The Law of the People's Republic of China on Administrative Penalties for Public Security was revised and promulgated in 2012 and implemented in 2013, the original text of which is shown below: (Since the full text is too long to upload in its entirety, only part of it is uploaded here.)

Chapter I General Provisions

Article 1

This Law is enacted for the purpose of maintaining public order and security, safeguarding the security of the public ****, protecting the lawful rights and interests of citizens, legal persons and other organizations, and regulating and safeguarding the public security organs and their people's police to perform their duties of public security administration in accordance with the law.

Article 2

Disturbing public **** order, jeopardizing public **** security, infringing on personal rights and property rights, and obstructing social management are socially hazardous, and constitute a crime in accordance with the provisions of the Criminal Law of the People's Republic of China **** and the State of China, shall be investigated for criminal responsibility in accordance with the law; if not yet sufficiently criminally punishable, the public security organs shall impose public security administration penalties in accordance with this Law.

Article 3

The provisions of this Law shall apply to the procedures for the imposition of penalties in the administration of public security; where this Law does not provide for such penalties, the relevant provisions of the Administrative Penalty Law of the People's Republic of China*** and the People's Republic of China shall apply.

Article 4

This Law shall apply to violations of public security administration occurring within the territory of the People's Republic of China*** and the State of China, except where specially provided for by law. This Law shall apply to violations of public security administration occurring within the territory of the People's Republic of China*** and its ships and aircrafts, except where the law contains special provisions.

Article 5

Penalties for the administration of public security must be based on facts that are commensurate with the nature and circumstances of the violation of the administration of public security as well as the degree of social harm. The imposition of public security administration penalties shall be open and fair, respecting and safeguarding human rights and protecting the human dignity of citizens. Handling of public security cases shall adhere to the principle of combining education and punishment.

Article 6

People's governments at all levels shall strengthen the comprehensive management of public security, take effective measures to resolve social conflicts, enhance social harmony and maintain social stability.

Article 7

The public security departments of the State Council are responsible for the administration of public security throughout the country. The public security organs of local people's governments at or above the county level are responsible for the administration of public security in their own administrative areas. The jurisdiction of public security cases shall be prescribed by the public security departments of the State Council.

Article 8

Where a violation of public order management causes damage to others, the perpetrator or his guardian shall bear civil liability in accordance with law.

Article 9

For violations of public security management such as fighting and assault or destruction of other people's property caused by civil disputes, the public security organs may mediate in cases where the circumstances are less serious. After mediation by the public security organs, the parties concerned to reach an agreement, shall not be punished. After mediation does not reach an agreement or agreement is not fulfilled, the public security organs shall, in accordance with the provisions of this Law, the violation of public security management shall be punished, and inform the parties concerned may, in accordance with the law on civil disputes to the people's court to file a civil lawsuit.

Chapter II Types and Application of Penalties

Article 10

The types of penalties for the administration of public security are divided into:

(1) warnings;

(2) fines;

(3) administrative detention;

(4) revocation of licenses issued by the public security organs. In the case of foreigners who violate public security administration, a time limit for departure or expulsion may be additionally applied.

Article 11

Drugs, obscene articles and other contraband seized in the handling of public security cases, gambling paraphernalia, gambling money, paraphernalia for smoking or injecting drugs, as well as tools owned by the person that are directly used in the commission of an act of violation of public security administration, shall be seized and disposed of in accordance with the provisions. The property derived from the violation of public security management shall be recovered and returned to the offended person; if there is no offended person, it shall be registered, sold at public auction or disposed of in accordance with the relevant provisions of the State, and the proceeds shall be paid into the State treasury.

Article 12

Where a person who has reached the age of fourteen but is not yet eighteen violates public security administration, the punishment shall be lighter or mitigated; and where a person who has not yet reached the age of fourteen violates public security administration, he shall not be punished, but his guardian shall be instructed to give him a more strict supervision.

Article 13

Mentally ill persons who violate public security administration when they are unable to recognize or control their own behavior shall not be punished, but their guardians shall be ordered to exercise strict supervision and treatment. An intermittent mental patient who violates the public security administration when he or she is in a normal state of mind shall be punished.

Article 14

A blind person or a deaf or dumb person who violates public security administration may be given a lighter or lesser punishment or shall not be punished.

Article 15

A drunken person who violates public security administration shall be punished. If an intoxicated person in a state of intoxication is dangerous to himself or a threat to the person, property or public ****safety of others, protective measures shall be taken to restrain him until he sobers up.

