Chapter I General Provisions

Chapter II Energy Conservation Planning

Chapter IV Energy Conservation Measures

Article 28 The implementation of energy-saving renovation of public **** institutions shall conduct energy audits and investment return analysis, clear energy-saving indicators, and after energy-saving renovation using measurement of energy-saving indicators for assessment and comprehensive evaluation.
Article 29 The public **** organization shall reduce the standby energy consumption of air conditioners, computers, photocopiers and other electrical equipment, and turn off the electrical equipment in a timely manner.
Article 30 The public **** institutions should strictly implement the state regulations on air conditioning indoor temperature control, make full use of natural ventilation, improve air conditioning operation and management.

Article 33 The public **** organization shall implement key monitoring of the network server room, cafeteria, water room, boiler room and other parts of the energy situation, and take effective measures to reduce energy consumption.
Article 34 The official vehicles of public **** institutions shall be equipped in accordance with the standards, giving priority to low energy consumption, low pollution, the use of clean energy vehicles, and the strict implementation of the vehicle scrapping system.
Public **** institutions shall use official vehicles in accordance with the prescribed purposes, develop energy-saving driving norms, and implement a single-vehicle energy accounting system.
Public **** institutions should actively promote the socialization of official car services, and encourage staff to use public **** transport, non-motorized transport travel.
Chapter V Supervision and Guarantee
Article 35 The State Council and local people's governments at or above the county level that manage the work of organ affairs shall, in conjunction with the relevant departments, strengthen the supervision and inspection of energy conservation in public **** agencies at their level. Supervision and inspection shall include:
(1) the formulation and implementation of annual energy-saving goals and implementation programs;
(2) energy consumption measurement, monitoring and statistics;
(3) the implementation of energy consumption quotas;
(4) the establishment of rules and regulations for energy-saving management;
(5) the setting up of energy management positions and the Energy management positions and the implementation of the responsibility system;
(f) energy systems, equipment, energy-saving operation;

(1) Failure to formulate annual energy-saving goals and implementation plans, or failure to file annual energy-saving goals and implementation plans for Targets and implementation programs for the record;
(b) the implementation of energy consumption metering system, or failure to distinguish between the types of energy use, energy use system to implement energy consumption sub-household, classification, sub-metering, and real-time monitoring of energy consumption conditions;
(c) failure to appoint a person responsible for the energy consumption statistics, or failure to truthfully record the raw data of energy consumption metering, and the establishment of statistical ledgers;
(d) not in accordance with the requirements of the report on the status of energy consumption in the previous year;
(e) more than the quota of energy consumption of energy use, not to the people's government at this level to manage the work of the authorities to explain the agency;
(f) did not set up the energy management positions, or not in the key energy-using systems, equipment operation positions equipped with professional and technical personnel;
(VII) not in accordance with the provisions of the energy audit, or not based on the audit results to take measures to improve energy efficiency;
(VIII) refusal, obstruction of energy-saving supervision and inspection.
Article 38 If a public **** organization fails to implement the government procurement list of energy-saving products and equipment, or fails to procure products and equipment listed in the government procurement list of energy-saving products and equipment in accordance with the provisions of the relevant state mandatory procurement or preferential procurement, or procures energy-using products and equipment that the state has explicitly ordered to be eliminated, it shall be given a warning by the supervision and management of government procurement, and it may be subject to a fine; and the directly responsible Supervisors and other directly responsible personnel shall be given sanctions in accordance with the law, and shall be notified.
Article 39 If the department responsible for approving or approving fixed asset investment projects approves or approves a construction project of a public **** organization that has not passed the energy-saving assessment and review, the directly responsible supervisory personnel and other directly responsible personnel shall be given penalties in accordance with the law.
Public **** institutions to start construction projects that have not passed the energy-saving assessment and review of construction projects, the relevant authorities shall be ordered by the law to rectify the situation; the directly responsible officers in charge and other directly responsible personnel shall be given sanctions in accordance with the law.
Article 40 If a public **** organization violates the regulations by purchasing official vehicles in excess of the standard or establishment, or refuses to scrap a vehicle that is highly energy-consuming or polluting, the person in charge and other persons directly responsible shall be given sanctions in accordance with the law, and the people's government of this level shall, in accordance with the relevant provisions of the agency managing the work of the affairs of the organs, take the vehicle back, auction it, or order it to be returned to it, and other ways of dealing with the vehicle.
Article 41 The public **** institutions in violation of the provisions of the use of energy caused by energy waste, by the people's government at the people's level to manage the affairs of the organs of the work of the agency in conjunction with the relevant departments to issue energy-saving rectification opinion, the public **** institutions shall be implemented in a timely manner.
Article 42 The staff of the institutions managing the affairs of the organs in the supervision and management of energy conservation in public **** institutions abuse of power, dereliction of duty, favoritism and malpractice, constituting a crime, shall be held criminally responsible; does not constitute a crime, shall be given sanctions according to law.
Chapter VI Supplementary Provisions
Article 43 These Regulations shall come into force on October 1, 2008, and shall be implemented.
