Provisions on the functional allocation, internal structure and staffing of the National Health and Wellness Committee
Article 1 These Provisions are formulated in accordance with the Decision of the Central Committee on Deepening the Reform of Party and State Institutions, the Plan for Deepening the Reform of Party and State Institutions and the Plan for Institutional Reform in the State Council approved by the First Session of the 13th National People's Congress.
Article 2 The National Health and Wellness Commission is an integral part of the State Council, and it is ministerial.
Article 3 In the course of performing its duties, the National Health and Wellness Committee implements the principles, policies and decision-making arrangements of the CPC Central Committee on health and wellness work, and upholds and strengthens the centralized and unified leadership of the Party on health and wellness work. The main responsibilities are
(1) Organizing the formulation of national health policies, drafting regulations, policies and plans for the development of health undertakings, formulating departmental rules and standards and organizing their implementation. Make overall plans for the allocation of health resources and guide the preparation and implementation of regional health planning. Formulate and organize the implementation of policies and measures to promote the equalization, generalization and convenience of basic public health services and the extension of public resources to the grassroots.
(two) coordinate and promote the deepening of the reform of the medical and health system, study and put forward major principles, policies and measures to deepen the reform of the medical and health system. Organize and deepen the comprehensive reform of public hospitals, promote the separation of management and operation, improve the modern hospital management system, formulate and organize the implementation of policies and measures to promote the diversification of health public service providers and methods, and put forward policy suggestions on medical services and drug prices.
(3) to formulate and organize the implementation of disease prevention and control plans, national immunization plans and intervention measures for public health problems that seriously endanger people's health, and to formulate a catalogue of quarantine infectious diseases and monitoring infectious diseases. Responsible for health emergency work, organize and guide the prevention and control of public health emergencies and medical rescue of various public health emergencies.
(four) to organize and coordinate the implementation of policies and measures to deal with the aging population, and to be responsible for promoting the construction of health service system for the elderly and the combination of medical care and nursing.
(five) to organize the formulation of national drug policy and national essential drug system, carry out drug monitoring, clinical comprehensive evaluation and early warning of drug shortage, put forward suggestions on national essential drug price policy, and participate in the formulation of national pharmacopoeia. Organize food safety risk monitoring and assessment, and formulate and publish food safety standards according to law.
(six) responsible for the supervision and management of public health such as occupational health, radiation health, environmental health, school health, public health, drinking water hygiene, etc., responsible for the prevention and control of infectious diseases, and improve the comprehensive health supervision system. Leading the implementation of the Framework Convention on Tobacco Control.
(seven) to formulate measures for the administration of medical institutions and medical service industries and supervise their implementation, and establish a medical service evaluation and supervision and management system. Formulate and implement the qualification standards for health professional and technical personnel in conjunction with relevant departments. Formulate and organize the implementation of medical service norms and standards, practice rules and service norms for health professional and technical personnel.
(eight) responsible for family planning management and services, to carry out population monitoring and early warning, to study and put forward relevant policy suggestions on population and family development, and to improve the family planning policy.
(nine) to guide the local health work, to guide the basic medical and health care, maternal and child health care service system and the construction of general practitioners. Promote the innovation and development of health science and technology.
(ten) to be responsible for the medical and health care work of the central health care object, and to be responsible for the medical and health care work of important meetings and activities of the party and the state.
(eleven) the management of state administration of traditional chinese medicine, the China Association for the Aged, and the guidance of the Chinese Family Planning Association.
(twelve) to complete other tasks assigned by the CPC Central Committee and the State Council.
(13) functional transformation. The National Health and Wellness Committee should firmly establish the concept of great health and great health, promote the implementation of the strategy of healthy China, take reform and innovation as the driving force, focus on promoting health, change the mode, strengthen the grassroots, and emphasize security, and shift the focus of treatment to people's health, so as to provide all-round and full-cycle health services for the people. First, pay more attention to prevention and health promotion, strengthen the prevention and control of major diseases, actively respond to the aging population, and improve the health service system. Second, pay more attention to the shift of work focus and the sinking of resources, and promote public health resources to extend to the grassroots, cover rural areas, and tilt to remote areas and people with difficulties in life. Third, pay more attention to improving service quality and level, and promote equalization, generalization and convenience of basic public health services. Fourth, coordinate and promote the deepening of the reform of the medical and health system, intensify the reform of public hospitals, promote the separation of management and operation, and promote the diversification of public health service providers and methods.