Article 16

Where there are two or more violations of public security administration, separate decisions shall be made and the penalties shall be enforced together. Where administrative detention penalties are combined, the maximum period shall not exceed twenty days.

Article 17

Where **** violates public security administration together, the punishment shall be imposed separately according to the role played by the perpetrator of the violation of public security administration in the act of violation of public security administration. A person who abets, coerces or entices another person to violate the public security administration shall be punished in accordance with his act of abetting, coercion or enticement.

Article 18

Where a unit violates public security administration, the person in charge and other persons directly responsible shall be punished in accordance with the provisions of this Law. Where other laws or administrative regulations provide for unit punishment for the same act, such punishment shall be imposed in accordance with their provisions.

Article 19

Where a violation of public security administration is committed under one of the following circumstances, the punishment shall be reduced or not imposed:

(1) where the circumstances are particularly minor;

(2) where the violator takes the initiative to eliminate or mitigate the consequences of the violation and obtains the understanding of the aggrieved person;

(3) where the violator has been coerced or induced by another person;

(4) where he takes the initiative to surrender the case to the public security authorities and to report the case to the public security authorities in good faith. (d) surrender, to the public security organs to truthfully state their offenses;

(e) meritorious performance.

Article 20

A violation of public security management shall be punished more severely if any of the following circumstances applies:

(1) there are more serious consequences;

(2) abetting, coercing, or inducing another person to violate public security management;

(3) retaliating against the informant, accuser, whistle-blower, or witness;

(4) he has been punished for a public security management offense within six months. received a public security management punishment.

Article 21

The punishment of administrative detention shall not be carried out if the perpetrator of an act of violating public security administration is in one of the following circumstances, and should be punished by administrative detention in accordance with this Law:

(1) He is fourteen years of age but less than sixteen years of age;

(2) He is sixteen years of age but less than eighteen years of age, and is violating public security administration for the first time;

(3) He is Those who have reached the age of seventy years or above;

(d) Those who are pregnant or breastfeeding their babies under one year of age.

Article 22

If a violation of public security administration is not discovered by the public security organs within six months, no further punishment shall be imposed. The period stipulated in the preceding paragraph shall be calculated from the date of occurrence of the act of violating public security administration; if the act of violating public security administration has a continuous or continuing state, it shall be calculated from the date of the end of the act.

Chapter III Violations of Public Security Management and Penalties

Article 23

Anyone who commits any of the following acts shall be given a warning or fined not more than two hundred yuan; if the circumstances are aggravated, he shall be sentenced to detention of not less than five days and not more than ten days, and may be fined not more than five hundred yuan:

(1) Disturbing the order of an institution, organization, enterprise or institution, so as to render work, production, business, medical care, teaching, scientific research can not be carried out normally, and has not yet caused serious damage;

(2) disturbing the order of stations, ports, wharves, airports, shopping malls, parks, exhibition halls, or other places of public ****;

(3) disrupting the order of the public **** car, tram, train, ship, aircraft or other means of public **** transportation;

(d) unlawfully intercepting or forcibly boarding or pickpocketing a motor vehicle, ship, aircraft or other means of transportation, thus affecting the normal movement of the means of transportation;

(e) disrupting the order of an election conducted in accordance with the law. Whoever gathers a crowd to commit the acts in the preceding paragraph shall be punished by detention of the prime movers for not less than ten days and not more than fifteen days, and may be fined not more than one thousand yuan.

Article 24

Anyone who commits any of the following acts and disrupts the order of a large-scale mass event such as a cultural or sports event shall be given a warning or fined not more than two hundred yuan; in serious cases, he or she shall be sentenced to detention of not less than five nor more than ten days, and may be fined not more than five hundred yuan in addition:

(1) forcing his or her way into the venue;

(2) violating the provisions of the regulations, setting off fireworks firecrackers or other objects;

(iii) displaying insulting slogans, banners and other objects;

(iv) besieging referees, athletes or other staff members;

(v) throwing miscellaneous objects into the field and failing to listen to stopping them;

(vi) other behaviors disturbing the order of large-scale mass events. Those who are punished with detention for disturbing the order of a sports competition may be ordered at the same time not to enter the stadium to watch the same kind of competition for twelve months; if they enter the stadium in violation of the regulations, they shall be forcibly taken away from the scene.

