According to the provisions of the Regulations on Work Injury Insurance, workers who are injured at work and identified as having a first-degree disability are entitled to the following treatment:
1. Costs required for the treatment of work-related injuries are in line with the directory of diagnostic and therapeutic items of work-related injuries, the directory of medicines for work-related injuries and the standard of hospitalization services for work-related injuries insurance and are paid out of the work-related injuries insurance fund;
2. The hospital meal allowance is paid according to the standard stipulated by the province or city;
3. The cost of installing medical equipment is confirmed by the Labor Capacity Appraisal Committee and is paid by the Work Injury Insurance Fund according to the stipulated standard;
4. If a person is suspended from work to receive medical treatment for the injury, the original salary and welfare benefits will remain unchanged during the period of suspension without pay, and will be paid by his/her employer on a monthly basis;
5. If a person can not take care of himself/herself during the hospitalization stage of care by the employer;
6, from the workers' compensation insurance fund to pay 25 months of my salary one-time disability benefit;
7, from the workers' compensation insurance fund to pay the labor capacity appraisal fee;
8, retaining the labor relationship, withdrawal from work, from the workers' compensation insurance fund according to the salary of 90% of the payment of disability allowance, the actual amount of disability allowance is lower than the local If the actual amount of the disability allowance is lower than the local minimum wage standard, the Employment Injury Insurance Fund will make up the difference; the employer and the individual employee will pay the basic medical insurance premiums with the disability allowance as the base amount.
When an injured worker reaches the retirement age and goes through the retirement procedure, the disability allowance will be stopped, and he/she will enjoy the basic pension insurance treatment in accordance with the state regulations; if the basic pension insurance treatment is lower than the disability allowance, the difference will be made up by the Work Injury Insurance Fund.
9. Monthly living care expenses shall be paid by the Industrial Injury Insurance Fund according to the standard confirmed by the Labor Capacity Appraisal Committee.
The person's salary refers to the average monthly contribution salary for the 12 months before the injured worker suffered accidental injury at work or suffered from occupational disease.
If the employer does not participate in the work injury insurance, the employer shall pay all the expenses.
Regulations on Work-Related Injury Insurance
Article 34 If an injured worker has been assessed as having a grade of disability and has been recognized by the Labor Capacity Appraisal Committee as in need of nursing care, the monthly nursing care fee shall be paid from the Work-Related Injury Insurance Fund.
Life care expenses are paid according to three different grades, namely, totally unable to take care of oneself, mostly unable to take care of oneself, or partially unable to take care of oneself, and the standard is 50%, 40%, or 30% of the average monthly salary of the employees in the previous year of the coordinated area respectively.
Article 35 If an employee who is disabled at work is appraised as having Grade I to Grade IV disability, he/she shall retain his/her labor relationship, withdraw from work, and enjoy the following treatments:
(1) A lump-sum disability benefit shall be paid from the Work-Related Injury Insurance Fund in accordance with the grade of the disability, and the standard shall be: 27 months of his/her own wages for Grade I disability, 25 months of his/her own wages for Grade II disability, 23 months of his/her own wages for Grade III disability, and 23 months of his/her own wages for Grade IV disability. The standard is 27 months' salary for first-degree disability, 25 months' salary for second-degree disability, 23 months' salary for third-degree disability, and 21 months' salary for fourth-degree disability.
(2) Disability allowance is paid monthly from the Workers' Compensation Insurance Fund at the rate of 90% of the salary for Grade 1 disability, 85% of the salary for Grade 2 disability, 80% of the salary for Grade 3 disability, and 75% of the salary for Grade 4 disability. If the actual amount of the disability allowance is lower than the local minimum wage standard, the difference will be made up by the Work Injury Insurance Fund
(3) After the injured worker reaches the retirement age and goes through the retirement procedures, the disability allowance will be stopped, and he will enjoy the basic pension insurance treatment in accordance with the state regulations, and the difference will be made up by the Work Injury Insurance Fund in the case that the basic pension insurance treatment is lower than the disability allowance.
If an employee is disabled at work and is recognized as having a Grade 1 to Grade 4 disability, the employer and the individual employee shall pay the basic medical insurance premiums with the disability allowance as the base amount.
