Regulations of Guangzhou Municipality on Kindergarten

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Education Law of the People's Republic of China, the Education Promotion Law of the People's Republic of China and the actual situation of this Municipality in order to strengthen the construction and management of kindergartens in this Municipality, safeguard the legitimate rights and interests of children and promote the healthy development of early childhood education. Article 2 These Regulations shall apply to the planning, construction and investment guarantee of kindergartens within the administrative area of this Municipality, as well as the care, education, supervision and management of preschool children over three years old in kindergartens. Article 3 The construction and management of kindergartens should be guided by public welfare and inclusiveness, adhere to the principle of government leading and government holding, encourage social participation, build a balanced, high-quality and safe public service system for early childhood education, and ensure the demand for early childhood education.

Kindergarten work should implement the educational policy of the party and the state, adhere to the fundamental task of educating people, follow the law of children's physical and mental development, and promote the healthy development of children's physical and mental health. Article 4 The municipal and district people's governments shall co-ordinate kindergarten work within their respective administrative areas, formulate plans for the development of early childhood education, incorporate them into the plans for national economic and social development, scientifically and rationally allocate resources for early childhood education, and ensure capital investment.

The town people's government and sub-district offices shall support the running of kindergartens within their respective jurisdictions. Fifth municipal education administrative departments in charge of the city's kindergarten work, and organize the implementation of these regulations.

District education administrative departments shall be responsible for the management of kindergartens within their respective administrative areas, and supervise and guide kindergartens.

Development and reform, public security, civil affairs, finance, human resources and social security, natural resources planning, ecological environment, housing and urban construction, transportation, health, market supervision and management, emergency management, fire rescue and other departments and the Communist Youth League, women's federations, disabled persons' federations and other units shall cooperate with the implementation of these regulations in accordance with their respective functions and duties. Article 6 The municipal and district people's governments shall establish a joint meeting system for early childhood education, hold regular meetings every year, study and solve problems existing in the construction and management of kindergartens, co-ordinate the allocation of early childhood education resources, and strengthen the organization, coordination and supervision of early childhood education. Seventh to encourage donations and other forms to provide funding, services and convenience for kindergartens to carry out conservation education.

Encourage and support scientific research in early childhood education, publicize and popularize scientific educational concepts and methods, and create a good environment conducive to the healthy growth of young children. Chapter II Construction and Establishment of Kindergartens Article 8 The municipal education administrative department shall, according to the overall planning of land and space and the development plan of preschool education, organize the preparation of the layout plan of kindergartens, which shall be submitted to the Municipal People's Government for approval after being audited by the municipal development and reform, planning resources and other departments.

Kindergarten layout planning should comply with the provisions of the state and province, calculate the degree of demand, and comprehensively consider the population density, residential distribution, population development and mobility trend, urban and rural construction planning, transportation, environment and other factors. , reasonable layout, adjust according to actual needs.

The District People's Government shall be responsible for the implementation of kindergarten layout planning within its administrative area, and implement the main body and specific measures; Establish a demand ledger for early childhood education degrees to ensure that children enter the park nearby. Article 9 The municipal and district people's governments shall guarantee the construction land of kindergartens. No unit or individual may arbitrarily change the nature of the use of land for kindergarten planning and construction.

If the use of land for kindergarten construction needs to be changed or the land and houses used by kindergartens need to be requisitioned due to public interests, it shall be supplemented with the consent of the planning and natural resources departments in accordance with the principles of first replenishment before expropriation, first construction before demolition and proximity. The construction land area for compensation and reconstruction shall not be less than the original land area, and meet the standards for kindergarten construction.

In areas with insufficient kindergarten land, priority should be given to ensuring the demand for kindergarten land by adjusting the function of regional land use and increasing the area of kindergarten land during urban renewal. Article 10 The municipal and district people's governments shall gradually increase the number of public kindergarten degrees in our city on the basis of meeting the national and provincial requirements for the proportion of public kindergarten degrees.

The District People's Government shall set up at least one public kindergarten in each town and street. Towns and streets with a permanent population of more than100000 should increase the number of public kindergartens in proportion to the population.

Priority will be given to holding public kindergartens for vacant street space, rural public service facilities, vacant land for primary and secondary school layout adjustment, new urban and rural construction land in the province, and military land incorporated into integration of defense and civilian technologies's strategic and local cooperative operation.

No unit or individual may sell or rent public kindergartens without authorization, and may not change its nature without authorization. Eleventh to encourage and support organs, township streets, collective economic organizations, enterprises and institutions, institutions of higher learning. The establishment of kindergartens provides convenience for the children of employees in this unit to enter the park and provides inclusive services for the society.

The municipal and district people's governments shall support social forces to set up inclusive private kindergartens by ensuring rational land use, reducing rent and purchasing services.

Support units and individuals to organize different types of kindergartens in various forms to meet the diverse needs of society for early childhood education services. Twelfth new residential areas should be in accordance with the planning requirements supporting the construction of public kindergartens. Reconstruction and expansion of residential areas should be in accordance with the planning requirements supporting the construction of public kindergartens or inclusive private kindergartens.

The municipal planning and natural resources department shall, when issuing the construction project planning permit, review the land, location and construction scale of supporting kindergartens according to the planning conditions, and send a copy of the examination and approval results to the education, housing and urban-rural construction departments.

Supporting kindergartens independently set up in newly-built residential areas shall be planned and designed synchronously with the main construction project of planned plots, and the construction project planning permit shall be handled before or at the same time of the first residential project, and the construction shall be completed before the pre-sale of the first residential project and verified in advance.

The construction unit shall, in accordance with the relevant provisions, promptly hand over all kindergartens, venues, ancillary facilities and related materials to the housing and urban-rural construction departments in the region. The district housing and urban-rural construction department shall deliver it to the district education administrative department within one month after receiving the kindergarten from the supporting public service facilities. The district education administrative department shall put the supporting kindergartens in residential areas into use within one year from the date of taking over.
