1) Article 266 of the Criminal Law Fraud Fraudulent public and private property, the amount of money, shall be sentenced to less than three years' fixed-term imprisonment, criminal detention or control, and shall be sentenced to a fine or a single fine; where the amount is enormous or there are other serious circumstances, the penalty shall be fixed-term imprisonment of not less than three years but not more than ten years, and a fine; where the amount is particularly enormous or there are other particularly serious circumstances, the penalty shall be fixed-term imprisonment of not less than ten years but not more than life imprisonment, and a fine or confiscation of property. Where this Law provides otherwise, it shall do so in accordance with the provisions.
2) "Interpretation on Several Issues Concerning the Specific Application of Law in Handling Criminal Cases of Fraud" Article 1 If the value of the fraudulent public or private property is more than 3,000 to 10,000 yuan, more than 30,000 to 100,000 yuan or more, or more than 500,000 yuan, it shall be recognized as the "larger amount" as stipulated in Article 266 of the Criminal Law, respectively, "huge amount" and "especially huge amount" as stipulated in Article 266 of the Criminal Law.
The higher people's courts and people's procuratorates of the provinces, autonomous regions and municipalities directly under the Central Government may, in conjunction with the economic and social development of their respective regions, within the range of the amounts stipulated in the preceding paragraph, *** with the study to determine the specific amount of the standard to be implemented in their respective regions, and report it to the Supreme People's Court and the Supreme People's Procuratorate for the record
