Chapter I General Provisions
Article 1 In order to protect the legitimate rights and interests of volunteers, volunteer service organizations and volunteer service objects, encourage and standardize volunteer service, develop volunteer service, carry forward the volunteer spirit of dedication, friendship, mutual assistance and progress, cultivate and practice socialist core values, and promote social civilization and progress, these Regulations are formulated in accordance with the Regulations on Volunteer Service of the State Council and relevant laws and administrative regulations, combined with the actual situation of this province.
Article 2 These Regulations shall apply to voluntary services and activities related to voluntary services carried out within the administrative area of this province.
The term "voluntary service" as mentioned in these Regulations refers to the public services provided by volunteers, voluntary service organizations and other organizations to the society or others voluntarily and free of charge.
Article 3 The people's governments at or above the county level shall incorporate the cause of voluntary service into the national economic and social development plan, and incorporate the funds for the development of voluntary service into the fiscal budget at the same level to guide and support the development of voluntary service.
Article 4 Guidance institutions for spiritual civilization construction at or above the county level shall establish a coordination mechanism for voluntary service, strengthen the overall planning, coordination and guidance, supervision and inspection and experience promotion of voluntary service within their respective administrative areas, and incorporate voluntary service into mass spiritual civilization creation activities.
The civil affairs departments of the people's governments at or above the county level are responsible for volunteer registration management, volunteer service organization registration management, volunteer service filing management, volunteer service informatization construction, volunteer service activity norms and guidelines, and investigation of illegal acts related to volunteer service.
Education, science and technology, cultural tourism, health, emergency management, human resources and social security, ecological environment, housing and urban and rural construction, judicial administration and other departments of the people's governments at or above the county level shall be responsible for the relevant work of voluntary service according to their respective responsibilities.
Township people's governments and sub-district offices shall guide and support the voluntary service activities carried out in this area.
Article 5 Trade unions, the Communist Youth League, women's federations, associations for science and technology, Federation of Literary and Art Circles, Federation of Social Sciences, Disabled Persons' Federation, Red Cross Society, China Vocational Education Association, charitable organizations and other organizations shall give full play to their respective advantages and do a good job in volunteer service.
Encourage state organs, enterprises and institutions, and grassroots mass autonomous organizations to participate in and support voluntary service activities in various forms.
The whole society should respect the work of voluntary service organizations and volunteers. Encourage citizens to participate in voluntary service activities.
Sixth radio, television, newspapers, Internet and other media should carry out voluntary service publicity activities, spread the culture of voluntary service, and create a good public opinion environment for voluntary service.
Chapter II Volunteers
Article 7 The term "volunteers" as mentioned in these Regulations refers to natural persons who engage in voluntary service with their own time, knowledge, skills and physical strength.
Eighth volunteers can register their identity information, service skills, service hours, contact information and other personal basic information through the volunteer service information system designated by the the State Council Municipal Civil Affairs Department or through volunteer service organizations.
Article 9 Volunteers shall enjoy the following rights:
(a) Voluntary participation in or withdrawal from voluntary service organizations;
(two) to participate in voluntary service activities that are suitable for their own abilities;
(three) to understand the true, accurate and complete information of volunteer service activities;
(four) to obtain the necessary conditions and guarantees for participating in voluntary service activities;
(five) knowledge and skills training required to participate in voluntary service activities;
(six) free access to my volunteer service record;
(seven) to supervise the work of voluntary service organizations and put forward opinions and suggestions;
(eight) other rights stipulated by laws, regulations and the articles of association of voluntary service organizations.
Article 10 Volunteers shall perform the following obligations:
(1) Abiding by laws, regulations and the articles of association of voluntary service organizations;
(two) to maintain the image and reputation of voluntary service;
(three) to provide my true, accurate and complete basic information;
(four) to fulfill the voluntary service commitments or agreements;
(five) when accepting arrangements to participate in voluntary service activities, obey the management of voluntary service organizations;
(6) Respecting the personality, privacy and other rights of volunteers;
(seven) to keep the state secrets, business secrets and personal privacy known in the process of participating in voluntary service activities;
(eight) other obligations stipulated by laws and regulations.
Chapter III Voluntary Service Organizations
Article 11 The voluntary service organizations mentioned in these Regulations refer to non-profit organizations established according to law for the purpose of providing voluntary services.
Voluntary service organizations can take the form of social organizations, social service institutions, foundations and other organizations according to law. The registration management of voluntary service organizations shall be implemented in accordance with the provisions of relevant laws and administrative regulations.
Twelfth voluntary service organizations in accordance with the provisions of the articles of association of China * * * Party organization, the establishment of China * * * Party organization, to carry out party organization activities, to provide the necessary conditions for party organization activities.
Thirteenth registered volunteer service organizations shall be identified by the registration administration department in accordance with the provisions.
Organizations that do not have the conditions for independent registration may apply to legally registered voluntary service organizations to become members of their groups in accordance with regulations.