Article 25

Anyone who commits any of the following acts shall be sentenced to detention for not less than five days and not more than ten days, and may be fined not more than 500 yuan; in less serious cases, he or she shall be sentenced to detention for not more than five days or a fine of not more than 500 yuan:

(1) spreading rumors, falsely reporting a dangerous situation, an epidemic, or an alarm, or intentionally disrupting the order of the public **** in any other way;

(2) Put false explosive, poisonous, radioactive, corrosive substances or infectious disease pathogens and other dangerous substances to disrupt public **** order;

(3) threatening to commit arson, explosion, put dangerous substances to disrupt public **** order.

Article 26

Anyone who commits any of the following acts shall be sentenced to detention for not less than five days and not more than ten days, and may be fined not more than five hundred yuan; if the circumstances are aggravated, he or she shall be sentenced to detention for not less than ten days and not more than fifteen days, and may be fined not more than one thousand yuan:

(1) ganging up and brawling;

(2) pursuing or intercepting others;

(3) forcefully taking or arbitrarily damaging or occupying public or private property;

(4) other provocative behavior.

Article 27

Anyone who commits any of the following acts shall be sentenced to detention for not less than ten days and not more than fifteen days, and may be fined not more than one thousand yuan; if the circumstances are less serious, he or she shall be sentenced to detention for not less than five days and not more than ten days, and may be fined not more than five hundred yuan:

(1) organizing, instigating, coercing, decoying, or inciting others to engage in activities of cults or synagogue sects, or to make use of the cults or synagogues, superstitious activities, disturbing the social order and damaging the health of others;

(2) fraudulent use of the name of religion, qigong activities to disturb the social order and damage the health of others.

Article 28

Whoever violates the state regulations and intentionally interferes with the normal conduct of radio operations, or produces harmful interference to radio stations (stations) in normal operation, and after being pointed out by the competent authorities concerned, refuses to take effective measures to eliminate it, shall be sentenced to detention of not less than five days and not more than ten days; and if the circumstances are serious, he or she shall be sentenced to detention of not less than ten days and not more than fifteen days.

Article 29

Anyone who commits any of the following acts shall be sentenced to detention for not more than five days; if the circumstances are more serious, he or she shall be sentenced to detention for not less than five days but not more than ten days:

(1) Anyone who violates the state regulations and intrudes into a computer information system, thus causing a danger;

(2) Anyone who violates the state regulations and deletes, modifies, adds to or interferes with the functions of a computer information system, thus causing the computer information system to fail to operate normally. computer information system can not operate normally;

(3) violation of state regulations, the computer information system to store, process, transmit data and applications for deletion, modification, addition;

(4) intentionally produce, disseminate computer viruses and other destructive programs, affecting the normal operation of the computer information system.

Article 30

Anyone who, in violation of state regulations, manufactures, buys, sells, stores, transports, mails, carries, uses, provides, or disposes of hazardous substances, such as explosive, poisonous, radioactive, corrosive substances, or pathogens of infectious diseases, shall be sentenced to detention of not less than ten days and not more than fifteen days; or if the circumstances are less serious, he or she shall be sentenced to detention of not less than five days and not more than ten days.

Article 31

Anyone who fails to report the theft, robbery or loss of dangerous substances such as explosive, poisonous, radioactive, corrosive substances or infectious disease pathogens in accordance with the regulations shall be sentenced to detention of not more than five days; anyone who intentionally conceals and does not report the matter shall be sentenced to detention of not less than five days but not more than ten days.

Article 32

Anyone who illegally carries firearms, ammunition, or crossbows, daggers or other state-prescribed control instruments shall be sentenced to detention of not more than five days and may be fined not more than five hundred yuan; in less serious cases, he or she shall be warned or fined not more than two hundred yuan. Anyone who illegally carries firearms, ammunition or crossbows, daggers and other state-prescribed control instruments into a public ****place or public ****transportation vehicle shall be sentenced to not less than five days but not more than ten days of detention, and may be fined not more than five hundred yuan.

Article 33

Anyone who commits any of the following acts shall be sentenced to detention for not less than ten days and not more than fifteen days:

(1) stealing, damaging or destroying facilities of oil and gas pipelines, electric power and telecommunication facilities, broadcasting and television facilities, facilities of water conservancy and flood control projects, or facilities of public **** such as hydrological monitoring, surveying, meteorological surveying and reporting, environmental monitoring, geological monitoring, seismic monitoring and the like;

(ii) moving or destroying boundary markers, boundary pillars and other border markers, border facilities or territorial or territorial sea marking facilities at the state border;

(iii) illegally carrying out activities affecting the direction of the state (border) boundary line or constructing facilities obstructing the management of the state (border) border.

