Regulations of Jinan Municipality on River Management and Protection

Chapter I General Provisions Article 1 In order to standardize the management and protection of river courses, ensure flood control safety, improve the water environment, give full play to the comprehensive benefits of water systems and promote the construction of ecological civilization, in accordance with the People's Republic of China (PRC) Water Law, the People's Republic of China (PRC) Flood Control Law, the People's Republic of China (PRC) Water Pollution Prevention Law, the People's Republic of China (PRC) River Management Regulations and other laws and regulations. Article 2 These Regulations shall apply to the planning, regulation, management, protection and utilization of river courses within the administrative area of this Municipality. Article 3 The management and protection of river courses shall adhere to the principles of unified planning, systematic management, simultaneous management and protection, and rational utilization. Article 4 The municipal, district and county people's governments shall incorporate the management and protection of river courses into the national economic and social development plan, and include the funds required for the planning, management, operation and maintenance of river courses into the financial budget.

The Town People's Government and the sub-district offices shall, in accordance with their functions and powers, do a good job in the management and protection of rivers within their respective jurisdictions. Article 5 This Municipality shall fully implement the system of river length, implement the local main responsibility of river management and protection, establish and improve the long-term mechanism of comprehensive management through departmental linkage, and make overall plans to promote water resources protection, water shoreline management, water pollution prevention, water environment management and water ecological restoration, ensure the ecological health and public safety of rivers, and enhance the comprehensive functions of rivers.

River flood control and obstacle clearing work shall be carried out by the chief executive of the people's government. Article 6 The municipal, district and county water administrative departments are the departments in charge of river management and protection, and are responsible for river management and protection within their respective administrative areas.

City, district and county ecological environment departments shall implement unified supervision and management of water pollution prevention and control within the scope of river management.

Development and reform, finance, natural resources and planning, comprehensive administrative law enforcement, urban and rural transportation, agriculture and rural areas, gardens and forestry greening, culture and tourism, administrative examination and approval services and other relevant departments shall, in accordance with their respective responsibilities, do a good job in river management and protection. Article 7 This Municipality implements a unified management and hierarchical management system for river courses.

The Jinan section of the Yellow River is managed by the municipal, district and county people's governments and their water administrative departments in cooperation with the Yellow River basin management agencies authorized by the state.

Xiaoqing River, Tuhaihe River, Dehui New River and Dawenhe Jin 'an section are managed by the municipal water administrative department under the organization and coordination of the provincial water administrative department, and the water administrative departments of the districts and counties through which they flow do a good job in river management within their respective jurisdictions according to their division of labor and authority.

Yufu River and Lashan flood diversion road are managed by the municipal water administrative department.

Other rivers are managed by the water administrative departments of the districts and counties through which they flow; If the management authority really needs to be adjusted, it shall be approved by the Municipal People's Government. Eighth to encourage and support social forces to participate in river management and protection activities.

All units and individuals have the obligation to protect the safety of river embankments and participate in flood control and emergency rescue according to law, and have the right to dissuade, stop and complain about acts that damage the river and its facilities or damage or pollute the ecological environment of the river. After receiving complaints and reports, the relevant state organs and units shall handle them according to law and feed back the results to the complainant in time. Chapter II Planning and Governance Article 9 The municipal and county water administrative departments shall, jointly with natural resources, planning and other relevant departments, formulate a water system plan and submit it to the people's government at the same level for approval.

Water system planning should include the delineation of the blue line of the river, flood control and drainage, water source protection, river regulation, shoreline management, sand mining management and so on. Tenth water system planning should follow the overall planning of urban land space, conform to the comprehensive planning of river basins and regions, and coordinate with other special planning.

Natural resources and planning departments should consider the requirements of water system planning, control the shape and height of buildings along the river, and reflect the scattered and exposed urban landscape. Eleventh approved water system planning shall not be changed without authorization. If adjustment is really necessary, it shall be reported to the original approval authority for approval. Twelfth river regulation should follow the water system planning, adhere to the principle of combining flood control safety with improving natural ecology, enhancing urban landscape and giving full play to historical and cultural functions. Thirteenth river regulation should take comprehensive measures such as river widening, water system connection, ecological water supply, dike greening, soil and water conservation, black and odorous water treatment, etc., effectively use the Yangtze River water and the Yellow River water, and improve the ecological environment quality of the water system.

Conditional river regulation can build hydrophilic promenade, greenway and other landscape belts along the river. Article 14 The protection of famous springs within the scope of river regulation should focus on the protection of famous springs.

It is forbidden to carry out anti-seepage treatment on river bottoms and river slopes within the protection range of key leakage zones in spring direct recharge areas. Article 15 The construction and development of various water conservancy, flood prevention and river regulation projects, as well as bridges, docks, roads, ferries, pipelines, cables, dams, pumping stations and other buildings and facilities across rivers, rivers, dikes and rivers shall meet the requirements of flood control standards and technical specifications for engineering construction stipulated by the state.

The construction unit shall submit the project construction plan to the administrative licensing department for review in accordance with the management authority; Cross-county river-related projects, buildings and facilities facing the river shall be reported to the administrative licensing department at the next higher level for examination. Without examination and approval, construction shall not be started.