Groups established in urban and rural communities with the consent of grassroots mass autonomous organizations can carry out voluntary service activities in their communities under the guidance of township people's governments and sub-district offices.
Fourteenth voluntary service organizations shall perform the following duties:
(a) to carry out voluntary service activities in accordance with the articles of association and purpose;
(two) to establish and improve the system of voluntary service activities;
(three) responsible for the recruitment, registration and evaluation of volunteers;
(four) truthfully record the volunteer service information, and issue a certificate of volunteer service record free of charge;
(five) to provide volunteers with knowledge, skills training and safety education needed for voluntary service;
(six) to safeguard the legitimate rights and interests of volunteers and provide necessary working conditions and safety and health protection measures for volunteers;
(seven) to carry out voluntary service publicity and exchange activities;
(eight) other duties as prescribed by laws and regulations.
Voluntary service organizations shall respect the personal dignity of volunteers and volunteers, and shall not disclose or divulge their relevant information without their consent.
Fifteenth to encourage natural persons, legal persons and other organizations to donate property for voluntary service.
Donations and subsidies accepted by voluntary service organizations according to law shall be used in accordance with the provisions of their articles of association and in accordance with the legal ways agreed with donors and sponsors.
The collection, use and management of voluntary service funds shall be open and transparent, and shall be subject to the supervision of relevant departments, donors, sponsors, volunteers and society.
Voluntary service funds should be earmarked, and no organization or individual may privately divide, misappropriate or occupy them.
Sixteenth volunteer service organizations arrange volunteers to participate in volunteer service activities, and can subsidize the necessary transportation, accommodation, communication and other expenses paid by the volunteers themselves.
Chapter IV Voluntary Service Activities
Article 17 It is advocated to carry out voluntary service activities in poverty alleviation, helping the elderly and the disabled, education and teaching, public culture, health, supporting the army's superior members, ecological environment protection, public security prevention, disaster prevention and relief, games-time services, scientific and technological services, legal services, community services, civilization creation, civilized tourism, and responding to emergencies and large-scale social activities.
Eighteenth volunteers can participate in voluntary service activities carried out by voluntary service organizations, and can also carry out voluntary service activities according to law.
Nineteenth volunteers to participate in volunteer service activities, should have the time to engage in volunteer service and the corresponding service ability, and have the physical and mental health conditions required for related volunteer service.
Volunteer service organizations should arrange volunteers to participate in volunteer service activities, which should be adapted to the age, knowledge, skills and physical condition of volunteers, and may not require volunteers to provide volunteer services beyond their ability.
Minors participating in voluntary service activities shall be accompanied by guardians or approved by guardians according to actual conditions.
Twentieth volunteers, volunteer service organizations and volunteer service objects can sign volunteer service agreements as needed.
Volunteer service in any of the following circumstances, volunteers and volunteer service organizations, volunteer service organizations and volunteer service objects shall sign a written volunteer service agreement:
(a) personal safety and physical and mental health are at greater risk;
(two) engaged in voluntary service for more than three months;
(3) Providing voluntary services for large-scale social activities;
(4) Any party requests to sign an agreement;
(five) the provisions of laws and regulations shall sign an agreement.
Article 21 A voluntary service agreement shall include the following main contents:
(a) the rights and obligations of both parties;
(2) Contents, methods, time and place of voluntary service;
(3) Working conditions, safety guarantee and risk prevention measures;
(4) Alteration and rescission of the voluntary service agreement;
(5) Ways to resolve disputes related to voluntary service;
(six) other matters that need to be clarified.
Twenty-second volunteer service organizations shall purchase corresponding personal accident insurance for volunteers before arranging volunteers to participate in volunteer service activities that may cause personal danger; In case of personal accidents, we should actively cooperate with them.
To provide voluntary services for large-scale social activities, the event organizer shall, in accordance with the agreement with volunteers, voluntary service organizations or other organizations, purchase corresponding personal accident insurance for volunteers.
Twenty-third volunteer service organizations to arrange volunteers to participate in volunteer service activities, should be timely personal basic information of volunteers, volunteer service, training, recognition and reward, evaluation and other related information input to the volunteer service information system designated by the civil affairs department of the State Council.
Twenty-fourth volunteers and volunteer service organizations to carry out volunteer service activities, should respect the wishes of the volunteer service object, and shall not harm the legitimate rights and interests of the volunteer service object, and shall not charge or collect remuneration from the volunteer service object in disguise.
No organization or individual may forcibly assign volunteers or voluntary service organizations to provide services, and may not engage in profit-making activities in the name of voluntary service.
Twenty-fifth encourage and support state organs, enterprises and institutions, people's organizations and social organizations to set up volunteer service teams and carry out professional volunteer service activities.
Encourage and support volunteers with professional knowledge and skills in education, medicine, psychology, law, science and technology, literature and art, sports, disaster prevention, mitigation and relief, and provide professional volunteer services.
Twenty-sixth encourage volunteers and voluntary service organizations to give priority to providing voluntary services to minors, the elderly, the disabled and other special groups.