Article 34

Anyone who steals, damages or moves without authorization an aircraft facility in use, or forcibly enters the cockpit of an aircraft shall be sentenced to detention of not less than ten days and not more than fifteen days. Anyone who uses an appliance or tool that may affect the normal functioning of the navigation system on board an aircraft in use and fails to heed the advice of others shall be sentenced to detention of not more than five days or a fine of not more than five hundred yuan.

Article 35

Anyone who commits any of the following acts shall be sentenced to detention of not less than five days and not more than ten days, and may be fined not more than five hundred yuan; if the circumstances are less serious, he or she shall be sentenced to detention of not more than five days or a fine of not more than five hundred yuan:

(1) Theft of, damage to, or unauthorized movement of railroad facilities, equipment, rolling stock fittings, or safety signs;

(2) placing obstructions on railway lines, or Railroad lines to place obstacles, or intentionally throwing objects to the train;

(3) in the railroad lines, bridges, culverts, digging pits, quarrying for sand;

(4) in the railroad lines to set up a private crossing or level crossing.

Article 36

Anyone who enters the railroad protection net without authorization or walks, sits or lies on the railroad line when a train is approaching, or snatches and crosses the railroad line, thus affecting the safety of the train, shall be sentenced to a warning or a fine of not more than two hundred yuan.

Article 37

Anyone who commits any of the following acts shall be sentenced to detention of not more than five days or a fine of not more than five hundred yuan; if the circumstances are serious, he shall be sentenced to detention of not less than five days but not more than ten days, and may be sentenced to a fine of not more than five hundred yuan:

(1) Installation or use of electric power grids without authorization or the installation or use of electric power grids does not conform to the provisions of the safety regulations;

(2) Construction in places where vehicles

(ii) construction in places where vehicles and pedestrians pass, the ditch wells and caves do not set up covers, fences and warning signs, or intentionally damage or move the covers, fences and warning signs;

(iii) theft, damage to the road surface covers, lighting and other public **** facilities.

Article 38

Organizing cultural, sports and other large-scale mass activities, in violation of the relevant provisions, there is a risk of safety accidents, ordered to stop the activities and immediately evacuate. The organizer shall be sentenced to detention for not less than five days and not more than ten days, and a fine of not less than two hundred yuan and not more than five hundred yuan; in less serious cases, the organizer shall be sentenced to detention for not more than five days or a fine of not more than five hundred yuan.

Article 39

An operator or manager of a hotel, restaurant, cinema, theater, amusement park, sports ground, exhibition hall, or other place intended for public activities, who violates the safety regulations and puts the place at risk of safety accidents, and is ordered by the public security authorities to make corrections and refuses to do so, shall be sentenced to detention for not more than five days.

Article 40

Anyone who commits any of the following acts shall be sentenced to detention for not less than ten days and not more than fifteen days, and to a fine of not less than five hundred yuan and not more than one thousand yuan; if the circumstances are less serious, he or she shall be sentenced to detention for not less than five days and not more than ten days, and shall be sentenced to a fine of not less than two hundred yuan and not more than five hundred yuan:

(1) organizing, coercing, or inducing a person less than sixteen years of age, or a person with disabilities to engage in a horrific or cruel performance;

(ii) forcing another person to labor by violence, threat or other means;

(iii) illegally restricting another person's personal freedom, illegally intruding into another person's home or illegally searching another person's body.

Article 41

Anyone who coerces, entices or takes advantage of another person to beg shall be sentenced to not less than ten nor more than fifteen days' detention and may be fined not more than one thousand yuan. Anyone who repeatedly entangles, forcibly begs or begs in other ways that nuisance others shall be sentenced to detention of not more than five days or a warning.

Article 42

Anyone who commits any of the following acts shall be sentenced to detention for not more than five days or a fine of not more than five hundred yuan; if the circumstances are more serious, he shall be sentenced to detention for not less than five days but not more than ten days, and may be sentenced to a fine of not more than five hundred yuan in addition:

(1) writing a threatening letter or threatening another person's personal safety in some other way;

(2) insulting another person in a blatant manner or fabricating facts to slander (c) fabricating facts to falsely accuse or frame others in an attempt to subject them to criminal prosecution or public security management punishment;

(d) threatening, insulting, beating or retaliating against witnesses and their close relatives;

(e) repeatedly sending obscene, insulting, intimidating or other information that interferes with the normal life of other people;

(F) peeping, secretly filming, eavesdropping, spreading the privacy of others.

