Twelfth health supervision institutions should be equipped with sampling and transmission tools, set up special storage places, facilities and equipment. Samples should be stored according to the storage conditions of product identification. Samples that need to be sealed and preserved shall have anti-unpacking measures.
Thirteenth health supervisors should send samples for inspection in time, and fill in the notice of sample inspection according to the regulations. After receiving the sample and accepting it, the inspection institution shall sign the sample inspection notice.
Fourteenth health supervision institutions shall keep unqualified samples until 3 months after the results of spot checks are announced. If there is any objection to the sampling results, the storage period of the samples shall be extended according to the specific circumstances.
Fifteenth inspection agencies should make good preparations for inspection before receiving samples, and issue inspection reports within 05 days from the date of receiving samples. Special circumstances can not be completed as scheduled, should be explained when receiving samples, and clear the completion time.
Article 16 The sample inspection shall meet the following requirements: (1) The inspection method shall be carried out in accordance with the requirements and standards stipulated in the sampling plan for national health supervision formulated by the Ministry of Health; (two) the original data records of the inspection report should be standardized and complete, and kept according to the relevant management requirements; (3) Standard materials should be used for quality control at the same time; (4) Perform parallel determination on each sample, and the results of parallel determination shall meet the error requirements of the analysis method, and report the average value of the test results; (5) The inspection report shall specify the product name, name of the production unit, production date, specifications, sampling unit and inspection value.
Seventeenth inspection results should be judged according to the relevant laws, regulations, rules, norms and standards of the state. When necessary, the Ministry of Health or the provincial health administrative department may organize experts to examine and approve the sampling results.
Eighteenth provincial health administrative departments shall inform the sampling unit of the sampling results before publishing the information of unqualified products. If the sampling unit is a distribution unit, it shall also inform the production unit or import agent of the product of the sampling results, except that the production unit or import agent cannot be confirmed.
Article 19 If a product producer, import agent or distribution unit disagrees with the sampling result, it may, within 10 days from the date of receiving the notification of the sampling result, submit a written application for re-inspection to the provincial health administrative department or the Ministry of Health, and explain the reasons. The administrative department of health shall make a decision on whether to review the application within 10 days from the date of receiving the application. Re-inspection shall not be conducted under any of the following circumstances: (1) The microbial index of the product exceeds the standard; (two) the retention of samples exceeds the shelf life; (3) The retained samples may change during normal storage, which will affect the inspection results; (four) has been reviewed; (5) Failing to apply for re-examination within the time limit; (six) the production unit or import agent of the sample raises an objection to its authenticity, but can not provide relevant certification documents.
Twentieth health administrative departments at or above the provincial level agree to re-examination, in principle, the application of retention samples for re-examination. The unit applying for reinspection shall go through the inspection procedures within 3 days from the date when the provincial health administrative department makes a decision to agree to reinspect. The reinspection fee shall be borne by the unit applying for reinspection.
Article 21 The applicant for reinspection may choose the original inspection institution or other inspection institutions undertaking sampling inspection, or choose the institution designated by the Ministry of Health to conduct reinspection. The inspection agency shall issue an inspection report within 15 days.
