Date of Implementation of Patriotic Health Regulations in Henan Province

Regulations on Patriotic Health in Henan Province is a local regulation adopted at the 22nd meeting of the Standing Committee of the Eighth People's Congress of Henan Province on September 26th, February/Kloc-0. Article 1 In order to protect people's health, practice the concept of great health, mobilize all social forces, prevent and control major diseases, further improve the comprehensive management level of social health, and promote the construction of socialist material civilization and spiritual civilization, these Regulations are formulated in accordance with relevant national laws and regulations and combined with the actual situation of our province.

Article 2 Patriotic health work is a social health activity to enhance social health awareness, eliminate health hazards, improve the environment and quality of life, eliminate pests and diseases, and improve the health quality and level of the whole people.

It is the duty of every citizen to participate in patriotic health activities.

Article 3 Patriotic health work shall follow the principles of government organization, graded responsibility, departmental coordination, participation by the whole people, scientific governance and social supervision.

Article 4 People's governments at all levels shall strengthen their leadership over patriotic health work, incorporate patriotic health work into the overall plan for national economic and social development, and formulate patriotic health development plans in their respective regions in accordance with the relevant provisions of the state and this province.

Fifth patriotic health campaign committee at all levels under the leadership of the people's government at the same level, unified responsibility, overall coordination of patriotic health work within their respective administrative areas.

Patriotic health campaign committee office at or above the county level is the office of patriotic health campaign committee at the corresponding level, and it shall be equipped with full-time staff to be responsible for daily work. The establishment of the office is decided by the people's government at the corresponding level.

Sixth township (town) people's government and the patriotic health organization of the street office are responsible for the patriotic health work in this area.

Patriotic health organizations established by organs, organizations, military units, enterprises and institutions shall be responsible for the patriotic health work of their own units under the guidance of local patriotic health campaign committee.

Seventh units and individuals that have made remarkable achievements in patriotic health activities, scientific research and management shall be commended and rewarded by the people's governments at all levels or patriotic health campaign committee.

Eighth units and individuals within the administrative region of this province shall abide by these regulations.

Chapter II Responsibility

Article 9 The main duties of patriotic health campaign committee at or above the county level are:

(a) to organize the implementation and supervision of laws, regulations, rules and policies related to patriotic health work;

(two) planning, deployment, coordination and guidance of patriotic health work within their respective administrative areas;

(three) to organize and carry out national health education activities;

(4) Mobilize the whole society to participate in patriotic health activities, carry out healthy' cell' projects such as healthy cities, healthy villages and towns, healthy communities, healthy units and healthy families, carry out activities to create healthy towns and healthy units, and promote rural water improvement, toilet improvement, environmental sanitation management and pest control;

(five) to formulate relevant standards and inspection methods for patriotic health work and organize inspection activities;

(six) to carry out patriotic health work and related scientific research exchanges and cooperation;

(seven) to undertake other patriotic health work.

Tenth patriotic health campaign committee at or above the county level under the leadership of the people's government at the same level, composed of relevant departments, the implementation of target management and departmental responsibility system. All relevant departments must be responsible for the patriotic health work undertaken by their own departments in accordance with the division of responsibilities of patriotic health campaign committee.

Article 11 The planning, finance and other departments of the people's governments at all levels shall, in accordance with the provisions, incorporate the funds needed for patriotic health work such as urban and rural disease vector prevention and control, health education and health infrastructure (including rural water improvement and toilet improvement) into the local national economic and social development plan and implement it by stages.

Twelfth people's governments at all levels of health, culture, education, press and publication, radio and television departments should take various forms to carry out social health education, popularize health science knowledge, improve health care awareness.

Primary and secondary schools should offer health education courses in accordance with relevant regulations, and kindergartens should educate children about health knowledge.

Chapter III Management

Thirteenth this province implements the following patriotic health system:

(a) to carry out patriotic health month activities in April each year;

(two) urban units to implement the door cleaning, greening and beautification, health order "three guarantees" system and the door health system.

Fourteenth people's governments at or above the county level shall carry out activities to create sanitary cities and sanitary counties, improve and implement various health management systems in accordance with relevant standards, and improve the health level of cities and counties.

Township (town) people's governments and villagers' committees shall carry out the construction activities of health townships (towns) and health villages focusing on popularizing health knowledge, improving the sanitary conditions of drinking water, building sanitary toilets, renovating the environment and preventing diseases.

