Article 67. 19 Types of medical certificates

Physical examination certificate is divided into the following categories:

(1) first-class physical examination certificate;

(2) Secondary physical examination certificate;

(3) Three-level physical examination certificates, including three-level A and three-level B physical examination certificates;

(4) Certificate of Level 4 physical examination, including certificate of Level 4 A and Level 4 B physical examination.

See Annex A "Physical Examination Standards for Aircrew and Air Traffic Controller's Physical Examination Certificates" for the applicable physical examination standards for physical examination certificates at all levels. Article 67.2 1 applies to persons with medical certificates.

(a) The applicant or holder of the air transport driver's license and commercial driver's license for aircraft and helicopters shall obtain and hold a first-class medical certificate.

(b) Pilots, navigators, flight mechanics and flight operators other than those mentioned in paragraph (a) shall apply for or hold a second-class medical certificate.

(c) Airport controllers, approach controllers, area controllers, approach radar controllers, precision approach radar controllers, and area radar controllers shall obtain and hold Class Ⅲ A medical certificate; Flight service controllers and operation monitoring controllers shall obtain and hold Grade Ⅲ B physical examination certificates.

(d) The aircrew shall obtain and hold a medical certificate of Grade Ⅳ A..

(e) The aviation safety officer shall obtain and hold a Class IV B medical certificate ... Article 67.23 Application conditions for medical certificate.

The applicant for the medical certificate shall conform to the corresponding medical standards stipulated in Annex A of these rules, and the medical standards for the medical certificates of aircrew and air traffic controllers, and obtain the medical certificate issued by the medical institution recognized by the Civil Aviation Administration.

Article 67.25 Acceptance of applications

(1) The applicant for the medical examination certificate shall apply to the local regional administration within 15 days after obtaining the conclusion that the medical examination is qualified, and submit the medical examination documents and medical materials related to this application for the medical examination certificate. Applicants who have obtained special permission to issue medical examination certificates and those who have obtained medical examination certificates from CAAC shall apply to CAAC.

(2) After receiving the applicant's application for "Physical Examination Certificate", the accepting organ shall conduct a preliminary examination and make a decision on whether to accept it according to the following circumstances:

(1) If it is not necessary to obtain a medical certificate, it shall immediately inform the applicant that it will not be accepted.

(2) If it does not fall within the scope of authority of this organ, it shall immediately make a decision not to accept it, and inform the applicant to apply to the relevant administrative organ.

(3) If the application materials are incomplete or inconsistent with the statutory form and can be corrected on the spot, the applicant is required to make corrections on the spot. If it cannot be corrected on the spot, it shall inform the applicant of all the contents that need to be corrected at one time within 5 working days. Fails to inform, since the date of receipt of the application materials is accepted.

(4) If the application matters fall within the scope of functions and powers of this organ, and the materials are complete and conform to the statutory form, or the applicant submits all the corrected materials as required, it shall accept and inform the applicant.

(3) If an application for medical certificate is submitted by letter, the time of acceptance shall be subject to the receipt by the accepting organ; If the application is made by fax, electronic data interchange or e-mail, the acceptance time shall be based on the recording time of entering the receiving equipment; If the application materials are incomplete or inconsistent with the statutory form, the acceptance time shall be subject to the time when all supplementary materials are received. Article 67.27 Review

(1) The accepting organ shall complete the accreditation examination and make a decision within 20 working days from the date of accepting the applicant's application for accreditation. If a decision cannot be made within 20 working days, it may be extended by 10 working days with the approval of the person in charge of the accepting organ, and the applicant shall be informed of the reasons for extending the time limit.

(b) Main contents of the review:

(1) Basic information of the applicant;

(2) Physical examination documents and medical materials;

(3) Conformity of physical examination items and auxiliary examination items;

(4) Conformity of the conclusions of medical appraisal;

(5) Other necessary contents.

(3) The accepting organ shall make the following decisions according to the examination results, and notify the relevant institutions and personnel in writing:

(1) If the medical certificate and medical data are complete, the medical examination items and auxiliary examination items meet the requirements of these Rules, and the appraisal conclusion meets the corresponding medical standards of these Rules, a decision shall be made to permit the medical examination certificate.

