Answers to several questions about health management of radiation workers
Since Health News published the Regulation on Health Management of Radiation Workers on August 5th 1997 (hereinafter referred to as the Regulation), our department has been receiving letters from radiation workers all over the country, asking about the calculated length of service, retirement age, health care allowance and health care leave of radiation workers. The unified answer to the main questions is as follows:
1. The Regulation published in Health News is ministerial order No.52 issued by the Ministry of Health on June 5, 1997. All relevant radiation work units and radiation workers in China shall abide by it from June 1997 to September 1 day.
Two, the "Regulations" provisions of article thirty-third, radiation workers health allowance standards can be implemented according to national regulations, but also according to local regulations. At present, the unified national standard is still the Trial Measures for Medical Care Allowance jointly issued by the Ministry of Health, the Ministry of Finance and the State Administration of Labor 1979 ((79) Zheng WeiziNo. 1780, (79) Cai Shizi No.399 and (79) Lao Comprehensive SalaryNo. 185).
3. Article 34 of the Regulations stipulates that the length of health leave for radiation workers shall be decided by each radiation work unit according to the principle stipulated in Article 34.
Four, the "Regulations" provisions of article thirty-fifth, the calculation of the length of service of radiation workers, according to state regulations. The relevant provisions of the state mentioned here are mainly:
1, 1953 issued the "Regulations on Labor Insurance in People's Republic of China (PRC)", which stipulates that the calculation of length of service is limited to retirement pension, and the corresponding pension benefits are enjoyed according to the converted length of service.
2. According to the regulations of the Ministry of Labor (65) 1956 No.248 (still valid now), engaging in X-ray work is classified as harmful to health, and each year of engaging in this kind of work can be calculated as one year and six months of service.
3.1On June 2, 978, the State Council's Interim Measures for Retirement and Resignation of Workers (Guo Fa [1978]104) stipulated that men should be engaged in underground, high altitude, high temperature, particularly heavy manual labor and other jobs harmful to health for 50 years. July 1978, 1 1 Opinions of the State Administration of Labor on Several Specific Issues Concerning the Implementation of the Interim Measures of the State Council on Retirement and Resignation of Workers (Draft for Comment) added that workers engaged in other jobs harmful to their health, regardless of whether they have been engaged in such jobs now or before, must be engaged in such jobs for a total of eight years. The above years refer to the actual working years.
The above-mentioned documents stipulate that when calculating the length of service for the personnel engaged in radiation work, they can calculate the length of service according to 1 year, and enjoy the corresponding pension treatment (mainly pension) stipulated by the state according to the converted length of service every 6 months; In addition, personnel engaged in radiation work can also retire early according to the provisions of document 1997.
