According to the Interim Measures of the State Council on Retirement and Resignation of Workers, the legal retirement age of ordinary female employees is 50 years old, but the retirement age can be advanced to 45 years old for female employees engaged in special types of work such as underground, high altitude, high temperature or particularly heavy manual labor. Therefore, if a 53-year-old female worker does not belong to a special type of work, her retirement age should be calculated as 50, not 45. Female workers are female cadres, and the retirement age is 55. Therefore, the 53-year-old female worker has exceeded the retirement age of ordinary workers, but if she is a female cadre, she has not yet reached the retirement age.
Provisions on the retirement age of social security:
1. According to the national regulations, the retirement age of women is divided into two categories: one is female employees, whose legal retirement age is 50 years old; The other is a female cadre, whose legal retirement age is 55;
2. The retirement age for men is 60 years old;
3. Employees in special industries or special types of work may have different retirement age regulations, which are usually determined according to the nature of work and labor intensity;
4. The retirement age may also be adjusted due to reforms, such as the policy of gradually delaying the retirement age;
5. In some cases, employees may apply for early retirement or delayed retirement due to health reasons or other special circumstances.
To sum up, the retirement age of 53-year-old female employees should be determined according to their jobs and positions: if they are ordinary employees, they have exceeded the statutory retirement age for 3 years, but if they are female cadres, they have not reached the retirement standard of 55 years old, and female employees engaged in special jobs may retire at the age of 45, which cannot be generalized.