Article 43

Anyone who assaults another person or intentionally inflicts bodily harm on another person shall be sentenced to detention of not less than five days but not more than ten days, and a fine of not less than two hundred yuan but not more than five hundred yuan; in less serious cases, he shall be sentenced to detention of not more than five days or a fine of not more than five hundred yuan. In any of the following cases, the offender shall be sentenced to detention for not less than ten days and not more than fifteen days, and shall be fined not less than five hundred yuan and not more than one thousand yuan:

(1) beating or injuring another person in a gang;

(2) beating or injuring a disabled person, a pregnant woman, or a person who is less than fourteen years old or who is sixty years old or older;

(3) beating or injuring another person several times or beating or injuring more than one person at one time of the person.

Article 44

If a person molests another person or intentionally exposes his or her body in a public *** place under aggravating circumstances, he or she shall be sentenced to detention of not less than five and not more than ten days; if he or she molests a mentally disabled person, a mentally ill person, or a person who is less than fourteen years of age or if he or she is involved in any other serious circumstances, he or she shall be sentenced to detention of not less than ten and not more than fifteen days.

Article 45

Anyone who commits any of the following acts shall be sentenced to detention of not more than five days or a warning:

(1) abusing a family member, and the abused person requests to be dealt with;

(2) abandoning a dependent person who is not capable of independent living.

Article 46

Anyone who forcibly buys or sells goods, forces another person to provide a service or forces another person to accept a service shall be sentenced to detention of not less than five and not more than ten days and a fine of not less than two hundred and not more than five hundred yuan; if the circumstances are less serious, he or she shall be sentenced to detention of not more than five days or a fine of not more than five hundred yuan.

Article 47

Anyone who incites ethnic hatred or ethnic discrimination, or carries contents of ethnic discrimination or insults in publications or computer information networks shall be sentenced to detention of not less than ten days and not more than fifteen days, and may be fined not more than one thousand yuan.

Article 48

Anyone who fraudulently claims, conceals, destroys, privately opens or illegally inspects another person's mail shall be sentenced to detention of not more than five days or a fine of not more than five hundred yuan.

Article 49

Anyone who steals, swindles, coaxes, snatches, extorts or intentionally destroys public or private property shall be sentenced to detention of not less than five days and not more than ten days, and may be fined not more than five hundred yuan; if the circumstances are aggravated, he shall be sentenced to detention of not less than ten days and not more than fifteen days, and may be fined not more than one thousand yuan.

Article 50

Anyone who commits any of the following acts shall be given a warning or fined not more than two hundred yuan; if the circumstances are serious, he or she shall be sentenced to detention of not less than five days but not more than ten days, and may be fined not more than five hundred yuan in addition:

(1) Anyone who refuses to carry out the decisions or orders issued by the people's government according to the law in a state of emergency situation;

(2) Anyone who obstructs a staff member of a state organ in the (iii) obstructing the passage of fire engines, ambulances, engineering rescue vehicles, police vehicles and other vehicles carrying out emergency tasks;

(iv) forcibly breaking through the cordon and warning zones set up by the public security organs. Anyone who obstructs the people's police in the performance of their duties in accordance with the law shall be punished more severely.

Article 51

Anyone who impersonates a staff member of a state organ or solicits by any other false identity shall be sentenced to detention of not less than five and not more than ten days, and may be fined not more than five hundred yuan; if the circumstances are less serious, he shall be sentenced to detention of not more than five days or a fine of not more than five hundred yuan. Anyone who impersonates a member of the uniformed forces and solicits fraud shall be punished more severely.

Article 52

Anyone who commits any of the following acts shall be sentenced to detention for not less than ten days and not more than fifteen days, and may be fined not more than one thousand yuan; if the circumstances are less serious, he or she shall be sentenced to detention for not less than five days and not more than ten days, and may be fined not more than five hundred yuan:

(1) Counterfeiting, forgery, or buying or selling of official documents of state organs, people's organizations, enterprises, institutions, or other organizations, p>(d) Counterfeiting or altering a ship's household registration plate, buying, selling or using a forged or altered ship's household registration plate, or altering a ship's engine number.

