The operation of urban rail transit should follow the principles of safe operation, convenience and efficiency, standardized service and comprehensive management. Article 4 The Municipal People's Government shall strengthen the unified leadership of urban rail transit, and the comprehensive coordination institution of urban rail transit management shall coordinate the planning, construction, operation, safety, emergency and comprehensive development of urban rail transit in this Municipality.
The people's governments of counties (cities, districts) along the urban rail transit (including functional area management institutions, the same below) shall assist in the planning, construction and operation of urban rail transit within their respective jurisdictions. Article 5 The municipal transportation department is the competent department of urban rail transit industry in this Municipality. The municipal transportation department may entrust the urban rail transit supervision and management institution to undertake the daily supervision and management work.
Municipal development and reform, natural resources and planning, housing and urban and rural construction, finance, public security, market supervision and management, emergency management, comprehensive administrative law enforcement, health, ecological environment, water conservancy, civil air defense and other competent departments shall do a good job in the supervision and management of urban rail transit according to their respective responsibilities. Article 6 The construction units and operation units of urban rail transit determined by the Municipal People's Government shall be responsible for the construction and operation of urban rail transit in this Municipality respectively.
Electric power, water supply, drainage, gas, communications and other related units shall ensure the normal construction and operation of urban rail transit. Chapter II Planning and Construction Article 7 Urban rail transit planning mainly includes network planning, land use control planning, construction planning and traffic connection planning.
Network planning, land use control planning and traffic connection planning shall be organized by the municipal natural resources and planning department in conjunction with relevant departments and implemented after approval by the Municipal People's government.
Construction planning by the municipal development and reform department in conjunction with relevant departments to organize the preparation, in accordance with the prescribed procedures for approval. Article 8 Urban rail transit planning shall conform to the overall urban planning, overall land use planning and comprehensive transportation planning.
The formulation of urban rail transit planning shall solicit the opinions of the people's governments and the public of counties (cities, districts) along the line.
The approved urban rail transit planning shall not be changed at will; If it is really necessary to change, it shall be submitted for approval in accordance with the original examination and approval authority and procedures. Article 9 The planning of urban rail transit shall be rationally laid out, and the interchange between different lines of urban rail transit and between urban rail transit and public transportation such as railways, aviation and highways in the city shall be arranged as a whole, and the comprehensive development of rail transit stations, vehicle depots and adjacent areas shall be planned as a whole, and public facilities such as interchange spaces, bus stops, parking lots and emergency evacuation land shall be reserved. Article 10 The municipal competent department of natural resources and planning shall strengthen the planning and control of construction projects along the rail transit according to the land control planning of rail transit.
When examining and approving other construction projects related to urban rail transit, the municipal competent department of natural resources and planning shall plan, control and manage the urban rail transit stations, sections, ventilation booths, cooling towers and other facilities that have been approved or the urban rail transit land control plan has been clearly defined, and the necessary space connected with them. Article 11 This Municipality shall establish and improve the special land reserve system for urban rail transit.
The municipal competent department of natural resources and planning shall, according to the relevant provisions of the state and the urban rail transit network planning, land use control planning, construction planning and traffic connection planning, do a good job in the control and management of land use along the urban rail transit.
The municipal competent department of natural resources and planning shall incorporate urban rail transit and its supporting facilities and related public facilities into the red line of urban rail transit construction land.
Urban rail transit planning to determine the rail transit land, without legal procedures shall not change its use. Twelfth urban rail transit construction must adhere to the principle of first survey, then design and then construction, and strictly implement the construction procedures.
The survey, design, construction, supervision, monitoring, testing and equipment supply of urban rail transit construction projects shall conform to the requirements of laws, regulations, rules and technical specifications, and abide by the provisions on the protection of existing buildings and related facilities above and around.
Urban rail transit construction units must establish and improve the safety and quality management system, set up special safety and quality management institutions, and strengthen the safety and quality performance management of survey, design, construction, supervision and monitoring units. Thirteenth urban rail transit construction projects and municipal public facilities conflict, should be coordinated in accordance with the principle of rail transit priority.
Where urban rail transit construction uses underground space according to law or temporarily occupies underground, surface and aboveground space of adjacent land, relevant units and individuals shall provide convenience. Fourteenth urban rail transit entrances, ventilation kiosks and cooling towers and other facilities need to be combined with the surrounding existing buildings (structures) or occupy land, their owners and users should cooperate; If damage is caused, compensation or compensation shall be made according to law.
Where the proposed, under construction or existing buildings around the urban rail transit station require connection with the urban rail transit station, the construction unit or the owner shall solicit the opinions of the urban rail transit construction unit and the operation unit in writing and bear the related expenses of the connection project.
