Regulations of Rizhao Municipality on the Prevention and Control of Air Pollution

Chapter I General Provisions Article 1 In order to prevent and control air pollution, protect and improve the atmospheric environment, safeguard public health, promote the construction of ecological civilization and promote the sustainable development of economy and society, in accordance with the People's Republic of China (PRC) Environmental Protection Law, the People's Republic of China (PRC) Air Pollution Prevention Law, the Shandong Air Pollution Prevention Regulations and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the prevention and control of air pollution and its supervision and management activities within the administrative area of this Municipality. Article 3 The prevention and control of air pollution shall follow the principles of ecological priority, planning first, source control, combination of prevention and control, comprehensive control and responsibility for damage. Article 4 People's governments at all levels shall be responsible for the quality of atmospheric environment in their respective administrative areas.

The people's governments of cities and counties (districts) shall incorporate the prevention and control of air pollution into the plans for national economic and social development, formulate plans for the prevention and control of air pollution, ensure the financial investment, improve the atmospheric environmental monitoring system, establish and improve the grid environmental supervision, and improve the quality of the atmospheric environment.

Township people's governments and sub-district offices shall, in accordance with the work arrangements of the people's governments at higher levels and relevant departments, do a good job in the prevention and control of air pollution. Article 5 The competent department of ecological environment of the Municipal People's Government shall exercise unified supervision and management over the prevention and control of air pollution.

The departments of development and reform, industry and informatization, public security, finance, natural resources and planning, housing and urban-rural construction, transportation, water conservancy, agriculture and rural areas, marine development, commerce, market supervision, urban management, administrative examination and approval, and comprehensive administrative law enforcement of the people's governments of cities and counties shall, according to their respective functions and duties, do a good job in the supervision and management of air pollution prevention and control. Article 6 The people's governments of cities and counties (districts) shall establish communication, coordination and assessment mechanisms for the prevention and control of air pollution, and make overall plans to study and solve major problems in the prevention and control of air pollution.

The competent department of ecological environment shall, jointly with other departments responsible for the supervision and management of air pollution prevention and control, establish a joint meeting system of air pollution environmental law enforcement, an information sharing system and a case transfer system to solve the problem of air pollution prevention and control. Article 7 All units and individuals have the obligation to abide by the laws and regulations on the prevention and control of air pollution, and should consciously adopt a green and economical way of production, life and consumption, reduce the emission of atmospheric pollutants and improve the quality of the atmospheric environment.

Actively advocate the public and social groups to participate in air pollution prevention and public welfare activities. Article 8 The people's governments of cities and counties (districts) shall strengthen the propaganda work of atmospheric environmental protection and popularize the knowledge of air pollution prevention and control.

Education authorities and schools should incorporate the scientific knowledge of air pollution prevention and control into school education, and cultivate students' awareness of atmospheric environmental protection.

Encourage grassroots self-governing organizations, social organizations and environmental protection volunteers. Carry out the publicity of laws and regulations on atmospheric environmental protection and knowledge of air pollution prevention and control, and create a good environmental protection atmosphere. Chapter II Supervision and Management Article 9 The management of pollutant discharge permits shall be implemented by stages and in batches according to the catalogue of classified management of pollutant discharge permits formulated and published by the competent department of ecological environment of the State Council. Article 10 In accordance with the principles of territorial management, graded responsibility, clear rights and responsibilities and comprehensive coverage, establish and improve the four-level supervision network of cities, counties (districts), towns (streets) and villages (communities), clarify the supervision objects, contents, standards and responsible persons, and implement a grid supervision mechanism for atmospheric environmental protection. Eleventh city ecological environment department is responsible for the organization of atmospheric environmental quality monitoring and atmospheric pollution source supervision monitoring, establish and improve the atmospheric environmental monitoring network.

In areas where serious pollution may occur, the people's governments of cities and counties (districts) can encrypt and set up automatic air quality monitoring stations; Set up automatic air quality monitoring stations in areas adjacent to other cities to increase the monitoring and analysis of imported pollution sources.

It is forbidden to occupy, damage or move or modify the atmospheric environmental quality monitoring facilities and automatic monitoring equipment for atmospheric pollutant discharge without authorization. Twelfth units that discharge industrial waste gas or toxic and harmful air pollutants shall conduct their own monitoring in accordance with the relevant provisions of the state and the province and the monitoring norms, and keep monitoring records.

Key pollutant discharge units shall, in accordance with the relevant national, provincial and municipal regulations and monitoring norms, install automatic monitoring equipment for air pollutant discharge, network with the competent department of ecological environment, ensure the normal operation of monitoring equipment, disclose pollutant discharge information according to law, and be responsible for the authenticity and accuracy of automatic monitoring data.

Automatic monitoring equipment shall be put into use at the same time as the main project, and shall not be dismantled or left idle without authorization. During the failure of automatic monitoring equipment, key units that discharge air pollutants shall conduct manual monitoring according to the specifications.

The municipal competent department of ecological environment shall, jointly with the relevant departments, determine the list of key pollutant discharge units in this Municipality according to law, and announce it to the public through the news media. Article 13 The management institutions of key parks for the prevention and control of air pollution shall prepare plans for the prevention and control of air pollution, improve environmental infrastructure, install an online monitoring system for characteristic pollutants of industrial waste gas, and connect with the monitoring system of the competent department of ecological environment to monitor the emission of pollution sources in the park in real time and give early warning in time.

The list of key parks for air pollution prevention and control shall be determined by the municipal competent department of ecological environment, and shall be promulgated and implemented after being approved by the Municipal People's Government.
