How to apply for occupational diseases

1. According to the Administrative Measures for Diagnosis and Identification of Occupational Diseases in People's Republic of China (PRC) No.24 (effective on May 1 2002):

Article 10 Laborers may choose an occupational disease diagnosis institution in the place where the employing unit is located or where it lives to make a diagnosis. The term "domicile" as mentioned in these Measures refers to the habitual residence of workers.

Article 11 When applying for occupational disease diagnosis, it shall provide:

(1) professional history and past history;

(two) a copy of the occupational health monitoring file;

(three) the results of occupational health examination;

(4) Detection and evaluation of occupational hazards in workplaces over the years;

(five) other necessary related materials required by the diagnosis institution. The employing units and relevant institutions shall truthfully provide necessary information according to the requirements of diagnostic institutions.

Article 25 When applying for occupational disease diagnosis and appraisal, the parties concerned shall provide the following materials:

(1) An application for occupational disease diagnosis and appraisal;

(2) Occupational disease diagnosis certificate;

(3) The materials specified in Article 11 of these Measures;

(4) Other relevant information.

Occupational disease diagnosis process application

1. Applicants can collect the application form from the Occupational Disease Diagnosis Office (5th floor of the office building) during working hours (Monday to Friday, 7: 30 am-11:00 and 2:00 pm).

Second, submit information:

(1) The party applying for occupational disease diagnosis for the first time must truthfully submit the following materials:

1. Application for occupational disease diagnosis;

2. Professional history and past history;

3. Occupational health monitoring files;

4. Recent occupational health examination results;

5. Detection and evaluation data of occupational hazard factors in workplaces over the years;

6. The materials provided by the employer to prove the basic situation of the party concerned;

7. Copy of ID card;

8. Other necessary related materials.

(2) Applicants for advanced diagnosis of pneumoconiosis:

1. Copy of the original occupational disease diagnosis certificate;

2. Occupational history materials exposed to dust;

3 medical and health examination data in recent years (including copies);

4. Copy of employee ID card. The entrusting party shall submit a copy of 1 employee (patient) and the entrusting party's ID card;

5 other materials required by the diagnosis institution according to the actual situation.

The parties concerned shall be responsible for the authenticity and correctness of all the materials provided. If the materials provided are photocopies, it shall be stamped with the official seal of the unit providing the materials, and marked "This piece is in conformity with the original".

The X-ray chest radiograph of workers exposed to dust should be confirmed as the applicant's own chest radiograph. X-rays that have been taken many times shall be submitted at the same time. The application for occupational disease diagnosis may not be accepted based on the results of a chest X-ray.

(3) If there is no contact history with occupational hazards or no abnormality is found in the occupational health examination, the application for occupational disease diagnosis may not be accepted.

(4) Submit complete materials and pay the occupational disease diagnosis fee (1,000 Wu Bai dollars) before the formal acceptance.

(5) The applicant may apply for occupational disease diagnosis at the medical and health institution where the employer is located or where the applicant lives.

(6) When the occupational disease diagnosis requires the employer to provide occupational health and health monitoring information, the employer shall truthfully provide it, and the workers and relevant institutions shall also truthfully provide information related to the occupational disease diagnosis.

(7) The employing unit shall support and arrange patients suspected of occupational diseases for occupational disease diagnosis. During the period of diagnosis or medical observation, the employer may not terminate or terminate the labor contract with the suspected occupational disease patient.

(eight) the expenses of patients suspected of occupational diseases during diagnosis or medical observation shall be borne by the employer.

(nine) the occupational disease diagnosis work shall be completed within 30 days after acceptance, and the occupational disease diagnosis certificate shall be served to the applicant and his unit within 20 days after completion.

(10) The materials submitted by the parties in the process of occupational disease diagnosis will be kept in the corresponding occupational disease diagnosis files and will not be returned to the parties after the diagnosis.