Article 53

Where a ship enters or docks without authorization in waters or islands prohibited or restricted by the state, the person in charge of the ship and the responsible persons shall be fined from five hundred yuan to one thousand yuan; if the circumstances are serious, the person shall be sentenced to detention of not more than five days and a fine of not less than five hundred yuan to one thousand yuan.

Article 54

Anyone who commits any of the following acts shall be sentenced to detention for not less than ten days and not more than fifteen days, and shall be fined not less than five hundred yuan and not more than one thousand yuan; in less serious cases, he shall be sentenced to detention for not more than five days or a fine of not more than five hundred yuan:

(1) Anyone who violates the state regulations and carries out activities in the name of a social organization without being registered, and continues to carry out such activities even after he has been prohibited;

(ii) by the law to revoke the registration of social organizations, still carry out activities in the name of social organizations;

(iii) without authorization, unauthorized operation in accordance with state regulations need to be licensed by the public security organs of the industry. The third of the preceding paragraph shall be banned. Obtain permission from the public security organs of the operator, violation of relevant state regulations, the circumstances are serious, the public security organs may revoke the license.

Article 55

Anyone who incites or plans an unlawful assembly, procession or demonstration, and fails to listen to dissuasion, shall be sentenced to detention of not less than ten days and not more than fifteen days.

Article 56

A staff member of the hotel industry who fails to register the name, type and number of identity document of a lodging traveler in accordance with the regulations, or who fails to stop a lodging traveler who is known to be bringing hazardous substances into the hotel, shall be sentenced to a fine of not less than two hundred yuan and not more than five hundred yuan. A staff member of the hotel industry who knows that a lodging traveler is a person suspected of a crime or is wanted by the public security organs and fails to report the case to the public security organs shall be fined not less than two hundred yuan but not more than five hundred yuan; if the circumstances are serious, he or she shall be detained for not more than five days, and may also be fined not more than five hundred yuan.

Article 57

A housing renter who rents a housing unit to a person who does not have an identity document to live in, or who fails to register the name of the tenant and the type and number of the identity document in accordance with the regulations, shall be sentenced to a fine of not less than two hundred yuan and not more than five hundred yuan. A housing renter who, knowing that the lessee is using the rented housing for criminal activities, fails to report the matter to the public security authorities shall be fined not less than two hundred and not more than five hundred yuan; in serious cases, he shall be sentenced to detention for not more than five days, and may also be fined not more than five hundred yuan.

Article 58

Anyone who violates the laws and regulations on the prevention and control of noise pollution in social life and creates noise that interferes with the normal life of other people shall be given a warning; and anyone who fails to rectify the situation after the warning shall be given a fine of not less than two hundred yuan and not more than five hundred yuan.

Article 59

Anyone who commits any of the following acts shall be sentenced to a fine of not less than five hundred yuan and not more than one thousand yuan; if the circumstances are serious, the person shall be sentenced to detention for not less than five days and not more than ten days, and shall also be sentenced to a fine of not less than five hundred yuan and not more than one thousand yuan:

(1) A staff member of a pawnbroker's business who undertakes to pawn an article, fails to examine the relevant certificates, fails to carry out the registration formalities, or who, knowing that he is suspected of having violated the law, Stolen goods, do not report to the public security organs;

(2) violation of state regulations, the acquisition of railroads, oil fields, power supply, telecommunications, mines, water conservancy, surveying and urban utilities and other waste special equipment;

(3) the acquisition of public security organs notified of the search for stolen goods or suspected of stolen goods;

(4) acquisition of the state prohibits the acquisition of other items.

Article 60

Anyone who commits any of the following acts shall be sentenced to detention of not less than five days and not more than ten days, and shall be fined of not less than two hundred yuan and not more than five hundred yuan:

(1) concealing, transferring, selling, or damaging property that has been lawfully seized, sequestered, or frozen by administrative law enforcement agencies;

(2) falsifying, concealing, or destroying evidence, or giving false testimony, or falsely reporting a case

(iii) knowingly harboring, transferring or selling on behalf of stolen goods;

(iv) criminals who have been legally executed for control, deprivation of political rights, or are on probation, temporary release from custody, or those who have been subject to criminal compulsory measures in accordance with the law, there is a violation of the laws, administrative regulations, or the supervision and management regulations of the relevant departments of the State Council.

Article 61

Anyone who assists in organizing or transporting another person to sneak across the state (border) border shall be sentenced to a detention of not less than ten nor more than fifteen days and a fine of not less than one thousand yuan nor more than five thousand yuan.