(14) Division of responsibilities.
1. Division of responsibilities with the National Development and Reform Commission. The National Health and Wellness Commission is responsible for carrying out population monitoring and early warning, formulating fertility policies, studying and proposing policy suggestions on the quantity, quality, structure and distribution of population related to fertility, promoting the convergence of fertility policies with relevant economic and social policies, participating in the formulation of population development plans and policies, and implementing relevant tasks in the national population development plan. The National Development and Reform Commission is responsible for organizing, monitoring and evaluating the impact of population changes and trends, establishing a population forecasting system, carrying out population impact assessment of major decisions, improving the consultation mechanism of major population policies, studying and proposing national population development strategies, formulating population development plans and population policies, studying and putting forward opinions on the coordinated and sustainable development of population, economy, society, resources and environment, and putting forward policy suggestions for promoting the long-term balanced development of the population as a whole.
2. Division of responsibilities with the Ministry of Civil Affairs. The National Health and Wellness Committee is responsible for formulating policies and measures to deal with the aging of the population and the combination of medical care and nursing, comprehensively coordinating, supervising and guiding, organizing and promoting the development of the cause of aging, and undertaking the health work for the elderly such as prevention and treatment of senile diseases, medical care for the elderly, mental health and nursing services for the elderly. The Ministry of Civil Affairs is responsible for the overall promotion, supervision and guidance, supervision and management of the old-age service, drawing up the plans, regulations, policies and standards for the construction of the old-age service system and organizing their implementation, and undertaking the welfare of the elderly and the relief work for the elderly with special difficulties.
3. Division of responsibilities with the General Administration of Customs. The National Health and Wellness Committee is responsible for the comprehensive prevention and control of infectious diseases and the emergency work of public health emergencies, and compiles the Catalogue of Infectious Diseases under Frontier Health and Quarantine Monitoring. The National Health and Wellness Committee and the General Administration of Customs should establish and improve the cooperation mechanism for handling infectious diseases and public health incidents at ports, the notification and exchange mechanism for infectious diseases and public health incidents, and the notification and collaborative handling mechanism for imported epidemic situations at ports.
4. Division of responsibilities with the State Administration of Markets. The National Health and Wellness Commission is responsible for food safety risk assessment, and jointly with the State Administration of Market Supervision and other departments, formulate and implement a food safety risk monitoring plan. If the National Health and Wellness Committee finds that food may have potential safety hazards through food safety risk monitoring or receiving reports, it shall immediately organize inspection and food safety risk assessment, and timely inform the State Administration of Market Supervision and other departments of the results of food safety risk assessment, and the State Administration of Market Supervision and other departments shall immediately take measures against the food that comes to the unsafe conclusion. If the State Administration of Market Supervision and other departments find it necessary to carry out food safety risk assessment in the supervision and management work, they shall make suggestions to the National Health and Wellness Committee in a timely manner.
5. Division of responsibilities with the National Health Insurance Bureau. National Health Commission, the State Medical Insurance Bureau and other departments have strengthened the system and policy convergence in medical care, medical insurance and medicine, established communication and consultation mechanisms, and jointly promoted reforms to improve the utilization efficiency of medical resources and the level of medical security.
6. Division of responsibilities with the State Administration of Pharmaceutical Products. The State Drug Administration, together with the National Health and Wellness Commission, organized the National Pharmacopoeia Committee, formulated the National Pharmacopoeia, and established a mutual notification mechanism and a joint disposal mechanism for major adverse drug reactions and medical device adverse events.
Article 4 The National Health and Wellness Commission has the following internal organs
(1) general office. Responsible for the daily operation of the organs, and undertake the work of security, confidentiality, letters and visits, and openness of government affairs.
(2) personnel department. Formulate policies for the development of health professionals, undertake personnel management, organization establishment and team building of organs and directly affiliated units, and be responsible for the qualification management of health professionals and technicians.
(3) Ministry of Planning, Development and Information Technology. Undertake the strategic coordination and promotion of healthy China, organize the formulation of medium and long-term plans for the development of health undertakings, guide the construction of health service system and informatization, and organize the patriotic health campaign and health statistics. Take the lead in implementing the Framework Convention on Tobacco Control.
(4) the finance department. To undertake the budget and final accounts, finance, asset management and internal audit of organs and budget management units.
(5) the department of laws and regulations. Organize the drafting of laws, regulations, rules and standards, undertake the legality review of normative documents, and undertake administrative reconsideration and administrative litigation.
