Article 2 The human resources and social security departments at all levels shall safeguard the rights of cardholders to inquire about and handle human resources and social security businesses, adopt technical means and management measures to protect the privacy of cardholders, use the information related to social security cards in accordance with the law, and ensure the safe use of social security cards. Article 3 The provincial and prefectural human resources and social security departments that have been approved to issue social security cards shall formulate clear procedures for the management of social security card applications and release them to the public by means of making them explicit in the places of service and publicizing them on the *** website. Social security card application management regulations should include the following contents: (a) social security card function, use; (b) social security card issuance object, application conditions, application procedures; (c) social security card use (including the use of restrictions), the use of the period of time and the use of methods; (d) social security card damage, loss of the loss of the card, reissuance program; (e) the card-issuing organization, cardholders and other relevant parties' rights and obligations. (v) The rights and obligations of the card-issuing organization, the cardholder and other parties concerned. Article 4 The Ministry of Human Resources and Social Security unifies the planning and deployment of cross-regional application of social security cards and implements the cross-regional application access system. The Leading Group Office of Informatization of the Ministry of Human Resources and Social Security is specifically responsible for checking the consistency and security of the card environment in each region, and access shall be granted to those who pass the check. Article 5 The social security card shall be mainly used in the business field of human resources and social security. Under the premise of keeping the main functions unchanged, the standard specifications unchanged, the key system unchanged, the management of the main body unchanged, the consent of the provincial human resources and social security departments, approved by the Ministry of Human Resources and Social Security, can be equipped with other public **** service functions. Article 6 The social security card is no longer used due to damage, loss, expiration and other reasons, should be included in the invalid list. The invalid list shall be managed on a hierarchical basis, with the Ministry of Human Resources and Social Security, provincial-level and prefectural and municipal-level human resources and social security departments managing the invalid lists of social security cards at the national, provincial and municipal levels, respectively, and providing query services. Chapter V Security Management Article 1 The social security card adopts key security technology and implements a nationally unified key management system. Article 2 The Ministry of Human Resources and Social Security is responsible for generating and managing the control key for the national read-write file and other keys that need to be used nationwide, and dispersing them to the human resources and social security departments at the provincial, prefectural and municipal levels level according to the unified rules to form subkeys. The human resources and social security departments at the provincial, prefectural and municipal levels are responsible for generating and managing the keys that are limited to use in their own regions, as well as the keys for reading and writing the files that the regions expand on their own; and they are responsible for the management of the subkeys that are dispersed by the Ministry of Human Resources and Social Security to them at various levels. Article 3 The encryption machine used for social security card key management and security suite shall have the commercial cryptographic product model certificate issued by the national cryptographic management department and meet the relevant specification requirements of the Ministry of Human Resources and Social Security. Article 4 The social security card master key card, master key card, transmission key card and security access control module (PSAM card) used for storing keys shall be uniformly issued by the Ministry of Human Resources and Social Security. Article 5 Card-issuing regions shall establish a strict key management system for social security cards, and strictly regulate the procedures for storing and using the keys, encryption machines, master key cards, master key cards, master key cards, transmission key cards and other key carriers; in case it is necessary to transfer the key carriers to a third party for use, it is necessary to make a good record of the handover, sign a confidentiality agreement, review the security management plan and supervise the third party's use of the key carriers. Article 6 Card-issuing regions shall establish a PSAM card management system, record in detail its specific information and use, establish a mechanism for its retrieval and destruction, and clearly stipulate the physical form, external conditions, and mode of use when it is actually used, so as to ensure the security of the card-using environment. Article 7 The human resources and social security departments at all levels shall establish emergency plans for the security management of social security cards, and properly deal with security problems arising from the issuance, use, and key management of social security cards. Where there is a security incident such as loss of key carrier, the region shall immediately report to the higher-level human resources and social security departments and the Ministry of Human Resources and Social Security, identify the cause, and deal with it in accordance with the relevant state regulations on security and confidentiality. Chapter VI Product Management Article 1 The chip of social security card shall implement a filing system. Chips to be selected by card-issuing regions shall be reported to the Leading Group Office of Informatization of the Ministry of Human Resources and Social Security for filing before they can be adopted in social security cards. Article 2 The chips to be selected by card-issuing regions shall be chosen from the products provided by chip manufacturers with the following conditions: (1) an integrated circuit design enterprise recognized by the competent department of the state information industry; (2) a commercial cryptographic product sales license and a certificate of designated unit for commercial cryptographic product production issued by the state cryptographic management department, and at least one IC card chip product that has passed the general guideline assessment assurance level organized by the relevant state departments; and (3) an IC card chip product that has passed the general guideline assessment assurance level organized by the relevant state departments. (b) It has a commercial cryptographic product sales license and commercial cryptographic product production designated unit certificate issued by the state cryptographic management department, and at least one integrated circuit card (IC card) chip product has passed the information security certification of EAL4+ organized by the relevant state departments; (c) It has standardized enterprise management, passed the certification of the ISO9001 quality system, and has obtained the corresponding certificate. Article 3 The chip of the social security card shall meet the following conditions: (1) It is the chip of the smart card (CPU card) processed and manufactured by the hard mask process, and the memory shall be composed of random memory (RAM), read-only memory (ROM), electrically erasable programmable read-only memory (EEPROM), and does not contain other types of memories; (2) It supports the encryption algorithms approved by the state cryptography administration department, and has the commercial cryptography certificate issued by the state cryptography administration department. (b) Support encryption algorithms recognized by the state cryptographic administration department and have a commercial cryptographic product model certificate issued by the state cryptographic administration department; (c) The manufacturer providing the chip has independent intellectual property rights over the chip. Article 4 The card issuing regions shall select the social security card operating system (COS) and read/write machines provided by vendors with independent development capability, and the above products selected by them shall comply with the specifications for social security cards of the Ministry of Human Resources and Social Security. Article 5 The Ministry of Human Resources and Social Security shall organize the provincial human resources and social security departments to inspect and supervise the quality of the products and the compliance with the standards of the social security cards that have been put into use. Chapter VII Supplementary Provisions Article 1 The issuance fees of social security cards shall be reported for approval and collected in accordance with the relevant state regulations. Article 2 The relevant technical specifications, procedures, system requirements and card face styles of social security cards shall be separately stipulated by the Leading Group Office of Informatization of the Ministry of Human Resources and Social Security in accordance with these Measures. Article 3 These Measures shall be interpreted by the Office of Informatization Leading Group of the Ministry of Human Resources and Social Security.