Article 62

Whoever provides conditions for a person to sneak across the state (border) border shall be sentenced to detention of not less than five days and not more than ten days, and shall be fined of not less than five hundred yuan and not more than two thousand yuan. A person who steals across the state (border) border shall be detained for not more than five days or fined not more than five hundred yuan.

Article 63

Anyone who commits any of the following acts shall be sentenced to a warning or a fine of not more than two hundred yuan; if the circumstances are more serious, he shall be sentenced to detention of not less than five days but not more than ten days, and shall be fined of not less than two hundred yuan but not more than five hundred yuan:

(1) Carving, defacing, or otherwise intentionally damaging cultural relics and scenic spots under the protection of the State;

(2) violating the provisions of the State (B) in the vicinity of cultural relics protection units for blasting, excavation and other activities, endangering the safety of cultural relics.

Article 64

Anyone who commits any of the following acts shall be sentenced to a fine of not less than five hundred yuan and not more than one thousand yuan; if the circumstances are serious, he shall be sentenced to a detention of not less than ten days and not more than fifteen days, and shall also be sentenced to a fine of not less than five hundred yuan and not more than one thousand yuan:

(1) Stealing a motor vehicle of another person;

(2) Driving or stealing another person's aircraft or motorized vessel without a driving license.

Article 65

Anyone who commits any of the following acts shall be sentenced to detention for not less than five days and not more than ten days; if the circumstances are serious, he or she shall be sentenced to detention for not less than ten days and not more than fifteen days, and may be fined not more than one thousand yuan:

(1) Intentionally destroying or defacing the grave of another person, or destroying or throwing away the corpse or ashes of another person;

(2) Parking a corpse in a public ****ing place or disrupting the normal living and working order of others by parking a corpse, and failing to listen to dissuasion.

Article 66

Anyone who engages in prostitution or soliciting prostitutes shall be sentenced to detention of not less than ten days and not more than fifteen days, and may be fined not more than five thousand yuan; if the circumstances are less serious, he or she shall be sentenced to detention of not more than five days or a fine of not more than five hundred yuan. Anyone who solicits prostitutes in a public *** place shall be detained for not more than five days or fined not more than five hundred yuan.

Article 67

Anyone who induces, accommodates or introduces another person into prostitution shall be sentenced to detention of not less than ten days and not more than fifteen days, and may be fined not more than five thousand yuan; if the circumstances are less serious, he or she shall be sentenced to detention of not more than five days or a fine of not more than five hundred yuan.

Article 68

Anyone who produces, transports, reproduces, sells, rents out or uses computer information networks, telephones or other means of communication to disseminate obscene information, such as obscene books, pictures, films or audiovisual products, shall be sentenced to detention of not less than ten days and not more than fifteen days, and may be fined not more than 3,000 yuan; in less serious cases, he or she shall be sentenced to detention of not more than five days or fined not more than 500 yuan. The lesser circumstances shall be punishable by detention for not more than five days or a fine of not more than 500 yuan.

Article 69

Anyone who commits any of the following acts shall be sentenced to detention for not less than ten days and not more than fifteen days, and may also be fined not less than five hundred yuan and not more than one thousand yuan:

(1) organizing the broadcasting of obscene audio or video images;

(2) organizing or carrying out obscene performances;

(3) taking part in mobbing and lewd activities. Anyone who knows that another person is engaged in the activities of the preceding paragraph and provides conditions for him to do so shall be punished in accordance with the provisions of the preceding paragraph.

Article 70

Whoever provides conditions for gambling for the purpose of profit, or participates in gambling with a large amount of money, shall be sentenced to detention of not more than five days or a fine of not more than 500 yuan; if the circumstances are serious, he or she shall be sentenced to detention of not less than ten days but not more than fifteen days, and shall also be sentenced to a fine of not less than 500 yuan but not more than 3,000 yuan.

Article 71

Anyone who commits any of the following acts shall be sentenced to not less than ten days but not more than fifteen days of detention, and may be fined not more than three thousand yuan; in less serious cases, he or she shall be sentenced to not more than five days of detention or a fine of not more than five hundred yuan:

(1) Illegal cultivation of less than five hundred poppies or small quantities of other narcotic plants;

(2) Illegal trade, transportation, carrying or possession of small quantities of uninactivated poppy; or (b) Illegally trading, transporting, carrying, possessing or using a small amount of uninactivated seeds or seedlings of opium poppy or other drug plants;

(c) Illegally transporting, trading, storing or using a small amount of poppy husk. Those who have committed the act in the first paragraph of the preceding paragraph and eradicated it by themselves before maturity shall not be punished.

