Regulations of Zhaoqing Municipality on the Governance of Rural Human Settlements

Chapter I General Provisions Article 1 In order to improve the rural living environment, build an ecologically livable beautiful countryside and promote the implementation of the rural revitalization strategy, these Regulations are formulated in accordance with the provisions of the People's Republic of China (PRC) Rural Revitalization Promotion Law, the People's Republic of China (PRC) Urban and Rural Planning Law and other laws and regulations, and in combination with the actual situation of this Municipality. Article 2 These Regulations shall apply to the governance of rural human settlements and related management activities within the administrative area of this Municipality.

The governance of rural human settlements as mentioned in these Regulations refers to the planning, construction, management and supervision of rural human settlements with village planning, rural housing construction control, domestic garbage management, domestic sewage treatment, toilet renovation and village landscaping as the main contents. Third rural human settlements governance adhere to the principle of government-led, villagers' main body, social support and systematic governance. The fourth is to establish a working mechanism of municipal overall planning, county-level responsibility and township (street) implementation.

The Municipal People's Government shall make overall coordination on the governance of rural human settlements in the city and strengthen supervision and management.

County (city, district) people's governments shall organize the implementation of rural human settlements governance within their respective administrative areas, formulate governance implementation plans, define governance objectives, coordinate the use of funds, ensure infrastructure construction and capital investment, and promote related work in a scientific and orderly manner.

Township people's governments (street offices) shall, according to the governance objectives set by the people's governments of counties (cities, districts), formulate governance plans for rural human settlements within their respective administrative areas, clarify governance priorities, organize the implementation of rural human settlements governance, strengthen law enforcement, supervision and management, and guide and urge village-level organizations, relevant units and individuals to implement governance responsibilities. Fifth city and county (city, district) people's government departments in charge of agriculture and rural areas shall be responsible for the overall coordination, guidance, supervision and inspection of rural human settlements governance within their respective administrative areas.

City, county (city, district) people's government development and reform, civil affairs, finance, natural resources, ecological environment, housing and urban and rural construction, transportation, water conservancy, health, forestry and other departments are responsible for rural human settlements governance within their respective functions and duties. Sixth villagers' committees shall assist and cooperate with the Township People's governments (street offices) to organize the management of rural human settlements.

Villagers' committees should give full play to the role of villagers' autonomy, incorporate the main contents of rural human settlements governance into village rules and regulations, and handle public affairs and public welfare undertakings of rural human settlements governance according to law.

The villagers' committee shall guarantee the villagers' right to participate in the governance of human settlements according to law. Respect the wishes of villagers, reasonably determine the priority of human settlements governance in the village according to the governance priorities and villagers' needs determined by the government, listen to villagers' opinions or suggestions on the planning, construction, management and supervision of governance projects, and report to the government and relevant functional departments in a timely manner. Improve the publicity system of rural human settlements governance projects. Strengthen publicity and education to guide villagers to practice a healthy, green and civilized lifestyle.

Villagers should fulfill their obligations of human settlements protection and governance according to law and enjoy the achievements of human settlements construction. Seventh cities, counties (cities, districts) and township people's governments (street offices) should strengthen the publicity and education of rural human settlements governance, and enhance the public's awareness of participating in rural human settlements protection and governance activities.

Newspapers, radio, television, internet and other news media should carry out public welfare propaganda and public opinion supervision on the protection and governance of rural human settlements.

The competent education department shall incorporate the legal norms, scientific knowledge and civilized habits related to the protection and governance of rural human settlements into the education and social practice of schools and kindergartens. Chapter II Village Planning and Construction Article 8 Village planning and construction shall follow the principles of first planning, first examination and approval, then construction, adapting measures to local conditions, protecting ecology and intensive economy, and embody local culture, regional characteristics and rural features. Ninth Township People's government is responsible for organizing the preparation of village planning.

Village planning in rural areas outside the boundaries of urban development should conform to the requirements of national and provincial village planning standards, implement the binding indicators and control bottom line determined by the superior land space planning, coordinate village development goals, ecological protection and restoration, protection of cultivated land and permanent basic farmland, historical and cultural heritage and protection, layout of infrastructure and basic public service facilities, industrial development space, layout of rural housing, village safety and disaster prevention and reduction, and define the projects to be implemented in the near future.

Village planning should take the form of field survey, household survey, questionnaire survey and meeting to listen to opinions and suggestions, and fully understand the local natural and cultural features, village infrastructure and public service facilities, rural housing construction and industrial development. And do a good job in the preliminary research of planning and design.

The Township People's Government where the traditional village is located shall organize the preparation of the protection and development plan of the traditional village within one year after the publication of the list of traditional villages, and incorporate it into the village plan. Article 10 The draft village plan prepared by the Township People's Government shall be submitted to the county (city, district) people's government for examination and approval after being discussed and agreed by the villagers' meeting or the villagers' representative meeting according to law.

Approved village planning is the legal basis for carrying out land space development and protection activities, implementing land space use control, issuing planning permission for rural construction projects and carrying out various constructions. No unit or individual may change it without authorization.

Approved village planning, the Township People's government and the villagers' committee shall be publicized and published for a long time in accordance with the provisions, so as to facilitate villagers' inquiry and supervision of implementation.

The competent department of natural resources of the people's governments of cities and counties (cities, districts) shall strengthen the supervision and guidance on the preparation and implementation of village planning, regularly carry out village planning evaluation, and enhance the pertinence, effectiveness and practicability of the planning.