(2) If it is considered that the medical examination has not been conducted according to the medical examination standard, auxiliary examination items and frequency of the medical examination certificate type applied by the applicant, a decision of disapproval shall be made.

(3) If two or more people review that medical inspectors have improperly applied medical standards and made wrong conclusions, they shall make a decision not to grant permission.

(four) two or more people think it is necessary to further confirm the conformity of the medical examination conclusion, and submit it to the expert committee for expert appraisal, and notify the applicant. Expert appraisal is not included in the review period. Rule 67.29 Questions

(1) After the accepting organ makes a decision to approve the issuance of a medical certificate, it shall issue a medical certificate (see Annex B for the style).

(2) If the accepting organ considers that the applicant's conditions cannot meet the requirements of these Rules, it shall make an administrative licensing decision not to issue a medical examination certificate, and fill in a notice not to issue a medical examination certificate. If a medical certificate is not issued, the reasons shall be explained in the notice of not issuing a medical certificate.

Article 67.365438 +0 Service

(1) If the accepting organ can make a decision to issue a medical certificate, it shall deliver the medical certificate to the applicant within 10 working days from the date of making the decision.

(two) if the accepting organ can make an opinion on not issuing a medical certificate on the spot, it will issue a notice on not issuing a medical certificate to the applicant on the spot. If it cannot be delivered on the spot, it shall be delivered to the applicant within the review period. At the same time, inform the applicant of the right to apply for administrative reconsideration or administrative litigation according to law.

(c) The medical certificate can be delivered directly, by mail or by the applicant himself. The delivery of medical certificates must keep the record of delivery receipt or mailing certificate or receipt. Article 67.33 Validity period

(a) The medical certificate shall take effect from the date of issuance. Age calculation is based on the actual age of the applicant at the time of physical examination.

(2) The first-class physical examination certificate is valid for 12 months, and it is 6 months for those over 60 years old. Among them, the pilot who participated in the operation as stipulated in the Rules for the Examination and Approval of Air Transport Carriers of Large Aircraft (CCAR- 12 1) is over 40 years old and over 6 months old.

(c) The second-class medical certificate is valid for 36 months. Among them, over 40 years old is 24 months, and over 50 years old is 12 months.

(d) According to the duties performed by the holder of the medical certificate, the validity period of the third-class medical certificate is:

(1) Class Ⅲ A physical examination certificate is valid for 24 months. Among them, the age over 40 is 12 months.

(2) Class Ⅲ B physical examination certificate is valid for 24 months.

(e) The validity period of Grade ⅳ A and Grade ⅳ B physical examination certificates is 12 months.

(f) The holder of the medical examination certificate may apply for the renewal of the medical examination certificate in accordance with the provisions of these Rules 30 days before the expiration of the medical examination certificate.

Article 67.35 Extension of validity

(1) If the holder of the medical certificate is unable to carry out medical examination and update the medical certificate before the expiration of the medical certificate due to special reasons and must perform his duties, he shall apply to the original issuing authority for extending the validity of the medical certificate before the expiration of the medical certificate.

(b) After receiving the application for extending the validity period, the issuing authority may require the holder of the medical certificate to provide aviation doctors or medical practitioners to inspect the applicant for specified items, and decide whether to extend the medical appraisal and the validity period of the medical certificate according to the situation. The extension of the validity period shall not exceed the following periods:

(1) The holder of the medical certificate specified in Article 67.33 (b), (d) and (e) shall not exceed 45 days;

(2) The holder of the medical certificate stipulated in Article 67.33 (c) shall not exceed 90 days.

(three) the issuing authority shall make a decision before the expiration of the validity period of the medical certificate. Agree to extend the validity of the applicant's medical certificate, it shall notify the applicant and his unit in writing.

Article 67.37 Compliance Requirements

(a) the medical certificate holder shall comply with the following requirements when performing his duties:

(1) Hold the corresponding valid medical certificate when performing duties;

(2) Abide by the restrictions specified in the medical certificate;

(3) Stop performing duties and report to the management department of the unit when the physical condition changes and may not meet the corresponding medical standards certified by the medical certificate.