Article 72

Anyone who commits any of the following acts shall be sentenced to detention for not less than ten days and not more than fifteen days, and may be fined not more than two thousand yuan; if the circumstances are less serious, he or she shall be sentenced to detention for not more than five days or a fine of not more than five hundred yuan:

(1) Illegally possessing less than two hundred grams of opium, less than ten grams of heroin or methamphetamine or a small amount of other drugs;

( (ii) supplying drugs to others;

(iii) smoking or injecting drugs;

(iv) coercing or deceiving medical personnel to prescribe narcotic drugs or psychotropic substances.

Article 73

Anyone who instigates, induces or deceives another person to take or inject drugs shall be sentenced to detention of not less than ten days and not more than fifteen days, and a fine of not less than five hundred yuan and not more than two thousand yuan.

Article 74

A person in the hotel industry, food service industry, cultural and entertainment industry, or taxi industry who tipped off the perpetrator of a crime when the public security authorities were investigating or dealing with drug abuse, gambling, prostitution or patronizing prostitutes shall be sentenced to detention of not less than ten days and not more than fifteen days.

Article 75

Anyone who keeps an animal that interferes with the normal life of another person shall be given a warning; and anyone who fails to correct the situation after the warning or who lets the animal terrorize another person shall be fined not less than two hundred yuan and not more than five hundred yuan. Those who drive animals to harm others shall be punished in accordance with the provisions of the first paragraph of Article 43 of this Law.

Article 76

If a person who has committed the acts referred to in Articles 67, 68 and 70 of this Law and repeatedly fails to correct them, he may be subject to compulsory educational measures in accordance with the provisions of the State.

Chapter IV Punishment Procedures

Article 77

The public security organs shall promptly accept and register cases of violation of public security administration reported, charged, or reported, or where the perpetrator of the violation of public security administration voluntarily surrenders himself or herself, as well as cases of violation of public security administration referred to them by other administrative authorities or judicial organs.

Article 78

After accepting a report, accusation, report, or surrender, the public security organs shall immediately investigate the case if they consider it to be a violation of public security administration; if they do not consider it to be a violation of public security administration, they shall inform the person who made the report, the accuser, the informant, or the person who surrendered the case, and shall explain the reasons for doing so.

Article 79

Investigations of public security cases by public security organs and their people's police shall be conducted in accordance with the law. It is strictly prohibited to extort confessions by torture or to collect evidence by illegal means such as threat, enticement or deception. Evidence collected by illegal means shall not be used as the basis for punishment.

Article 80

The public security organs and the people's police in handling public order cases shall keep confidential the state secrets, commercial secrets or personal privacy involved.

Article 81

People's police officers, in the course of handling public order cases, shall recuse themselves in the event of any of the following circumstances; the perpetrator of the violation of public order management, the aggrieved person, or the person acting on his/her legal behalf shall also have the right to request them to recuse themselves:

(1) if they are the parties to the case, or a close relative of the parties to the case;

(2) if they themselves or a close relative of the parties have an interest in the case;

(3) if they have an interest in the case; and interest in the case;

(iii) has other relations with the parties to the case, which may affect the fair handling of the case. The recusal of a people's police officer shall be decided by the public security organ to which he belongs; the recusal of the head of a public security organ shall be decided by the public security organ of a higher level.

Article 82

Where it is necessary to summon the perpetrator of a violation of public security administration to be investigated, the person in charge of the case-handling department of the public security organ shall, with the approval of the head of the public security organ, use a summoning warrant to summon him. The people's police may, upon presentation of their working documents, orally summon the perpetrator of a violation of public security administration found at the scene, but this shall be noted in the transcript of the inquiry. The public security organ shall inform the person summoned of the reasons and basis for the summons. A person who fails to accept the summons without justifiable reasons or evades it may be forcibly summoned.

Article 83

The public security organ shall, after summoning a person who has violated public security management, promptly inquire and investigate the person, and the time for inquiry and investigation shall not exceed eight hours; where the situation is complicated and the punishment of administrative detention may be applied in accordance with the provisions of this Law, the time for inquiry and investigation shall not exceed twenty-four hours. The public security organ shall promptly notify the family of the person summoned of the reason for the summons and the premises.