Chapter V Promotion Measures
Twenty-seventh people's governments at all levels should take volunteer service as an important part of spiritual civilization construction and formulate policies and measures to promote the development of volunteer service.
People's governments at all levels and their relevant departments can support the operation and management of voluntary services by purchasing services according to law, and disclose the relevant information such as the project catalogue, service standards and capital budget of purchasing services to the public in accordance with relevant state regulations.
Twenty-eighth encourage and support qualified places to set up voluntary service federations according to law and establish voluntary service training bases.
Encourage institutions of higher learning, research institutes and social organizations to carry out voluntary service research.
Article 29 Where conditions permit, a voluntary service foundation may be established according to law to provide support and guarantee for the development of voluntary service.
Natural persons, legal persons and other organizations that donate property for voluntary service shall enjoy preferential tax treatment according to law.
Thirtieth volunteers and volunteer service organizations that have made outstanding contributions in the development of volunteer service shall be commended and rewarded by the people's governments at or above the county level or the relevant departments in accordance with laws, regulations and the relevant provisions of the state and province.
Thirty-first encourage enterprises and other organizations to give priority to recruiting volunteers with good volunteer service records under the same conditions. The civil service examination and the recruitment of public institutions can include the situation of voluntary service in the scope of investigation.
Encourage public service institutions to give preferential treatment to volunteers with good volunteer service records.
The standards for the identification of volunteers with good volunteer service records shall be implemented in accordance with the relevant provisions of the state and the province.
Thirty-second schools, families and society should cultivate teenagers' awareness and ability of voluntary service, and encourage and support teenagers to participate in voluntary service activities within their capabilities.
The administrative department of education should incorporate the awareness and ability of youth volunteer service into the content of quality education.
* * * The Communist Youth League shall do a good job in youth volunteer service in accordance with its articles of association, guide young people to actively participate in volunteer service activities, and cooperate with relevant departments to do a good job in volunteer service.
Institutions of higher learning and secondary vocational schools should support students to carry out corresponding volunteer service activities, carry out relevant volunteer service training according to needs, support the construction of volunteer service student associations, and incorporate students' participation in volunteer service activities into social practice and other credit management.
Thirty-third civil affairs departments of people's governments at or above the county level shall encourage social work service institutions and voluntary service organizations to establish a linkage mechanism and cooperate in organizational planning, project operation and resource sharing.
Encourage and support urban and rural communities and voluntary service organizations to recruit social work professionals and promote the professionalization and standardization of voluntary service.
Thirty-fourth encourage and support insurance companies to develop voluntary service-related insurance according to the characteristics and development needs of voluntary service.
Thirty-fifth units and organizations that carry out volunteer service shall record the years of volunteer service in accordance with the relevant provisions of the state and the province, and may encourage and give back to volunteers in combination with service time and service quality.
When volunteers need help, they can be given preferential treatment according to their accumulated volunteer service time and service quality.
Thirty-sixth for volunteers with good volunteer service records, the people's governments at or above the county level and their relevant departments can take measures such as giving priority to volunteer service, taking public transport, visiting tourist attractions, enjoying health checkups, and conducting skills training free of charge.
Encourage state organs, social organizations, enterprises, institutions and other organizations to provide convenience and corresponding preferential treatment for volunteers.
Thirty-seventh to encourage public cultural places, service windows, airport stations, square parks, scenic spots and other voluntary service places.
Thirty-eighth to encourage the use of information technology to strengthen the supply and demand of volunteer service docking, and guide volunteer service organizations to disclose their volunteer skills, expertise and service time and other information, and organically combine with the demand for volunteer service.
Article 39 Promote the establishment of a cooperation mechanism for the integrated development of volunteer service in the Yangtze River Delta region, carry out volunteer service cooperation in personnel training, cultural tourism promotion, medical care and education, and realize the sharing of volunteer service resources and information interconnection.
Chapter VI Legal Liability
Article 40 Disputes between volunteers, volunteer service organizations and volunteer service objects in volunteer service activities can be settled through negotiation and mediation, or they can apply for arbitration or bring a lawsuit to the people's court according to law.
Forty-first organizations and individuals engaged in profit-making activities in the name of voluntary service shall be investigated and dealt with by civil affairs and market supervision departments according to law.
Forty-second civil affairs departments of people's governments at or above the county level and other relevant departments and their staff in any of the following circumstances, the supervisory organ or other relevant organs shall order them to make corrections; If punishment should be given according to law, the supervisory organ or other relevant organs shall give punishment to the directly responsible person in charge and other directly responsible personnel:
(1) Forcibly assigning volunteers and voluntary service organizations to provide services;
(2) Failing to perform the duties of supervision and management according to law;
(three) other acts of abuse of power, dereliction of duty, favoritism.
Forty-third acts in violation of these regulations, laws and administrative regulations have been punished, from its provisions.
Chapter VII Supplementary Provisions
Article 44 These Regulations shall come into force from June 65438+10 +2020 10.
