement at the same level within fifteen working days after the expiration of the response period. Article 56 The government procurement supervision and management department shall, within thirty working days after receipt of the complaint, make a decision to deal with the complaint, and notify the complainant and the parties concerned with the complaint in writing. Article 57 of the government procurement supervision and management department in dealing with the complaint matters during the period, depending on the circumstances of the written notice to the purchaser to suspend the procurement activities, but the suspension shall not exceed a maximum of thirty days. Article 58 The complainant of the government procurement supervision and management of the complaint handling decision is not satisfied or the government procurement supervision and management of overdue processing, may apply for administrative reconsideration or administrative litigation to the people's court according to law. Chapter VII Supervision and Inspection Article 59 The government procurement supervision and management department shall strengthen the supervision and inspection of government procurement activities and centralized purchasing agencies. The main contents of supervision and inspection are: (1) the implementation of laws, administrative rules and regulations concerning government procurement; (2) the implementation of the scope of procurement, procurement methods and procurement procedures; (3) the professional quality and professional skills of government procurement personnel. Article 60 The government procurement supervision and management department shall not set up a centralized purchasing agency and shall not participate in the procurement activities of government procurement projects. Procurement agencies and administrative organs shall not have affiliation or other interests. Article 61 centralized purchasing agency shall establish and improve the internal oversight management system. Decision-making and implementation procedures for procurement activities shall be clear, and shall supervise and restrain each other. Personnel handling procurement and responsible for procurement contract review, acceptance of the duties and powers of personnel should be clear and separate from each other.
