Regulations of Lvliang Municipality on Prevention and Control of Water Pollution

Article 1 In order to protect and improve the water environment, prevent and control water pollution, protect water ecology, ensure the safety of drinking water, safeguard public health, promote the construction of ecological civilization, and promote the sustainable development of economy and society, these Regulations are formulated in accordance with the Law on the Prevention and Control of Water Pollution in People's Republic of China (PRC), the Regulations on the Prevention and Control of Water Pollution in Shanxi Province and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the prevention and control of pollution of surface water bodies and underground water bodies such as rivers, reservoirs and channels within the administrative area of this Municipality. Article 3 The prevention and control of water pollution shall adhere to the principles of giving priority to prevention, combining prevention with control and comprehensive management, giving priority to the protection of drinking water sources, strictly controlling industrial pollution, agricultural non-point source pollution and urban and rural domestic pollution, actively promoting ecological control and restoration, and preventing, controlling and reducing water environmental pollution and water ecological damage. Article 4 The people's governments of cities and counties (cities, districts) shall strengthen their leadership in water pollution prevention and control, establish a coordination mechanism for water pollution prevention and control, and make overall plans to solve major problems in water pollution prevention and control; Incorporate the prevention and control of water pollution into the national economic and social development plan and increase the financial investment in water pollution prevention and control; Promote the application of big data technology in water pollution prevention and control, and establish a working pattern of civil air defense, technical defense and joint defense; According to the requirements of the water environment quality improvement target determined by the water pollution prevention and control plan, the deadline for reaching the standard is formulated and measures are taken to reach the standard on schedule.

Township (town) people's governments and sub-district offices shall do a good job in drinking water safety, prevention and control of water pollution in agriculture and rural areas, renovation of sewage outlets into rivers, construction and operation of environmental infrastructure, etc. Article 5 The competent department of ecological environment shall exercise unified supervision and management over the prevention and control of water pollution within their respective administrative areas and perform the following duties:

(a) the implementation of laws, regulations and policies and measures related to the prevention and control of water pollution;

(two) according to the preparation of water environment planning, sewage outfall planning in key river basins;

(3) Establish a grid supervision system for water pollution, and define the grid management objects, management standards and responsible persons;

(four) to organize the monitoring and early warning of water environmental quality and the source of water pollution, and to release the information of water environmental quality in this administrative region;

(five) to organize the implementation of the total discharge control of key water pollutants;

(six) to carry out water pollution prevention and law enforcement according to law;

(seven) the illegal information of water environment of enterprises, institutions and other producers and operators will be included in the social credit files and announced to the public;

(eight) other duties as prescribed by laws and regulations.

Other relevant departments of the people's governments of cities and counties (cities, districts) shall supervise and manage the prevention and control of water pollution according to their respective responsibilities. Article 6 Cities, counties and townships implement the system of river length, and organize and lead the work of water resources protection, waterfront management, water pollution prevention and control, water environment management, water ecological restoration and water risk prevention and control within their respective administrative areas. Article 7 Enterprises, institutions and other producers and operators that directly or indirectly discharge water pollutants shall bear the main responsibility for the prevention and control of water pollution, establish and improve the management system for water environmental protection, disclose water environmental information according to law, ensure the normal operation of water pollution prevention and control facilities and stable discharge up to standard, and prevent and reduce water environmental pollution and water ecological damage. Article 8 The people's governments of cities and counties (cities, districts) shall establish and improve the compensation mechanism for water environmental ecological protection in drinking water source protection areas, upstream areas of rivers and reservoirs, water conservation areas and related important ecological function areas. Ninth to encourage and support the scientific and technological research of water pollution prevention and control and the popularization and application of advanced and applicable technologies; Encourage and support all kinds of market players to participate in water pollution control, water ecological restoration and water pollution prevention; Encourage and support financial institutions to provide credit support for water pollution control projects. Tenth in the administrative area of this Municipality, the discharge of water pollutants shall not exceed the national and provincial pollutant discharge standards and the total control index of key water pollutants.

The people's government at a higher level shall organize the formulation and implementation of the implementation plan for the total discharge control of water pollutants within their respective administrative areas. For areas that exceed the control target of total discharge of key water pollutants or fail to reach the improvement target of water environment quality, the people's government at a higher level and the competent department of ecological environment will interview the main persons in charge of the people's government at a lower level, and the competent department of ecological environment will suspend the examination and approval of the environmental impact assessment documents of new construction projects involving the discharge of water pollutants in this area, and the interview will be made public. Article 11 The people's governments of cities and counties (cities, districts) shall assess the completion of water environment quality improvement targets and key tasks of water pollution prevention and control, incorporate the completion of targets and key tasks into the annual assessment of the relevant departments of the people's governments at the corresponding levels and their responsible persons, and announce the assessment results to the public.

The superior river chief is responsible for organizing the assessment of the subordinate river chief, and the assessment results serve as an important basis for its annual comprehensive assessment and evaluation. Twelfth city, county (city, district) people's government and its relevant departments shall establish a joint meeting, information sharing, notification and joint punishment system, establish and improve the monitoring and early warning mechanism of water environmental quality and water pollution source, and improve the ability of water pollution prevention and control. Thirteenth enterprises, institutions and other producers and operators shall, in accordance with the relevant provisions and monitoring norms, monitor the pollution discharge of their own units, establish monitoring data files, make the monitoring data public, and be responsible for the authenticity and accuracy of the monitoring data. The preservation period of the original monitoring records shall not be less than three years.

Key pollutant discharge units shall install automatic monitoring equipment for water pollutant discharge networked with the monitoring equipment of the competent department of ecological environment, monitor the sewage outlets that discharge toxic and harmful water pollutants and the surrounding environment, and truthfully disclose information such as sewage discharge, construction and operation of water pollution prevention facilities, and emergency plans for sudden water pollution accidents.
