Provisional Regulations on Real Estate Registration, Article 4
The State implements a unified registration system for real estate. Real estate registration follows the principles of strict management, stability and continuity, and convenience for the public. Real estate rights already enjoyed by real estate rights holders in accordance with the law shall not be affected by changes in registration organizations and registration procedures.
Article 502 of the Civil Code
Contracts established in accordance with the law shall take effect from the time of their formation, unless otherwise provided for by law or agreed upon by the parties. Where a contract is subject to approval or other formalities in accordance with the provisions of laws or administrative regulations, such provisions shall apply. If the failure to apply for approval or other formalities affects the entry into force of the contract, it does not affect the validity of the provisions of the contract on the fulfillment of the obligation to apply for approval or other related provisions. If the party that should have gone through the formalities of applying for approval, etc., fails to fulfill its obligations, the other party may request it to bear the responsibility of violating such obligations. In accordance with the provisions of laws and administrative regulations, the change, transfer, termination of the contract should be approved and other procedures, the provisions of the preceding paragraph shall apply.