(6) Department of System Reform. To undertake the specific work of deepening the reform of the medical and health system, study and put forward major principles, policies and measures for deepening the reform of the medical and health system, and undertake to organize and promote the comprehensive reform of public hospitals.
(7) CDC. Formulate major disease prevention and control plans, national immunization plans, and intervention measures for public health problems that seriously endanger people's health, organize their implementation, improve the disease prevention and control system, and undertake the information release of infectious diseases.
Medical Administration and Hospital Authority. To formulate management policies, norms and standards for medical institutions and medical personnel, application of medical technology, medical quality and safety, medical services, management of blood collection and supply institutions and construction of morals, and supervise their implementation, and undertake the work of promoting the development of nursing rehabilitation. Formulate the operation supervision, performance evaluation and assessment system of public hospitals.
(9) Primary health departments. Formulate and organize the implementation of primary health policies, standards and norms, and guide the construction of primary health service system and the management of rural doctors.
(ten) health emergency office (public health emergency command center). Undertake health emergency and emergency medical rescue work, organize the preparation of special plans, and undertake the organization, implementation, guidance and supervision of plan drills. Guide the health emergency system and capacity building. Release information on emergency handling of public health emergencies.
(1 1) Division of Science, Technology and Education. Formulate health science and technology development plans and related policies and organize their implementation. Undertake the supervision of laboratory biosafety. Organize and implement continuing education such as medical education after graduation and training of residents and specialists, and coordinate and guide education in medical colleges and universities.
(12) comprehensive supervision bureau. Undertake public health and medical supervision, and investigate and deal with illegal acts in the medical service market. Organize the supervision and inspection of school hygiene, public hygiene, drinking water hygiene and the prevention and control of infectious diseases. Improve the comprehensive supervision system, guide and standardize law enforcement behavior.
(xiii) Division of Drug Policy and Essential Drug Systems. Improve the national system of essential drugs, and organize the formulation of national drug policies and the list of essential drugs. Carry out drug monitoring, clinical comprehensive evaluation and early warning of drug shortage. Put forward suggestions on the drug price policy and the policy of encouraging and supporting drug production in the national essential drugs list.
(fourteen) food safety standards and monitoring and evaluation departments. Organize the formulation of national food safety standards, carry out food safety risk monitoring, evaluation and communication, and undertake the safety review of new varieties of food raw materials, new varieties of food additives and new varieties of food-related products.
(15) Department of Health for the Elderly. Organize to formulate and coordinate the implementation of policies and measures to deal with aging. Organize the formulation of policies, standards and norms for the combination of medical care and nursing, and establish and improve the health service system for the elderly. To undertake the specific work of the National Working Committee on Ageing.
(16) Department of Maternal and Child Health. Formulate maternal and child health policies, standards and norms, promote the construction of maternal and child health service system, and guide maternal and child health care, birth defect prevention, early infant development, human assisted reproductive technology management and reproductive technology services.
(17) Department of Occupational Health. Formulate policies and standards related to occupational health and radiation health and organize their implementation. Carry out key occupational disease monitoring, special investigation, occupational health risk assessment and occupational population health management. Coordinate the prevention and control of occupational diseases.
(XVIII) Ministry of Population Monitoring and Family Development. Undertake population monitoring and early warning, put forward policy suggestions related to population and family development, improve the birth policy and organize its implementation, and establish and improve the special assistance system for family planning.
(19) Propaganda Department. Organize health promotion, health education and health promotion activities, and undertake the popularization of health science, news and information release.
(20) International Cooperation Department (Hong Kong, Macao and Taiwan Office). Organize and guide international exchanges and cooperation, foreign publicity and foreign aid in the field of health work, carry out exchanges and cooperation with Hong Kong, Macao and Taiwan, and undertake foreign affairs management of organs and directly affiliated units.
(2 1) Health Bureau. Responsible for the medical and health care work of the central health care targets, the medical management of the relevant cadres of the central departments, and the medical and health protection work of important meetings and activities of the party and the state.
Party committees of organs. Responsible for the party-mass work of Beijing municipal organs and directly affiliated units.
Bureau of retired veteran cadres. To be responsible for the work of retired cadres in organs and guide the work of retired cadres in directly affiliated units.

Regulations on the handling of medical accidents
Article 62 Measures for handling medical accidents in military medical institutions shall be formulated by the competent health department of China People's Liberation Army in conjunction with the administrative department of health of the State Council in accordance with these regulations.