Fifteenth units and individuals shall, in accordance with national and provincial standards, do a good job in indoor sanitation and outdoor environmental sanitation within the prescribed scope.

Citizens should consciously safeguard public health, and it is forbidden to dump garbage, feces, burn leaves and discard wastes in non-designated places in urban areas; Do not scribble; No spitting or urinating.

Sixteenth to strengthen the publicity and education of smoking control, smoking is harmful to health, and advocate a healthy lifestyle.

Smoking (including electronic cigarettes) is prohibited in urban public places, indoor areas of workplaces and public transport. No smoking places should set up eye-catching no smoking signs. Fully implement the construction of smoke-free institutions and smoke-free units.

It is forbidden to publish tobacco advertisements and sell tobacco products (including electronic cigarettes) to minors.

Seventeenth urban areas strictly limit the raising of dogs. Specific measures for the administration of restricting dog raising shall be formulated separately by the provincial people's government.

It is forbidden to raise chickens, ducks, geese, rabbits, sheep, pigs and other poultry and livestock in urban areas. Scientific research, teaching, production and other units and urban agricultural households need to raise, must be approved by the relevant departments.

Article 18 Township (town) people's governments, sub-district offices, residents' committees and villagers' committees shall regularly organize units and residents within their jurisdiction to carry out activities to eliminate rats, flies, mosquitoes, cockroaches and other vectors and their breeding grounds, and control the density of vectors within the standards prescribed by the state.

Article 19 Measures for the administration of the production, sale and use of rodenticides and drugs for killing disease vectors shall be implemented in accordance with the relevant provisions of this province.

Chapter IV Supervision

Twentieth patriotic health work to implement professional supervision, mass supervision and public opinion supervision of the combination of social supervision system.

Patriotic health campaign committee at or above the county level urged all localities and departments to carry out patriotic health work through supervision and inspection activities.

All departments in patriotic health campaign committee are responsible for inspecting and supervising the patriotic health work undertaken by their own departments according to the division of responsibilities.

All units shall consciously accept and cooperate with the supervision and inspection of patriotic health campaign committee.

Twenty-first patriotic health campaign committee at or above the county level shall have patriotic health supervisors, who shall be appointed by the people's government at the same level.

Township (town) people's governments, sub-district offices, residents' committees, villagers' committees and relevant units shall set up patriotic health inspectors to assist patriotic health supervisors in their work.

Twenty-second any unit or individual has the right to stop or report violations of these regulations to patriotic health campaign committee.

Chapter V Punishment

Twenty-third units and individuals that have won the honorary title of patriotic health shall be cancelled by the organ that awarded the honorary title or the higher authorities in any of the following circumstances:

(a) resort to deceit, to obtain the honorary title of patriotic health;

(two) the decline in health quality has not reached the standard of patriotic health honorary title.

Twenty-fourth acts in violation of these regulations, in accordance with the provisions of laws, regulations and government rules, the administrative law enforcement departments prescribed by them shall be punished according to law; If the prescribed administrative law enforcement department fails to handle it according to law, patriotic health campaign committee at or above the county level has the right to urge the department to handle it according to law.

Twenty-fifth refusal or obstruction of patriotic health law enforcement personnel to perform official duties according to law or retaliation against informants, which constitutes a violation of public security management, shall be punished by the public security organs in accordance with the "People's Republic of China (PRC) Public Security Management Punishment Law"; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law.

Twenty-sixth patriotic health law enforcement officers who abuse their powers and engage in malpractices for selfish ends shall be criticized and educated by patriotic health campaign committee at or above the county level or disqualified from supervision and inspection; If the circumstances are serious, it may be suggested that the unit to which it belongs be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law.

Twenty-seventh if a party refuses to accept the decision on administrative punishment, it may apply for reconsideration or bring a lawsuit in accordance with the Administrative Reconsideration Law of People's Republic of China (PRC) and the Administrative Procedure Law of the People's Republic of China. If a party fails to apply for reconsideration, bring a lawsuit or perform the punishment decision within the time limit, the organ that made the punishment decision may apply to the people's court for compulsory execution.

Chapter VI Supplementary Provisions

Article 28 These Regulations shall come into force as of1June 1996+1 year1October.