(two) the unit where the medical certificate holder belongs shall meet the following requirements:

(1) Before performing their duties, the holder of the physical examination certificate shall confirm that his physical condition meets the corresponding physical examination standards of the physical examination certificate and can meet the needs of performing his duties;

(2) Establish the health observation file of the physical examination certificate holders, understand their health status, implement health risk management and corresponding medical care measures, and bring them into the unit safety management system (SMS);

(three) to urge the holder of the physical examination certificate to take targeted measures to correct the disease.

Article 67.39 After the physical examination certificate is lost or damaged, the holder shall apply to the original issuing authority for a replacement. If the issuing authority examines and confirms that the applicant's medical certificate is within the validity period and the relevant information is true, it may reissue the medical certificate with the same contents as the original medical certificate.

67.4 1 information change

When the name, nationality and other information specified in the medical certificate changes, the holder shall apply to the original issuing authority for information change. The issuing authority shall, after examining and confirming that the relevant information of the applicant is true, change the physical examination certificate for the applicant and withdraw the physical examination certificate before the change. The validity period and restriction requirements of the changed medical certificate are the same as those of the original medical certificate.

Article 67.43 The medical certificate shall be specially issued.

(1) Applicants (except trainee drivers and learner drivers) who apply for Class I, II and III A medical certificates again, if the medical examination conclusion is unqualified, and there are sufficient reasons to prove that they can perform their duties safely and will not aggravate their illness or worsen their health due to their duties, may apply to the expert committee for special permission for medical examination, and submit the following documents:

(1) application form;

(2) unit certification documents (except for private driver's license holders);

(three) the technical ability certificate issued by the technical experts designated by the local regional administration;

(4) Physical examination documents and medical materials;

(5) Other materials that need to be submitted.

(b) The Committee of Experts conducts a preliminary examination of all materials submitted by the applicant. In line with the application conditions, in accordance with the provisions of Article 67. 15 of these Rules, organize the physical examination and appraisal of the franchise certificate; Those who do not meet the application conditions shall be returned to the applicant.

(c) Applicants who have passed special accreditation may apply to the Civil Aviation Administration for special permission to issue medical examination certificates.

(d) The Civil Aviation Administration shall accept and review in accordance with the provisions of Articles 67.25 and 67.27 of these Rules. According to the basic situation of the applicant, the safety responsibility when performing duties, the acceptable medical measures to ensure the safe performance of duties, the possibility of implementation, etc. , make a licensing decision to issue a medical certificate. If preferential treatment is granted, a medical certificate shall be issued; If the license is not granted, it shall sign an opinion not to issue it. The above-mentioned permission decision shall be notified in writing by the Civil Aviation Administration to the applicant and its subordinate units, as well as to the regional administration and medical examination institution where the applicant is located.

(e) One or more of the following restrictions shall be stipulated in the medical certificate issued by the concessionaire:

(1) Responsibility or task restriction;

(2) Time limit for performing duties;

(3) Medical security requirements necessary for the safe performance of duties;

(4) Other necessary restrictions.

Article 67.45 Management of Foreign Pilots' Physical Examination Certificates

(1) A foreign civil aircraft pilot who holds a valid medical certificate issued by the civil aviation authorities of other contracting countries of ICAO, and who applies to work in civil aircraft operating units such as public aviation, general aviation and flight academy for less than 120 days (inclusive), may apply for a certificate of recognition of the medical certificate of foreign pilots issued by the local regional administration. See annex c for the format. If it is more than 120 days, it shall apply for a medical certificate in accordance with these rules.

(2) Foreign pilots may apply for a medical examination certificate from the local regional administration after applying to the medical examination institution in accordance with the provisions of these Rules and obtaining the conclusion that the medical examination conforms to the standards of these Rules.

(c) After receiving the application for medical examination certificate or accreditation certificate of foreign pilots, the regional administration shall accept and examine it in accordance with the provisions of Articles 67.25 and 67.27 of these Rules. If the examination considers that it meets the corresponding requirements, the corresponding medical certificate or medical certificate approval certificate shall be given; Review that does not meet the corresponding conditions, shall not issue a medical certificate or medical certificate approval certificate, and notify the applicant and the unit in writing.

(d) When performing tasks, foreign aviation personnel participating in the flight operation of aviation units in China shall hold valid medical certificates issued by the civil aviation authorities of other ICAO contracting States and valid accreditation certificates issued in accordance with these Rules, or hold valid medical certificates issued in accordance with these Rules.
