Provisions of Guangzhou Municipality on the Supervision and Administration of Occupational Health

Chapter I General Provisions Article 1 In order to strengthen the prevention and control of occupational diseases, prevent, control and eliminate occupational hazards, and protect the occupational health rights and interests of workers, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Occupational Diseases, the Law of People's Republic of China (PRC) on Work Safety and other relevant laws and regulations, and in light of the actual situation of this Municipality. Article 2 The employing units mentioned in these Provisions refer to enterprises, institutions and individual economic organizations with occupational hazard factors listed in the Catalogue of Occupational Hazard Factors. Article 3 These Provisions shall apply to the prevention and control of occupational diseases and the supervision and management of occupational health within the administrative area of this Municipality. Article 4 The people's governments at all levels in this Municipality shall strengthen their leadership in the prevention and control of occupational diseases, formulate plans for the prevention and control of occupational diseases in their respective regions, and incorporate the funds for occupational health supervision and management into the annual financial budget of the governments at the corresponding levels. Article 5 The safety production supervision and management departments and health administrative departments at all levels in this Municipality shall be responsible for the supervision and management of occupational disease prevention and control within their respective administrative areas. The human resources and social security departments at all levels in this Municipality are responsible for the supervision and management of occupational disease prevention and control within their respective responsibilities.

The safety production supervision and management departments at all levels in this Municipality shall supervise and inspect the implementation of relevant occupational health laws, regulations, rules and standards by the employing units according to law, and organize the investigation and punishment of occupational hazard accidents and illegal acts according to law. The health administrative departments at all levels in this Municipality shall standardize the inspection, diagnosis, identification and statistics of occupational diseases. Article 6 The people's governments at all levels in this Municipality shall implement the territorial supervision responsibility of occupational health, establish and improve the occupational health work responsibility system and work coordination mechanism, and coordinate and solve major problems existing in occupational health work in a timely manner.

District-level safety production supervision and management departments may entrust the safety production supervision and management institutions with administrative law enforcement qualifications established by the town people's government and sub-district offices to carry out occupational health administrative law enforcement work according to law within their respective jurisdictions. The specific scope and authority of entrusted law enforcement shall be determined by the entrusting organ and the entrusted organ signing the Power of Attorney for Administrative Law Enforcement. Chapter II Occupational Health Guarantee Article 7 The employing unit is the main body responsible for the prevention and control of occupational diseases, and shall formulate and publish the responsibility system and operating rules for the prevention and control of occupational diseases to ensure the occupational health of workers.

The main person in charge of the employing unit is fully responsible for the occupational disease prevention and control work of the unit, the person in charge of production safety of the employing unit is directly responsible for the occupational disease prevention and control work of the unit, and other responsible persons and relevant personnel shall perform occupational health duties while performing their duties. Article 8 The principal responsible person of the employing unit shall bear the following responsibilities for the occupational health management of the unit:

(a) to organize the formulation of occupational health rules and regulations of the unit and supervise the implementation;

(two) to organize the formulation and implementation of the occupational health education and training plan of the unit;

(three) the implementation of occupational health funds;

(four) to supervise and inspect the occupational health work of the unit, and eliminate the hidden dangers of occupational diseases in time;

(five) when an occupational accident occurs, the organization shall take prompt measures, report truthfully in time, do a good job in the aftermath, and cooperate with the investigation and handling;

(6) Other occupational health duties as prescribed by laws and regulations. Article 9 The person in charge of production safety of the employing unit shall implement occupational health management under the leadership of the principal person in charge and perform the following duties:

(a) to organize the implementation of the occupational health rules and regulations of the unit;

(two) to organize the implementation of occupational hazard prevention measures to eliminate the hidden dangers of occupational hazards accidents;

(3) Organizing, coordinating and supervising the implementation of occupational health education and training;

(four) timely report occupational diseases and occupational health hazards, and draw attention to major problems of occupational health in the unit;

(five) to organize the monitoring and detection of occupational hazards in the workplace, occupational health monitoring of workers exposed to occupational hazards and the "three simultaneous" work of occupational health in construction projects;

(six) to coordinate and urge the occupational health management institutions of this unit to perform their duties;

(seven) other occupational health duties as prescribed by laws and regulations. Article 10 The employing unit shall be equipped with full-time or part-time occupational health management personnel in accordance with state regulations. The safety production management institution of the employing unit engaged in production and business activities shall perform the duties of occupational health management. Eleventh the employer or workplace with occupational hazards shall declare the occupational hazards in accordance with the provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Occupational Diseases.

Where the employing unit uses laborers in the name of contracting or outsourcing, it shall be uniformly declared by the employing unit.

If the same employer has multiple workplaces and is located in different administrative regions, it shall declare the workplaces separately; If multiple workplaces are located in different places in the same administrative area, they shall be declared by a reporting entity. Article 12 The employing unit shall truthfully inform the workers of the occupational hazards in the workplace and their consequences, occupational health management system, detection results of occupational hazards, occupational protective measures and treatment by concluding labor contracts, conducting training and education, setting up bulletin boards, and setting up toxic substances notification cards in the workplaces where they exist or produce.

The employing unit shall, within 5 working days from the date of receipt, truthfully inform the workers of the results of occupational health examination during their employment in writing, keep written records and sign them for confirmation.
