Regulations of Guangzhou Municipality on the Promotion of Charity

Article 1 In order to promote the healthy development of charity, carry forward charity culture, standardize charity activities, protect the legitimate rights and interests of participants in charity activities, and create a charity city, these Regulations are formulated in accordance with the Charity Law of the People's Republic of China and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to charitable activities carried out within the administrative area of this Municipality and activities related to charity promotion. Article 3 The municipal and district people's governments shall take the development of charity as an important part of the social security system and spiritual civilization construction, incorporate it into the national economic and social development plan at the corresponding level, formulate policies and measures to promote the development of charity, and include the funds needed to promote the development of charity in the fiscal budget at the corresponding level. Article 4 The municipal civil affairs department is in charge of charitable work within the administrative area of this Municipality and is responsible for organizing the implementation of these Regulations. The district civil affairs department is responsible for the charity work within its administrative area.

Relevant departments shall, in accordance with the division of responsibilities, do the following work:

(a) the propaganda, culture, radio, film and television tourism departments are responsible for bringing charity culture into the propaganda system to carry forward the traditional virtues of the Chinese nation and practice the socialist core values;

(two) the education department is responsible for guiding the development of charitable culture and education, and guiding young people to participate in charitable activities within their capabilities;

(3) The human resources and social security department is responsible for guiding charitable organizations and other organizations engaged in charitable activities to implement laws, regulations and policies on labor contracts and social insurance;

(four) the financial and tax departments are responsible for the implementation of national, provincial and municipal tax preferential policies for charitable organizations, donors and beneficiaries;

(five) the health department is responsible for the supervision of medical donations, medical assistance and other matters;

(six) the ethnic and religious affairs department is responsible for guiding religious groups and places for religious activities to carry out charitable activities according to law;

(seven) public security, urban management and comprehensive law enforcement, housing and urban and rural construction, market supervision and management, state-owned assets supervision and management, emergency management and other departments are responsible for providing necessary support and guarantee for charitable activities.

The town people's government and sub-district offices are responsible for assisting civil affairs departments and other relevant departments to do charity-related work and support community charity activities. Article 5 The civil affairs department shall, jointly with relevant departments and units, establish mechanisms for charity work organization and coordination, information communication and sharing, credit information disclosure and emergency rescue.

The civil affairs department shall establish a connection mechanism with charitable organizations, charitable industry organizations and other organizations that carry out charitable activities to realize the sharing of information such as social assistance, charitable resources and social services. Article 6 Trade unions, the Communist Youth League, women's federations, disabled persons' federations, federations of industry and commerce, the Red Cross and other social organizations shall, according to their respective functions and duties, mobilize social forces to carry out charitable activities. Article 7 Exhibition venues, stadiums, stations, docks, airports, subways, parks and shopping malls are encouraged to provide venues and other conveniences for charitable activities, and relevant fees are reduced or exempted.

Encourage legal services, finance, evaluation, auditing and other institutions to reduce or exempt service fees when providing services for charitable activities, and encourage media such as radio, television, newspapers and websites to reduce or exempt charity publicity fees.

Encourage volunteers to participate in charitable activities, and organizations that carry out charitable activities should provide necessary conditions for volunteers to protect their legitimate rights and interests.

Encourage compatriots from Hong Kong, Macao and Taiwan, overseas Chinese and international friends to participate in charity, and qualified religious groups and venues for religious activities can carry out charity activities according to law. Eighth to encourage and support charitable organizations to set up charitable trade organizations. Civil affairs departments should provide guidance for charitable organizations to improve industry norms, formulate group standards, organize industry training, promote industry exchanges, strengthen industry self-discipline and safeguard industry rights and interests.

Encourage and support the establishment of social supervision institutions in the charity industry. The civil affairs department shall provide guidance for the social supervision institutions in the charity industry to evaluate and supervise charitable organizations and charitable activities. Article 9 The establishment of charitable organizations is encouraged. The establishment of a charitable organization shall apply to the civil affairs department in accordance with the provisions of the Charity Law of the People's Republic of China.

Encourage non-profit organizations such as foundations, social organizations and social service institutions that have been established before the promulgation of the Charity Law of the People's Republic of China and meet the conditions for the recognition of charitable organizations to apply to the civil affairs department for recognition as charitable organizations.

The civil affairs department shall provide the applicant with convenience such as simplifying procedures and shortening the time limit for examination and approval. Tenth civil affairs departments should cultivate and develop all kinds of charitable organizations through the purchase of services, incubation, project guidance, public welfare venture capital and other means. Give priority to cultivating charitable organizations that help the poor, the needy, the elderly, the orphans and the disabled, and encourage the development of charitable organizations that promote education, science, culture, health, sports and protect and improve the ecological environment. Article 11 Charitable organizations are encouraged to set up social service institutions such as public medical care, education, pension, emergency assistance, environmental protection and assistance for the disabled, and relevant government departments should provide convenience for charitable organizations to rent venues and use supporting facilities. Article 12 The civil affairs department shall, jointly with the human resources and social security departments, formulate policies for the cultivation and introduction of charitable talents, establish a pool of charitable talents, and cultivate and introduce talents for theoretical research, fund raising, project implementation, professional services, publicity and promotion, etc. required for the development of charitable undertakings.

The civil affairs department shall, jointly with the departments of education, human resources and social security, strengthen the vocational education and skills training for charity practitioners, and provide free education and training for charity practitioners in this Municipality for a certain period of time every year.

Encourage institutions of higher learning, secondary vocational schools and scientific research institutions to establish charitable talents training and training bases.
