Regulations of Kunming Municipality on Promoting Aged Care Services

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly, the Regulations of Yunnan Province on the Protection of the Rights and Interests of the Elderly and other laws and regulations, combined with the actual situation of this Municipality, in order to standardize the work of the aged care service, improve the aged care service system, promote the healthy development of the aged care service and carry forward the socialist core values. Article 2 These Regulations shall apply to the aged care service and its development, promotion, supervision and management within the administrative area of this Municipality.

The term "aged care service" as mentioned in these Regulations refers to the life care, rehabilitation care, health management, cultural entertainment, spiritual comfort, hospice care, emergency rescue and other services provided by the government and society for the elderly with service needs. Article 3 Old-age care services shall follow the principles of government-led, overall development, social participation, market operation, basic guarantee and moderate universal benefits, and build an old-age care service system based on home, supported by community, supplemented by institutions, and combined with medical care to meet diversified old-age care service needs. Article 4 The people's governments of cities and counties (cities, districts) shall incorporate the work of aged care services into the national economic and social development plan and the rural revitalization plan, establish a fund guarantee mechanism that is compatible with the level of economic and social development, the aging population and the demand for aged care services, incorporate the required funds into the fiscal budget at the same level, encourage social input, and guide social forces to participate in aged care services.

Township (town) people's governments and sub-district offices are specifically responsible for organizing and implementing the work of old-age care services within their respective regions, and guiding neighborhood (village) committees and old-age care service organizations to do a good job in old-age care services. Article 5 The civil affairs departments of cities and counties (cities, districts) shall be responsible for the guidance, supervision and management of pension services, organize relevant departments to improve and perfect relevant standards and technical specifications for pension services, and promote their implementation.

The health department is responsible for promoting the combination of medical care and health services for the elderly.

The medical security department is responsible for organizing the implementation of the long-term care insurance system and implementing the relevant medical insurance policies of combining medical care with nursing care.

Development and reform, finance, auditing, natural resources planning, housing and urban construction, urban management, agriculture and rural areas, human resources and social security, industry and information technology, public security, education and sports, emergency, market supervision, fire rescue and other departments and institutions shall, according to their respective functions and duties, work together to do a good job in providing aged care services.

Trade unions, Communist Youth League, Women's Federation, Disabled Persons' Federation, Red Cross Society, Association for Science and Technology and other people's organizations and social organizations, according to their duties or articles of association, give full play to their respective advantages and actively participate in the work related to aged care services. Sixth encourage social forces to participate in the work of old-age care services, and promote the development of old-age care services through cooperation between the government and social capital, public construction and private operation.

Encourage citizens, legal persons and other organizations to participate in and support pension services in various ways.

Radio, television, newspapers, Internet and other news media should strengthen the publicity of old-age care services, and create a good social atmosphere of providing for the elderly, showing filial piety, respecting and helping the elderly. Seventh city and county (city, district) people's governments shall, in accordance with the relevant provisions, commend or reward the units and individuals that have made remarkable achievements in the work of providing for the aged. Chapter II Planning and Construction Article 8 The municipal civil affairs department shall, jointly with the municipal development and reform, natural resources planning, finance and other departments, formulate a special plan for the old-age service facilities in this city according to the economic and social development level of this city, the development trend of the aging population, the distribution of the elderly population and the demand for old-age services, and according to the standard that the per capita land is not less than 0.2 square meters, and organize the implementation after the approval of the Municipal People's Government.

County (city, district) people's government shall, according to the special plan of the city's old-age service facilities, formulate the construction plan of the old-age service facilities in this administrative region, and report it to the municipal civil affairs department for the record.

Encourage county (city, district) people's governments, township (town) people's governments and sub-district offices to plan and build elderly residential areas (spots) according to the concentrated living conditions of residents (villages). Article 9 The natural resources planning department shall, according to the national spatial planning and the special planning of the old-age service facilities, guarantee the land for the construction of the old-age service facilities and provide the land in accordance with the relevant provisions.

In accordance with the relevant regulations and requirements, rural collective construction land can be used to build old-age service facilities. Tenth new urban areas and new residential areas should be in accordance with the planning and standards supporting the construction of old-age service facilities, old-age service facilities should be synchronized with residential projects planning, synchronous construction, synchronous acceptance, synchronous delivery.

Newly built residential areas supporting community home care service housing, in the land transfer conditions, land transfer contracts and other documents agreed property rights, handed over to the local civil affairs department.

The newly-built residential community projects developed by stages, and the supporting community home care service houses should be arranged in the first phase of construction and shall not be divided. For the project that cannot be arranged in the first phase, the supporting housing for community home care services should be completed simultaneously before 50% of the total living scale is completed.

After the completion of facilities such as supporting the construction of old-age service houses in newly-built residential quarters, the housing and urban-rural construction departments shall participate in joint acceptance with the civil affairs departments.

Old-age service institutions shall accept the supervision of local civil affairs departments to ensure the use of old-age services. Article 11 If the home-based facilities for the aged without community in the built residential area can't meet the requirements and construction standards, the county (city, district) people's government can use idle factories, schools, community houses and public facilities to configure them as old-age facilities through new construction, reconstruction, expansion, purchase, replacement and lease.

State organs, people's organizations and institutions can give priority to the transformation of old-age service facilities.

Encourage villagers' committees, villagers' groups and collective economic organizations to make use of idle factories, schools, collective houses and public facilities and transform them into old-age service facilities.

In accordance with the provisions of the use of idle factories, schools, community housing decoration facilities for the elderly, you can temporarily change the nature of the property, and go through the fire design review, acceptance, filing and other related procedures, by the local civil affairs department is responsible for supervision and management.
